This article calls for an increased use of strategic litigation in the anti-trafficking field to ensure long-lasting systemic reforms. While generally, the prosecution of human trafficking or related severe forms of labour exploitation, like forced labour, is quite challenging and prosecutions and convictions lag seriously behind, it is argued that strategic litigation, meaning continuing legal action, aimed at achieving rights-related changes in law, policy, practice, and/or public awareness, can help to ensure that justice is delivered to victims, as several landmark cases also show. Efforts to counter human trafficking through strategic litigation by NGOs remain in their infancy, among others as they are resource-intensive and require access to experienced lawyers in high level courts. The author discusses some examples and dilemmas and identifies needs for NGOs to use strategic litigation more often as an effective tool to effectuate systemic change.

The police have the responsibility to balance public protection from harm by respecting the human rights of suspects during prevention and investigation. However, it is difficult to achieve absolute balance because it is determined based on the police because the process or model of crime control, especially in the case of special investigative techniques, is a confidential investigation of serious crimes based on the principles of legality, necessity, proportionality, and adequate protection. The purpose of the doctrinal article evaluates the role of special crime investigation techniques for human trafficking in Ethiopia. Data is collected through document review and interviews with crime investigators, intentionally and in direct contact. Qualitative research and descriptive design. The collected data is analyzed thematically. Research findings that there are some special investigative technical provisions in FDRE criminal justice policies, human trafficking and smuggling of migrant proclamations. However, this legal basis is not as comprehensive as specific types of investigation techniques, who did it and for how long, the requirements for doing this were not answered. Therefore, the House of Representatives must make a law covering all specific investigative techniques for human trafficking in Ethiopia. The Attorney General must also create public awareness about it.

Tulisan ini—dengan merujuk kepada tema besar “Kekerasan Gender Berbasis Online di Era Pandemi”—mencoba memaparkan bagaimana kontribusi sistem kapitalisme, budaya patriarki, dan globalisasi dalam mendukung lestarinya kekerasan gender secara daring yang sedang marak terjadi di tengah pandemi. Temuan pada tulisan menunjukkan bahwa sistem kapitalisme memegang peranan kunci dalam mendorong terciptanya budaya patriarki dan globalisasi, yang pada akhirnya mendorong langgengnya kekerasan berbasis gender. Berangkat dari perspektif marxist-feminism dengan premis utama bahwa sistem kapitalisme melakukan aksi eksploitasi atas kaum proletar dengan melegalkan segala cara termasuk membangun kesadaran palsu—false consciousness, temuan pada tulisan akan dielaborasikan lebih lanjut melalui tiga bahasan utama. Pertama, akan dipaparkan temuan bahwa opresi terhadap kaum wanita di tengah lingkungan yang patriarki merupakan salah satu upaya manifestasi elit kapitalis untuk melanggengkan sistem kapitalisme. Kedua, komodifikasi wanita—seperti isu human trafficking— dipercaya sebagai konsekuensi dari sistem kapitalis yang memberikan kebebasan komodifikasi atas segala sumber daya. Terakhir, akan dipaparkan fenomena globalisasi—sebagai salah satu produk liberalisme-kapital—yang dipercaya telah mendorong masifnya aksi human trafficking berbasis daring. Pada akhirnya, melalui temuan dan bahasan terkait kapitalisme sebagai sistem kunci yang telah melanggengkan kekerasan berbasis gender, diharapkan akan muncul kesadaran publik sehingga muncul aksi emansipasi dalam mendorong runtuhnya sisi eksploitatif sistem kapitalisme secara umum dan kekerasan berbasis gender secara khusus. ===== This paper—referring to the big theme of “Online-Based Gender Violence in the Pandemic Era”—tries to explain the contribution of the capitalist system, patriarchal culture, and globalization in supporting the sustainability of gender-based violence that is currently rife in the midst of a pandemic. The findings in this paper show that the capitalist system plays a key role in encouraging the creation of a patriarchal culture and globalization, which in turn encourages the perpetuation of gender-based violence. Departing from the perspective of marxist-feminism with the main premise that the capitalist system exploits the proletariat by legalizing all means, including building false consciousness, the findings in this paper will be further elaborated through three main topics. First, the findings will be presented that the oppression of women in a patriarchal environment is one of the manifestations of the capitalist elite to perpetuate the capitalist system. Second, the commodification of women—such as the issue of human trafficking—is believed to be a consequence of the capitalist system that provides freedom for the commodification of all resources. Finally, we will describe the phenomenon of globalization—as one of the products of capital-liberalism—which is believed to have encouraged the massive action of online-based human trafficking. In the end, through findings and discussions related to capitalism as a key system that has perpetuated gender-based violence, it is hoped that public awareness will emerge so that emancipation actions emerge in encouraging the collapse of the exploitative side of the capitalist system in general and gender-based violence in particular.

In the West African sub-region, the trend of trafficking in persons is widespread; and the phenomenon now attaining its peak unhindered, has actually portrayed Nigeria as a nation occupying a central position as an originating state, transit and destination for victims of trafficking. There is also evidence of internal trafficking from rural zones to cities. The menace of human trafficking in Nigerian state has taken an indescribable facet in the last two decades owing to the factors of; massive unemployment, poverty, recession in the economy, conflicts, globalization, existing weak legal system, and inadequate legislation, and political will. Trafficking in person is an organized crime and a modern form of slavery. The two methods used by traffickers to get their victims are deception and through force. Human trafficking has continued to strive in Nigeria because of shameful connivance among the Nigeria’s security agencies, Embassies, airline officials and human traffickers. The study adopts Marcus Felson and Lawrence Cohen’s Routine Activity and the Kevin Bales’ Modern Slavery theories (1979; 1999). 500 copies of questionnaire were administered to a set of purposively selected respondents with the In-Depth Interview Guide to elicit information on the subject. The study in its findings reveals that human trafficking has continued to strive in Nigeria because of connivance from the security, immigration, embassy, airline officials and traffickers while the menace has put Nigeria’s identity black in the global system. The study therefore recommended that the Nigerian government should swiftly endeavour to address the issue of massive unemployment and poverty in the state as well as create enabling environments for entrepreneurship for the citizenry; also the national laws, international conventions and protocols that have legal potencies to curb trafficking must be implemented or strengthened; and finally, fighting human trafficking in Nigeria requires more efforts to create public awareness of the crime, organize counseling, rehabilitation and re-integration program for the victims.

