An evaluation of EIA system performance in Turkey in the context of procedural effectiveness

Purpose In Turkey, where the environmental impact assessment (EIA) has been applied since 1993, there have been numerous amendments in the legal and administrative process of the EIA. This study aims to evaluate the effectiveness of those amendments to the EIA process. Design/methodology/approach This paper evaluated EIA system performance in the context of procedural effectiveness in Turkey from the day implementation was begun. From its beginning to the present day, the positive and negative developments at the EIA process in Turkey caused by the amendments were evaluated and at which stages. Measures recommended increasing the effectiveness of each of the EIA systems were also identified. Findings As the EIA Directive first came into force in the USA in 1970, EIA procedures have been widely adopted throughout the world. Although it has been implemented for many years, expectations regarding the EIA process have still not been realized which has forced countries to conduct studies to increase the effectiveness of the EIA process. Turkey, like other countries that are implementing the EIA, acknowledges that the EIA is a significant impact assessment tool and continues its studies to implement this system effectively. In this respect, in Turkey, where the EIA has been applied since 1993, there have been numerous amendments in the legal and administrative process of the EIA. Originality/value The results obtained from this study were expected to facilitate the evaluation of the EIA process in Turkey and to guide other similar countries.

Purpose The purpose of this paper is to review the Rwandan Environmental Impact Assessment (EIA) practice and identify the possible constraints faced by EIA practitioners in Rwanda. The results presented here will help to highlight strengths and weakness of the Rwandan EIA practice. Design/methodology/approach The EIA practice was evaluated by a self-administered questionnaire survey for respondents including approved EIA experts in Rwanda, government agencies involved in EIA process and corporate which have received environmental clearance. The aspects of practices and challenges were evaluated and include the suitability of institutional arrangements, the scientific methodological bases of EIA, the conduct of EIA, the effectiveness of EIA with respect to influence decision making, overall results and EIA as a learning process. These aspects were rated on different scales by the respondents to identify where the Rwandan EIA practice stands now in terms of strengths, weaknesses, opportunities and constraints. Findings The institutional arrangements of EIA were judged to be good overall by the respondents with main strengths being seen in the policy and legal base, and the scope of application. Only the marginal weaknesses are seen in the monitoring. The scientific and empirical basis for assessment was judged to stand moderately strengthened during the last five years. The performance of key activities is more than satisfactory. A majority of Rwandan EIA stages are good and excellent to some extent. Originality/value This paper identifies some of the constraints and challenges faced by the Rwandan EIA practitioners. It will contribute to an understanding of EIA practice and robust practices across the globe.

PurposeDuring the 1920s and into the 1930s, German‐language work on consumer behavior led the world; for example, segmentation was clearly discussed from the late 1920s. The purpose of this paper is to show how marketing thought in Germany and Austria reached a peak even as the environmental substructure that sustained it was being seriously eroded by political and economic changes that forever consigned it to a peripheral position upon the world stage.Design/methodology/approachThe design of the study is a critical historical one relying heavily upon documents produced during the period discussed. Statements are weighed and evaluated.FindingsThe paper finds that very impressive, at times world‐leading, work was being done in the 1920s and early 1930s, particularly in the areas of segmentation and what would later become known as consumer behavior. Much of what later became known as Motivation Research, or example, was pioneered in Germany and Austria before 1934.Research limitations/ implicationsThe primary implication is that a great deal of marketing thought developed outside the USA, sometimes drawing upon US marketing thought, in other cases developing completely independently. A second implication is that marketing thought can be weakened by political and economic conditions, as Germany and Austria painfully experienced.Originality/valueThis is the first study to explore historical German and Austrian marketing thought in a cross‐cultural manner, comparing and contrasting them with thought developed elsewhere.

Purpose The astonishing thing about Wikipedia is that despite the way it is produced, the product is as good as it is and not far worse. But this is no reason for complacency. As others have documented, Wikipedia has representational blind spots, produced by the nature of its editorial community and their discursive conventions. This article wishes to look at the potential effect of sources on certain of these blind spots.Design/methodology/approach The author used an extended example, the Wikipedia article on the Philippine–American War, to illustrate the unfortunate effects that accompany a lack of attention to the kind of sources used to produce narratives for the online encyclopaedia. The Philippine–American War article was chosen because of its importance to American history. The war brought to the fore a debate over the future of the USA and the legitimacy of a republic acquiring overseas colonies. It remains controversial today, making it essential that its representation on Wikipedia is soundly constructed.Findings Inattention to sources (a lack of bibliographical imagination) produces representational anomalies. Certain sources are privileged when they should not be and others are ignored or considered as sub-standard. Overall, the epistemological boundaries of the article in terms of what the editorial community considers reliable and what the community of scholars producing knowledge about the war think as reliable do not overlap to the extent that they should. The resulting narrative is therefore less rich than it otherwise could be.Originality/value While there exists a growing literature on the representational blind spots of Wikipedia (gender, class, geographical region and so on), the focus has been on the composition of the demographics of the editorial community. But equally important to the problem of representation are the sources used by that community. Much literature has been written that seeks to portray the social world of the marginalized, but it is not used on Wikipedia, despite it easily meeting the criteria for reliability set by the Wikipedia community. This is a tragic oversight that makes Wikipedia's aim to be a repository for the knowledge of the world, a laudable goal to strive for, even if in reality unobtainable, even harder to achieve than ever.

Abstract It is rare to find an environmental law development or ‘innovation’ announced or celebrated without some discussion of its transferability. Discourses of diffusion are becoming increasingly central to the way that we develop, communicate and frame environmental law ideas. And yet, this significant dimension of environmental law practice seems to have outgrown existing conceptual scaffolding and scholarly vocabularies. The concept, and intentionally unfamiliar terminology, of ‘contagious lawmaking’ creates a space for both fleshing out, and problematizing, the phenomenon of the dynamic and multi-directional transfer of environmental law ideas. This article sets the stage for further study of the global diffusion of environmental law. It does so by identifying the phenomenon of contagious lawmaking and by making explicit some of the terminological and methodological challenges implicated in its study. The article draws on narratives of the ‘global’ diffusion of environmental impact assessment, cited as ‘the most widely adopted environmental management tool in the world’.

Purpose The purpose of this paper is to review recent examples of sophisticated money laundering operations involving financial institutions in Eurasia, including Russia and Moldova, and the resulting flow of licit and illicit capital from that part of the world to the UK, the USA, and other Western countries. Design/methodology/approach Relying on materials from publicly available sources, the study uses several case studies to illustrate various money laundering methods with a view toward identifying common elements and aspects of the schemes that might be considered new or innovative. Findings In particular, the study examines the roles that lax anti-money laundering compliance by financial institutions and the use of shell corporations designed to conceal the beneficial ownership of the companies and their assets have played in virtually all of the money laundering schemes. Originality/value The paper discusses the risks that these emerging money laundering methods pose to Western countries and their financial institutions and the approaches that governments might take to minimize those risks and raise the barriers for the laundering of illicit funds within their jurisdictions.

Environmental impact assessment (EIA) and other related forms of assessment require decision-makers to take into account the environmental implications of an activity before making a decision about those acitvities. EIA is a feature of most environmental law systems of the world. This chapter is an overview of the Environmental impact assessment (EIA) and strategic environmental assessment (SEA) legal regimes in the EU and how they have been implemented into English law. It provides an overview of the distinctive legal nature of both EIA and SEA, the main legal features of each directive, and how they have been implemented into national law. A significant feature of this chapter is that it provides an overview of the case law of the CJEU and UK courts concerninig these regimes.
