The Environmental Challenges of EU Enlargement

Although the implementation of the acquis is a crucial element of the EU integration process, it is recognised as its ‘weakest link’. The implementation deficit is especially apparent with the EU environmental acquis, both in the existing member states and the accession countries. Most recently, following the accession of Croatia, the EU faces prospective enlargement to other Western Balkans countries. The author argues that there are specific problems in implementing the environmental acquis in accession countries and that the case of Serbia, or other countries of the Western Balkans, is not particularly unique. The case study used to support this argument is the implementation of the waste acquis in Serbia as it represents a highly demanding and costly policy area for national authorities and the country faces extensive legal, institutional, economic and financial challenges in implementing the environmental acquis.

The European integration process of the Western Balkans has been experiencing considerable stagnation since 2010, although the regional states have been formally following the accession stages. In spite of the remarkable achievements in the 2000s in terms of stability and engagement in reforms, the European Union (EU) conditionality policy is experiencing shortcomings in terms of tangible impact. Due also to its internal problems, the EU appears to have lost its shine in influencing domestic political agendas of the Western Balkan countries as in the case of Central and Eastern Europe (CEE) and has gradually lost the support of citizens in the region. This has had several consequences in terms of rising authoritarian practices, slowing down EU-related reforms and compliance with the acquis, some return to nationalistic rhetoric, and openness to influences of other global actors from the East, which do not necessarily maintain good relations with the EU. The enlargement fatigue that has affected the EU since the 2008 global crisis has had repercussions inside the EU institutions and domestic politics of member states. These changes have been reflected in the Union’s approach towards accession countries, undermining the credibility of the integration process and its commitment to the Western Balkans. The weakening of credibility and predictability on this path, together with the poor state capacities that characterize the Western Balkans, have produced some regress of the democracy indicators. The EU, with its conditionality, is still a determining factor in the trajectory of the countries of the region. However, there is a need to renew the commitments undertaken on both sides in order to make sure that the European perspective, stability, and democratization in the Western Balkans are irreversible and properly supported. The European Union is still considered the only game in town, but it has to face up to the enlargement fatigue and return to its leading role as an aspirational model for the Western Balkans.

The enlargement policy of the European Union (EU) aims at integrating new members following an accession path. EU conditionality policy is a delicate balancing exercise between keeping the partner countries on the accession path and upholding fundamental values. Enlargement countries are now concentrated, with the exception of Turkey, in the Western Balkans. A key challenge is that the current leaderships in many of these states are shifting their countries increasingly in an authoritarian direction. The EU now faces a situation of establishing illiberal regimes in the region and so far seems to lack the willingness and the tools to engage and counter this. The chapter finds that human rights conditionality seems to allow for less-than-honest domestic compliance, where the EU’s requests are (mis)used to boost the power of domestic leadership. The stated principles of the EU can clash with the state’s actual performance for various reasons, including the prioritization of more direct economic interests or security goals. Conditionality tends to remain shallow as it is built on conditions that are easy to implement and measure but remain largely formal (for example, setting up an institution, adopting legislation). In the case of the Western Balkans, our research findings indicate that the enlargement process can result in favouring strong leaders who can deliver, even if the same ‘strength’ puts human rights compliance at risk. The greatest danger is that EU integration can end up legitimising the violation of human rights by the authorities.

After four years of ambivalence, the relationship between the European Union and Serbia is again gaining a new opportunity to flourish. The new Serbian government is formed by parties which are strongly committed to Serbia?s EU integration and hence ready to carry out reforms and fully cooperate with the International Crime Tribunal for the former Yugoslavia. This paper presents the current relationship between Brussels and Belgrade and its main obstacles. It emphasizes both internal and external problems of this relationship and their interdependency. In this regard the author argues that only by a mutual commitment of both Serbia and the EU lasting peace will be achieved in the Western Balkans and the region stabilized.

The rule of law is incorporated in the EU Founding Treaties and case-law of the Court of Justice of the EU and was included as a key requirement already in 1993 Copenhagen accession criteria. The EU enlargement is not only territorial increase, but also transposition of EU acquis to third countries. Since 1993, the monitoring mechanism of the rule of law reform in the EU accession countries was enhanced, including two specific negotiation chapters, Chapter 23 – judiciary and fundamental rights and Chapter 24 – justice, freedom and security. Over the last two decades, the EU was struggling to develop an adequate mechanism in this area, from mechanism for coordination and verification, to action plans for Chapter 23, to more specific tools like perception and experience surveys of the judiciary and functional reviews. Due to the challenges to measure progress and track record in the rule of law, in February 2020 the European Commission presented the new approach to EU Enlargement that aims to push reforms forward. The intention is to make the accession negotiations more credible, predictable and dynamic and criteria for assessing reforms in the accession countries will be based on the clearer criteria and more concise EU requirements. The article examines how EU enlargement policies influenced the rule of law reforms in Western Balkan countries over the years and what could be expected from the new approach. The research hypothesis is based on the correlation between Enlargement strategy towards the Western Balkans and its impact on rule of law in countries of the mentioned region. The methodological approach applied in the assessment is based on analysis of Enlargement strategy and other EU and national documents, as well as results of the work of judicial institutions in order to provide insight into the bottlenecks of the state rule of law in Western Balkan countries and enable identification of recommendations for improvement. The authors concluded that the new methodology would improve the measurability of the achieved results in the rule of law area, however, the approach might slow down the accession process of Serbia and Montenegro as a frontrunners in the process.

