Living wages in international and European law

A number of countries worldwide provide for a statutory minimum wage. Generally speaking, however, it is not a living wage, although the right to a living wage is guaranteed in a variety of agreements under both international and European law. The Council of Europe’s European Social Charter (ESC), for example, codifies a living wage and, according to the case-law of its supervisory body, the level of 60 per cent of the net average wage is to be taken as the basis for appropriate remuneration. This article argues that the Charter of Fundamental Rights of the European Union also incorporates the right to a living wage, which should be at least 60 per cent of the net average wage. The Charter is legally binding for EU institutions, agencies and other bodies. Member States are bound only to the extent that the material scope of the relevant EU laws has been opened, which is the case when EU law is implemented or when obligations arising out of specific Union legislation are required for the relevant subject area, as will be explained in the article. In purely national situations nevertheless, values laid down in international law have to be observed when interpreting national laws.

One of the biggest challenges of European law is balancing the relations between the Member States and the European Union. An especially interesting aspect of this issue is the horizontal impact of the European Union Charter of Fundamental Rights. The authors of the article will reconstruct the jurisprudence of the Court of Justice of the European Union, which precisely settles problems related to this issue. Various examples will be examined, ranging from the renowned judgment of the Grand Chamber of the Court in Case C-617/10 Åklagaren v. Hans Åkerberg Fransson to the most recent judgment of the Grand Chamber of the Court in Joined Cases C-569/16 and C-570/16 Stadt Wuppertal v. Maria Elisabeth Bauer and Volker Willmeroth v. Martin Broßonn. The authors will also evaluate the settled case law using a holistic perspective on the whole system of European law and its principles. Horyzontalny skutek oddziaływania Karty Praw Podstawowych Unii Europejskiej w linii orzeczniczej Trybunalu Sprawiedliwosci UEJednym z największych wyzwań prawa europejskiego jest uzyskanie balansu między systemami prawnymi poszczególnych państw członkowskich a systemem Unii Europejskiej. Autorzy artykułu dokonali rekonstrukcji linii orzeczniczej Trybunału Sprawiedliwości UE, które w sposób konsekwentny rozwija wykładnię tej problematyki — od legendarnego już wyroku wielkiej izby Trybunału w sprawie C-617/10 Åklagaren przeciwko Hansowi Åkerbergowi Franssonowi po najnowszy w badanym zakresie wyrok wielkiej izby Trybunału w sprawach połączonych C‑569/16 i C‑570/16 Stadt Wuppertal przeciwko Marii Elisabeth Bauer oraz Volker Willmeroth przeciwko Martinie Broßonn. Autorzy podjęli się także ewaluacji dotychczasowej linii orzeczniczej w sposób holistyczny, biorąc pod uwagę czynniki wynikające z całego systemu prawnego UE oraz jej zasad i wartości.

The purpose of this paper is to explore whether the processing of personal data under Regulation 2017/226 is compatible with the principle of proportionality in the light of Charter of Fundamental Rights of the EU and the case-law of the Court of Justice of the European Union (CJEU). The Regulation 2017/2226 provides the EES system which is the only system that collects the entry/exit data of all third-country nationals entering the Schengen area for a short stay, whether via a land, sea or air border. The EES replaces the current system of manual stamping of passports.

The best interests of the child should be a primary consideration in all actions concerning children. This cornerstone of international children’s rights has been codified in Article 24(2) of the Charter of Fundamental Rights of the European Union. In eu family reunification law, the best interests of the child are mentioned in Directive 2003/86/ec on the right to family reunification. However, in the case law of the Court of Justice of the European Union, this concept is not systematically applied in the various types of family reunification cases. In this contribution it is argued that, although the contexts of family reunification cases may be different, from the perspective of the diverse international obligations of the Member States, it would be preferable if the Court systematically involved the best interests of the child concept in all family reunification cases.

Abstract This paper intends to discuss some major European legal issues by building on the critique of a certain narrow relevance of human basic needs, according to traditional Western legal conceptions of the subject as well as of the public-private divide. In particular it aims at verifying the potentiality of consumer law for rethinking the right to housing, within recent trends of European Private Law, by adopting a remedial approach. For this reason the paper analyzes three well-known cases decided by the Court of Justice of the European Union (CJEU) – namely Aziz, Sanchez Morcillo and Kušionová – as examples of this meaningful trend. Through the combination of the fairness test over contractual terms with the criteria of effectiveness and proportionality, a broader protection of right to housing is recognised even in horizontal private relationships. Art. 7 of the EU Charter of Fundamental Rights (CFREU) could represent the constitutional reference for this new perspective. The paper also intends to show how the relevance of the basic need for housing is traced to debtor's families. CJEU's interpretative itinerary seems to start from a fairness test about contractual terms, but eventually comes to give protection to subjective situations that are even out of the domain of the contract.

