This chapter discusses defences that exempt certain activities from infringement on the basis of their transient or incidental character. These tend to be of paramount importance in cases of electronic communications and, more specifically, on the Internet as a result of the very nature and function of online networks. The exception available for temporary copying, for instance, which features in Article 5(1) of the Information Society Directive, has specifically been drafted with a view to covering online activities, such as caching and browsing, that enhance the efficiency of the Internet. Subject to discussion is the temporary copying exception in its broader contextual framework, including the relevant statutory provisions and case law, such as Infopaq I and II, Football Association Premier League, Meltwater, and Filmspeler decisions. It is argued that although Article 5(1) of the Information Society Directive takes, organically, the form of a copyright exception, the relevant provision should be better understood to be setting a scope limitation on the reproduction right and an exemption from copyright infringement.

This contribution recounts the historical development and expansion of the reproduction right in copyright in response to, and as a result of, technological developments, with a focus on the music reproduction right. It is shown how the very first copyright statute, the Statute of Anne, was enacted in response to the effects of a technological development, namely the invention of the printing press, which had been experienced over some time. To safeguard the interests of rightsholders, the Statute of Anne gave rise to and was itself epitomised by the reproduction right (the right to copy or print). The uncertainty with regard to the question of whether the Statute of Anne applied only in respect of books and other literary works, or whether it also extended to musical works, was resolved in the case of Bach v Longman, which extended the application of the Statute to musical works. It was particularly in the area of musical works that the reproduction right was further developed in the wake of rapid technological developments that emerged at the end of the nineteenth century and have continued into the digital age. This has led to the expansion of the music reproduction right into a multi-pronged right, covering usages made possible by the various technological developments, thus creating increased sources of income for rights-holders. Using a historical and contextual analysis, the contribution recounts these developments and their continuing relevance today.

From 1909 to 1930, U.S. courts grappled with claims by authors of prose works claiming that works in a new art form – silent movies – had infringed their copyrights. These cases laid the groundwork for much of modern copyright law, from their broad expansion of the reproduction right, to their puzzled grappling with the question how to compare works in dissimilar media, to their confusion over what sort of evidence should be relevant to show copyrightability, copying and infringement. Some of those cases – in particular, Nichols v. Universal Pictures – are canonical today. They are not, however, well-understood. In particular, the problem at the heart of most of these cases – how to imagine a work consisting entirely of pictures as infringing a work made entirely of words – has largely vanished from our consciousness. A better understanding of these early cases casts into clearer light copyright doctrines and practices we take for granted today.

This article addresses the problems presented by the effective overlap ofcopyright's exclusive rights in the context of transmission on computernetworks. Simple activities such as sending email or posting to Web pagesmay implicate the reproduction right, the adaptation right, thedistribution right, the performance and display rights, and the new digitalperformance as well as triggering liability for contributory infringementand under the proposed transmission right. The article suggests that thisoverlap creates serious problems not only for user rights and defenses, butalso for copyright owners who wish to license only a subset of their rightsor who wish to divide ownership of their copyright. The article considersas possible solutions to this problem a theory of implied license, as wellas a unified statutory transmission right that displaces other exclusiverights.

Reproduction process is really not a dangerous activity because it has gender rights reflected in the supporting components, i.e. ability, success, and safety. In the social reality, however, it is found different, as the high mortality rates of mothers and children, the appearance of sexual intercourse disease, and the side effects of contraceptive use. Biran Affandi, in his writing, describes social realities of the reproduction health which tends to be in the high risky point especially for women. All of these are as the consequence of the individuals who do not adhere their reproduction right.
