Paying careful attention to his use of language, this chapter introduces Albert the Great’s contribution to natural rights into the scholarly debate between subjective and objective rights. Teacher of Thomas Aquinas, Albert’s work on ius naturale has been overshadowed in many aspects by the significance and impact of his student’s. However, Albert’s early appearance on the stage of empirical sciences as a student of nature has been widely recognized. Eclectic in his use of sources, Albert would generously use Stoic writings, and would become as well a first-rate commentator of Aristotle’s works. As a theologian, Albert’s Augustinian influences cannot be neglected. The text examined here, De bono (1242), constitutes an early and thorough elaboration of an original doctrine of natural right and, importantly, of natural rights.

Ranging over a host of issues, Property Rights: A Re-Examination pinpoints and addresses a number of theoretical problems at the heart of property theory. Part 1 reconsiders and refutes the bundle of rights picture of property and the related nominalist theories of property, showing that ownership reflects a tripartite structure of title, the right to immediate, exclusive, possession, and the power to licence what would otherwise be a trespass, and to transfer ownership. Part 2 explores in detail the Hohfeldian theory of jural relations, in particular liberties and powers and Hohfeld’s concept of ‘multital’ jural relations, and shows that this theory fails to illuminate the nature of property rights, and indeed obscures much that it is vital to understand about them. Part 3 considers the form and justification of property rights, beginning with the relation an owner’s liberty to use her property and her ‘right to exclude’, with particular reference to the tort of nuisance. Next up for consideration is the Kantian theory of property rights, the deficiencies of which lead us to understand that the only natural right to things is a form of use- or usufructory-right. Part 3 concludes by addressing the ever-vexed question of property rights in land.

Summary Aim: Although visual color determination is the most frequently applied method in dentistry, instrumental color analysis offers advantages like objectivity, measurability and rapidity. The aim of this study was to evaluate the natural teeth color in teeth without any restoration visually, and by using a computerized shade measuring and analyzing system in the population.Materials and Methods: 202 patients were inspected. Before instrumental shade matching visual matching was done by the inspector with Vitapan 3D Master Shade Guide in the day light. Images were taken with computerized shade measuring and analyzing system from patients’ natural right or left maxillary incisors and canines without any restoration. Then these images were evaluated by the original software of its own.Results: Value differences between visual and instrumental shade matching were statistically significant. Darker value levels were obtained with instrumental measurement. The distribution of hue was more reddish in instrumental examination than visual examination. Significant difference was found at cervical and middle third of the tooth in both visual and instrumental determination of chroma. Chroma of the tooth was higher at these two regions in visual assessment.Conclusions: Teeth colors were distributed more uniform in visual shade matching compared to instrumental matching. However, some teeth shades were more common in instrumental matching. Value scores were found higher with instrumental shade matching. Individual selection of shades for each tooth and different regions of a tooth instead of a single color is considered to be a factor to increase the success of the restoration.

At least since Matthew Arnold exploited the term Zeitgeist in Literature and Dogma, the expression has been variously a source of irritation and confusion to a number of his critics. Identifying it with a tendency to disparage the past, an exasperated contemporary reviewer of that work in Blackwood's Edinburgh Magazine cried, “Can anything be more unscientific than such a spirit? It is the very apotheosis of self-opinion intoxicated by its own pride, and flaunting its own dogmatisms with a crude audacity in the face of preceding dogmas.” Among other critics of Arnold, R. H. Hutton protested that the Zeitgeist was a will-o'-the-wisp “who misleads us at least as much as he enlightens”; W. H. Dawson concluded that for Arnold it was “a fetish, a talisman, a thaumaturgy”; for W. H. Paul it became a bore; Hugh Kingsmill began his caricature of Don Matthew, “So forth he sallied, mounted on Zeit-Geist, a hobby horse.” Still others, less annoyed than these by the reiteration, have themselves borrowed it as they write of him—sometimes effectively, because with consistency of meaning, as H. F. Lowry in his edition of Arnold's letters to Clough; sometimes bewilderingly, as when one reads such a statement as this: “Expediency, which had become in Burke's hands an anti-revolutionary doctrine, was equated by Arnold with the Zeitgeist, a force which, in his conception of it, was quite as revolutionary as that of natural right.”

It evolved over the course of several centuries and was arguably the defining notion in both Hobbes’ and Spinoza’s doctrines of natural right. Yet Leibniz appears to effect a reversal in this millennium-long trajectory and demotes power to a derivative term of his philosophy. What was the rationale behind this radical change?