In response to increasing public awareness of human trafficking in the United States, the Victims of Trafficking and Violence Protection Act (TVPA) was signed into law by President Bill Clinton in October of 2000. The TVPA consolidated existing legislation to create a comprehensive civil remedy; this ensures that trafficking victims are no longer forced to seek redress under multiple criminal and civil statutes that target only components of the human trafficking offense. However, despite its status as the first comprehensive anti-trafficking legislation to be enacted in the United States, the TVPA fails to sufficiently address human trafficking concerns. It is suggested that the failure of the TVPA is a result of both the prosecutorial focus of the legislation, a focus which tends to overlook victims’ civil rights, and the contingency of TVPA benefits upon adherence to the prosecutorial process. In response to the shortcomings of the TVPA, the legislation was amended by the Trafficking Victims Protection Reauthorization Act of 2003 (TVPRA) to provide a civil remedy for trafficking victims. The civil remedy confers on trafficking victims the private right to vindicate their civil rights and hold their traffickers directly accountable for their exploitative acts. By directly compensating victims, the civil remedy acts as a financial deterrent against traffickers and provides a private enforcement anti-trafficking policy. In pursuing the civil remedy, trafficking victims possess several advantages over the prosecutorial process of the TVPA and other civil causes of action. However, despite its advantages, the civil remedy is infrequently utilized thus frustrating congressional intent that victims advance antitrafficking policy by enforcing a civil remedy against their traffickers.

Climate change is not a new topic, but it remains an unsolved issue for most countries in the world. Singapore, a small island nation, is not spared from climate change. The issue is worsened because Singapore is not endowed with natural resources and the country is mainly dependent on imported fossil fuels to generate energy. The burning of fossil fuels releases carbon into the air, intensifying the greenhouse effect. Furthermore, the recurring episodes of haze in Singapore have posed a threat to public health. Realizing the importance of public perceptions on climate change mitigation, the Singapore government and academic researchers have conducted studies to understand public perceptions of climate change. Although the general public do not have great concern about climate change, research suggests that interpersonal communication, information campaigns, and mass communication may have an impact on public awareness of climate change. Attention to mass media, such as newspapers and television, has been found to shape public perception of climate change in Singapore and increase public knowledge of climate change. In addition, the Singapore government has introduced the topic of climate change into the education system to cultivate sustainability among the young generations. Campaigns and programs were funded and organized by the Singapore government as well as the non-governmental organizations to raise the awareness of climate change among Singaporeans. In order to sustain public awareness and concern about climate change, continuous communication strategies are necessary.

In 2010 Korin Lebov published her article ‘Human trafficking in Scotland’, a state-of-the-field piece that reported on the nature and extent of human trafficking and the challenges in tackling this issue. Several important developments have occurred in the period since, including new enforcement measures, the first prosecutions and convictions for human trafficking in Scottish courts, the establishment of a dedicated policing unit within Scotland’s new police service to tackle such crimes, the passage of specific human trafficking legislation through the Scottish Parliament, and, as a direct result of this legislation, the publication of a bespoke strategy by the Scottish Government to take action against human trafficking and support victims. This article draws upon the findings of a qualitative research study exploring the community impact of organized crime in Scotland and, in doing so, refracts advances in both public awareness of human trafficking and the policing response to this issue through the analytical prism of ‘invisible crimes’. Ultimately, it traces the path of human trafficking from a peripheral and largely ‘invisible’ phenomenon to becoming a core issue of concern in Scotland’s policing and community safety landscape.

Even ten years ago, the phrase “human trafficking” might have evoked blank stares in many circles. Today, the existence of a contemporary trade in human beings has blossomed fully into public awareness. Discussion of and expositions about human traffickingappear not only in sensationalist media reports, but also in many other arenas, such as film dramas, documentaries, books and articles by scholars from a variety of disciplines, activist NGO websites, and legislative chambers across the globe.However, some legal scholars as well as other scholars in the human trafficking sphere admit to a growing unease. Why? There is the sense that the label is a mushrooming monster that encompasses or swallows up all forms of human exploitation, identifies or creates stereotypical bad guys and innocent victims, and yet leaves relatively untouched the root causes of the exploitation.

This article provides a summary of research undertaken to investigate public awareness and understanding of human trafficking in Great Britain, Hungary and Ukraine. Responding to the lack of reliable empirical data on this issue, the research relies on representative national opinion surveys to assess the extent of public awareness of what constitutes human trafficking, the sources of knowledge underpinning this awareness, and respondents’ attitudes towards key dimensions of human trafficking as embedded in international and respective national legal and policy frameworks and discourses. Conceptually, this article reinforces recent calls for policy and media paradigm shifts from understanding human trafficking as a phenomenon of crime and victimhood, to, above all, a human rights concern linked to the broader issues of sustainable development and social justice. Methodologically, the study highlights the role of opinion surveys as a measure of effectiveness and impact of anti-trafficking awareness campaigns. In practical terms, the article presents a set of data which can be useful for policy-makers, anti-trafficking activists, and national media in designing impactful awareness-raising campaigns and interventions.
