AbstractThe adoption of the Rome Statute of the International Criminal Court (ICC) was widely lauded as a success with regard to the recognition and potential prosecution of conflict-related sexual violence. More than twenty years later, however, many observers are disillusioned with the ICC’s dire track record concerning the implementation of its progressive legal framework. In many cases, the Court and particularly its Prosecutor have been criticized for failing to adequately address and prioritize sexual violence, culminating in only a single final conviction since 2002. Nevertheless, the ICC’s emerging practice shows progress with regard to the conceptual understanding of conflict-related sexual violence and the realization of the Statute’s full potential in ensuring accountability for sexual crimes. Taking into account the evolving jurisprudence, the Article explores the persisting challenges and the perceived gap between aspirations and reality regarding the prosecution of sexual violence at the ICC.

- A large number of studies have aimed at outlining the personality profile of sex offenders; however, due to the heterogenousness of such crime and their perpetrators, this task is very difficult. This study attempts to highlight the different types of sex offenders, their personality profiles, their possible defence mechanisms. Methods: Subjects of this study are male prisoners detained in a special section of the district penitentiary in Velletri (Rome, Italy). All subjects (N=8) were convicted of sexual crimes towards children and/or women. Their mean age is 51. Prisoners on remand were not included in this study. The adopted tools are: a Grid for collecting the anamnesis and the information regarding the crime; the Big Five Questionnaire; the Sesamo. Results and conclusions: Results proved the difficulties to outline a personality profile of sex offenders, but pointed out some common psycho-sexual aspects. These aspects were probably related to the prison situation of the subjects. Key words: sex offenders; personality profile; district penitentiary.

<p>Penjatuhan sanksi pidana terhadap pelaku kejahatan kesusilaan pada anak di Indonesia belum seimbang dengan dampak yang ditimbulkannya. Adapun anak sebagai korban dari kejahatan kesusilaan tentu mengalami trauma yang berkepanjangan hingga dewasa bahkan seumur hidupnya. Salah satu upaya yang dapat ditempuh dalam menghadapi problematika penegakan hukum adalah dengan cara pembenahan sistem hukum. Oleh karna itu perlu adanya pembaharuan sanksi pidana bagi pelaku kejahatan kesusilaan sebagai bagian dari sistem hukum. Pembaharuan ini perlu dilakukan karena sanksi pidana yang ada saat ini tidak memberikan efek jera bagi pelaku. Upaya pembaruan hukum pidana yang berkaitan dengan sanksi pidana dalam kasus kejahatan kesusilaan pada anak dapat ditelusuri berdasarkan perumusan sanksi pidana berdasarkan KUHP, UU Nomor 23 Tahun 2002 tentang Perlindungan Anak, UU Nomor 35 Tahun 2014 tentang perubahan pertama atas UU Nomor 23 Tahun 2002 tentang Perlindungan Anak, dan Peraturan Pemerintah Pengganti Undang-Undang (Perppu) No. 1 Tahun 2016 tentang Perubahan Kedua atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Dengan demikian tulisan ini secara fokus mengkaji urgensi pembaharuan hukum pidana, khususnya hukum pidana materiil tentang sanksi pidana bagi pelaku kejahatan seksual dalam rangka untuk memberikan perlindungan pada anak korban kejahatan seksual.</p><p><em>The imposition of criminal sanctions against the perpetrators of morality in children in Indonesia has not been balanced by its impact. As for the child as a victim of crime decency certainly traumatized prolonged until adulthood even a lifetime. One effort that can be taken in dealing with the problem of law enforcement is to reform the legal system. By because it is necessary to reform criminal sanctions for the perpetrators of decency as part of the legal system. These reforms need to be done because there is a criminal sanction which does not currently provide a deterrent effect on perpetrators. Efforts to reform the criminal law relating to criminal sanctions in cases of crimes of morality in children can be traced by the formulation of criminal sanctions under the penal law, Law No. 23 of 2002 on Child Protection, Law No. 35 of 2014 on the First Amendment of Law No. 23 of 2002 on Child Protection, and Government Regulation in Lieu of Law (Perppu) Number 1 Year 2016 Concerning Second Amendment Act No. 23 of 2002 about Child Protection. So this paper examines the urgency updates operating focus criminal law, especially criminal law substantive about criminal sanctions for dader of sexual crimes in order to provide protection for child victims of sexual crimes.</em></p><p> </p>

This article highlights the problem of emotional perception in pedophilia (ICD-10) / pedophilia disorder (ICD-11). In present paper, emotional perception is considered as abilities of recognizing and identifying a wide range of mental states like emotions, affects, moods, feelings. The assumption about relations of alexithymia and disturbances in the recognition of emotions, perspective taking, empathy with pedophilia and regulatory mechanisms of activity verified empirically. Two groups of persons accused of sexual crimes are compared: 44 people with pedophilia, 32 people without the disorder; also 95 persons who haven't been accused were examined for the control group; as well intra-group comparison of pedophilic persons with egosyntonic and egodystonic attitude toward sexual drive was made. Contradictions of earlier studies are resolved in the result: it is shown that in pedophilia the ability of understanding emotional states remains normal at first sight (in comparison with the deficits found in the accused without pedophilia). However, the group with pedophilia is characterized by extremely high level of alexithymia and based on this the consistently conclusion is made about disturbances of emotional regulation in egosyntonic form of this disorder.

The development of technology which is rapidly increasing has an impact on children. One of the problems that lurk children is the case of child sexual abuse. The number of cases of sexual crimes against children requires an integrated effort both at home by parents and at school by teachers. But in reality, these activities are hampered by the absence of structured BK implementation in primary schools. Although there are already formal rules governing BK in basic education. The absence of special hours for guidance and counseling in elementary school also becomes an obstacle in providing information services for students. In addition, limited knowledge and misperceptions of parents about reproductive health education in children. Activities carried out by training methods. This dedication partner is TK Model SD Sleman Regency Yogyakarta, where the target of the activity of this training are TK Model SD teachers and representatives of student guardians as well as students / students. The purpose of the activity is to empower the target to be able to become a role model in providing sexual education and reproductive health for children / students. the results of this PKM activity are the BK module, the availability of child-friendly and easily accessible reproductive health promotion media, the availability of adequate BK rooms, the increase in the knowledge and skills of teachers and parents in providing sexual education / child reproductive healthKeywords:  Education, reproductive health, children