The right to good administration constitutes an established principle of European Union law, which includes the procedural rights of stakeholders in administrative proceedings, the result of which may affect their interests. Article 41 of the European Union Charter of Fundamental Rights states that every person has the right to have his or her affairs handled impartially, fairly and within a reasonable time by the institutions and bodies of the Union. When it comes to reasonable time of handling the case one can ask if eGovernment solutions are the guarantee of such a right. eGovernment understood as the use of all kinds of electronic means of communication, in particular, however, the Internet, improves services provided by the state to its citizens. The usage of IT technology in public administration allows it to perform its activities in a more efficient way. This improvement applies not only to the communication between parties but also to the quality of citizens’ life. To sum up, one can ask the question if the European right to good administration can be understood as the right to eGovernment solutions and if so, to what extent. Which services and technical solutions should be guaranteed as ones ensuring challenges of good administration?

La finalidad principal de este trabajo es analizar la eficacia vinculante de la Carta de Derechos Fundamentales de la Unión Europea en las relaciones entre particulares. Una vez apuntada brevemente la capacidad vinculante de la misma en relación al poder público (eficacia vertical), sea de la Unión o de los Estados miembros (cuando aplican Derecho de la Unión), el artículo se centra en la descripción de las diversas posiciones y argumentos en torno a la eficacia inter privatos de la Carta, esto es, a su capacidad para vincular (directa o indirectamente) a los particulares (eficacia horizontal). Puestos a ello, estas líneas se adentran, asimismo, en señalar una de las principales cuestiones a las que se enfrenta en la actualidad la jurisprudencia del Tribunal de Justicia en esta materia. Esto es, si la conexión de un derecho de la Carta con una Directiva, o su concreción en la misma, viene a fortalecer su eficacia vinculante horizontal (sabiendo que, por definición, éstas carecen de tal eficacia en las relaciones entre particulares) o invocabilidad, una cuestión que se está planteando en relación con los derechos de igualdad (particularmente, con la no discriminación) y con los derechos de solidaridad de la Carta.The main purpose of this paper is to analyze the binding effectiveness of the Charter of Fundamental Rights of the European Union in relationships between individuals. After explaining briefly its binding capacity in relation to public authorities (vertical efficacy), either in the Union or in the Member States (when applying Union law), the article focuses on the description of the various positions and arguments about the inter privatos effectiveness of the Charter, that is, its ability to bind or constrain (directly or indirectly) individuals (horizontal effectiveness). In that respect, these lines also aim at one of the main issues the Court’s case-law is currently facing in this area: whether the connection of a Charter right with a Directive, or its realization in it, strengthens its horizontal binding effectiveness (knowing that, by definition, these rights lack of efficacy in the relationships between individuals), or its invocability, an issue that is being raised in relation to the Charter’s rights of equality (particularly, non-discrimination) and of solidarity.

IS the right to vote in European Parliament elections a matter for EU law? Until recently, the answer to this query seemed to be a clear “no”. Indeed, while Article 223(1) of the TFEU does confer on the European Union the competence to lay down a uniform procedure for the election of Members of the European Parliament (“MEPs”), this competence has not been exercised so far. Consequently, Article 8 of the Act concerning the election of the MEPs by direct universal suffrage, annexed to Council Decision 76/787/ECSC, EEC, Euratom (OJ 1976 L 278 p. 1, henceforth “the 1976 Act”), provides that the “electoral procedure shall be governed in each Member State by its national provisions”. Apart from the general principles of “direct universal suffrage in a free and secret ballot” and of non-discrimination on the ground of nationality, enshrined respectively in Article 14(3) of the TEU, Article 1(3) of the 1976 Act, and Article 20(2)(b) of the TFEU, there is nothing in EU law that governs specifically the eligibility to vote in EP elections.

In a recent judgment in ERGO Poist’ovňa, a.s. v Alžbeta Barlíková, the Court of Justice of the European Union attempted to clarify the ambit of Article 11 of Council Directive of 18 December 1986 on the coordination of the laws of the Member States relating to self-employed commercial agents, that is the circumstances where a commercial agent’s right to remuneration may be extinguished should a negotiated transaction not be executed between the principal and the client. Notably, the Court held that in the event of even partial non-execution of a negotiated contract between the principal and the third party client, provided it happened due to no fault on the part of the principal, the agent’s right to commission is proportionately extinguished. The paper discusses the judgment in the light of previous CJEU case law and the Polish transposition of the said European standards with a view to finding any potential divergences between the two. The paper notes two problems. First, Polish law, as opposed to Slovak law, does not recognize an automatic termination of an insurance contract in the event of default on the part of the customer. Conversely, whether such an effect eventuates is left to contractual discretion of the parties. Second, Polish courts have been recently willing to substitute unjust enrichment for contractual liability even where, it appears, complainants have valid claims under Article 7614 of the Civil Code.
