War-Making and Mediation in Civil Wars: Three Ideal Types of Third Parties and Ripeness Concepts

After surveying the literature on the causes, consequences, and management of civil wars, we argue that novel ways of examining civil war management are needed. We advocate for a developmental view of civil wars in order to better understand how to prevent the escalation of low-level armed conflict to full-scale civil war. To prevent full-scale civil war, third parties need to (a) respond swiftly, (b) have the will and ability to impose tangible costs on (and offer benefits to) governments and rebels, and (c) remain involved over the long term. Our analysis shows that typical third-party civil war management approaches (mediation, peacekeeping, and intervention) fail to adequately address at least one of these issues. This motivates our argument in favor of focusing on a different type of third party that could arguably play a particularly constructive role in civil war prevention: highly structured intergovernmental organizations.

AbstractThe current scholarly literature on the international mediation of civil wars draws predominantly on a rationalist-materialist perspective. This perspective suggests that the ticket to mediation success is the material manipulation of the bargaining environment by third parties with a high degree of economic and military resources. I argue that legitimacy also determines outcomes of mediation because if a mediator has legitimacy, it can continue to look for a mutually satisfactory outcome and try to pull the conflict parties toward compliance. I show that legitimacy matters by systematically comparing the effectiveness of African and non-African third parties. African third parties are typically considered ineffective because of a low degree of economic and military capacity. However, they effectively mediate civil wars in Africa because of a high degree of legitimacy, which is a result of a strong conviction within the African society of states that African mediation is the most desirable type in conflicts there. Drawing on data from the Uppsala Conflict Data Program supplemented with unique data, which together cover all mediation efforts in Africa between 1960 and 2017, I find quantitative evidence supporting the effectiveness of African third parties. Compared to non-African ones, African third parties are far more likely to conclude negotiated settlements that are more likely to be durable. African third parties are especially effective if the conflict parties are highly committed to the African solutions norm. Theoretically, this study deviates from much of the literature that puts forward solely rationalist-materialist explanations of mediation success. By bringing legitimacy to the forefront, this article supplements the current mediation literature that emphasizes material sources of power and ignores social structures.

Third-party states consider the regional destabilization consequences of civil wars when deciding to intervene. However, previous work implicitly assumes that potential interveners base their intervention decisions solely on their links to the civil war country. This approach is unlikely to reflect the regional concerns of interested parties. When a civil war is increasingly likely to infect its surrounding region, potential interveners with strong interests in those states neighboring the conflict will be more likely to intervene to contain the violence. Thus, relationships outside the civil war state—intervener dyad are causally associated with intervention. To test these arguments, the author accounts for the contagious properties of civil wars and the regional interests of third parties, constructing dynamic measures to represent the contagion threat posed to third party regional interests. Analyses of these measures support the argument that third parties are increasingly likely to intervene as the risk of diffusion increasingly threatens their regional interests.

The literature on conflict management offers two explanations of why the effectiveness of third parties to settle militarized disputes differs. The structural research tradition focuses on conflict characteristics, while the individualist approaches highlight the background, skills and power of a mediator, as well as the mediation strategy. This article reconciles these two approaches, and examines especially the effectiveness of mediation strategies. Accounting for the selection of mediation and the success of mediation attempts, we use the CWM 1945–2004 dataset. The analysis demonstrates that mediators who were able to pursue a determined strategy face a higher chance of success.

In recent years, the law in the area of recovered memories in child sexual abuse cases has developed rapidly. See J.K. Murray, “Repression, Memory & Suggestibility: A Call for Limitations on the Admissibility of Repressed Memory Testimony in Abuse Trials,” University of Colorado Law Review, 66 (1995): 477-522, at 479. Three cases have defined the scope of liability to third parties. The cases, decided within six months of each other, all involved lawsuits by third parties against therapists, based on treatment in which the patients recovered memories of sexual abuse. The New Hampshire Supreme Court, in Hungerford v. Jones, 722 A.2d 478 (N.H. 1998), allowed such a claim to survive, while the supreme courts in Iowa, in J.A.H. v. Wadle & Associates, 589 N.W.2d 256 (Iowa 1999), and California, in Eear v. Sills, 82 Cal. Rptr. 281 (1991), rejected lawsuits brought by nonpatients for professional liability.

This paper describes the use of the Defense Mechanism Test as an aid in helping to assess senior executives in four areas: for selection, development, career strategy, and crisis intervention. The origins of this test, developed to measure the defense mechanisms used to protect the individual from stress, are described. The paper shows how it was used to predict the capacity of trainee fighter pilots to withstand stress and its later application to other stressful occupations. Finally, some ideal types of the test are shown followed by four real test profiles, two of them with their associated histories.