In the 1970s Jagdish Bhagwati proposed the introduction of a brain drain tax to compensate less developed countries for the welfare losses they suffered as a result of outward skilled migration, but the proposal was never implemented. In light of tensions in Europe caused by the mobility of highly-skilled labour from ‘East’ to ‘West’ following the 2004 EU enlargement, this paper re-examines the feasibility of such a proposal within the Union. The disparity between levels of income and economic development in (some of) the ‘new’ and ‘old’ member states, combined with the specific European institutional environment to trigger a brain drain from the accession countries to the EU-15. Mindful of the values and specificities of the EU, I address the question of whether Bhagwati's brain drain tax could provide a solution to this problem in the European context. Combining empirical research with EU integration theory, I argue that it cannot: implementation would face obstacles even in the limited context of the EU because of the lack of appropriate supranational competences; moreover, the tax – as a compensation mechanism - could not reduce the major differences in development levels, which is the underlying cause of the problem. Nonetheless, addressing this question illuminates broader issues of the politics of enlargement and the inequities of the current EU, in spite of the benefits it has brought to its 2004 and 2007 entrants.

Trade agreements with the European Union (EU) and Central European Free Trade Agreement (CEFTA) significantly influenced the liberalisation of agri-food products in Western Balkan (WB) countries. In all Western Balkan countries, there has been an intensification of the trade of agri-food products and a partial change in the regional and commodity structures of trade. This paper aims to identify comparative advantages of agri-food sectors and consider its tendencies during the EU integration process. Additionally, this paper will discuss some opportunities for improvement of the export positions of agri-food products. In that context and based on the literature review, the indexes of revealed comparative advantages and its modified version will be used as a main method for analysis in this research. Results showed that all Western Balkan countries, except Albania, have comparative advantages in exporting agri-food products. It is evident that Serbia has the highest level of comparative advantages in this sector. Moreover, this paper suggests that all countries should aim to provide the best possible positions for their agri-food products during pre-accession negotiations for EU membership and take the necessary steps towards increasing the level of competitiveness in the common EU market.

Although according to some scholars, Serbia does not have great immigration potential, there is more and more research within social science?s framework about immigrants in Serbia. However, the majority of these papers focus on current ?migration crisis? and, in relation to this, asylum seekers and irregular migrants. Therefore, this paper has had manifold aims. Firstly, the paper has drawn attention to the anthropological study of foreigners who live and work in Serbia. Secondly, it has revealed some of the problems they had been confronted with in reality. Within this framework, the focus was on highly qualified female foreigners from the EU countries who came for love or/and work which is a topic that does not occupy a prominent place in anthropological research in Serbia. However, with regard to the EU-integration of Serbia and Europeanization of migratory policies, the research of personal experiences of foreigners living in Serbia could signify the gaps in migrants? integration policy and in the adaptation of migration strategies. Thus, in this research were used in-depth semi-structured interviews conducted in 2016 in Belgrade as a method of collecting data and the ?bottom-up? approach. As a result, in this paper were analyzed narratives of a German and a British woman about their everyday experiences connected with their residing and working status. Their narratives showed their struggle with Serbian bureaucracy and related to this, how they legalized their ?migratory status?. Furthermore, in the analysis of the micro context the term ?ethnography of particular? was used, an approach developed by Lila Abu-Lughod in order to, one the one hand, avoid generalization and, on the other, to focus on individual life histories, which is an approach usually used in socio-anthropological studies. In particular, the paper stresses the relevance of individual strategies used for regulation of residence of foreigners in Serbia. Both British and German woman are married to Serbs, have no children, speak The Serbian language, socialize mainly with the Serbs and live and work in Belgrade. While German woman came during Milosevic?s regime in 1999, the British woman came in 2002. Although they did not suffer from ?professional deskilling?, which is typical for female migration in general, they both had to prequalify in order to find a job in Serbia. However, they both found it was easier to regulate their residence status through family, not working, visa, especially before new legal documents concerning foreigners? status were introduced. For instance, the most important legal document adopted as part of EU-integration process are Law on Foreigners (2008), Law on Migration Management (2012) and Law on Employment and Work of Foreign Citizens (2014). Foreigners living in Serbia represent the important group as many of them either work or use their pensions in Serbia. Therefore, having in mind the importance of Europeanization of migratory strategies in Serbia within Europeanization of Serbia and EU-integration process in general and possible migration of EU nationals to Serbia, this paper discussed the importance of individual (working) migration to Serbia on a micro level.
