The study aims at identifying the concept of digital library, it also tries to shed the light on the most significant intellectual issues by presenting its definition, development, functions (selection and acquisition of information resources from the web, sources indexing, communication and management of intellectual property rights, production of electronic resources and its availability, and digital resources maintaining), characteristics, and the purpose of turning into digital library, passed by the proposed stages of digital library transition, Types of Intellectual Property (Copyright, Patents, Trademarks, Commercial Secrets), it also discusses copyrights and intellectual property, the problems and challenges of digital library, and finally the future of digital library. Many researchers agree that the main objective of the digital library is to accomplish all the functions of the traditional library, but in the form of electronic digital libraries which are only an extension for jobs that are performed and the resources that are accessible in digital library. The study concluded that digital libraries emerged as an obligatory result of revolution of the third millennium which is called the communications revolution, as libraries are able to prove that they are able to stand and cope with all the modern technology, where there is no conflict between the new and modern trends in libraries issue, but it also benefits from both of them concerning their evolution instruments in service for beneficiaries in every time and place.

This chapter examines the ethical management of digital collections in a way that enhances compliance to copyright requirements. The chapter clarifies similarities and differences between the terms digital, electronic and virtual. The author emphasises that the digital librarians have a duty to preserve their professional integrity by committing to professional ideals in carrying out various information dissemination activities in a manner that guarantees positive consequences for the users, the library and all other stakeholders such as the owner of the intellectual property, the parent organization, the professional association and the society at large.

Intellectual property poses a major challenge to digital libraries. This is because access to information in digital libraries is limited by laws, licenses and technology adopted by intellectual property owners. Similarly, intellectual property renders it difficult for digital libraries to make orphan works discoverable and accessible. Furthermore, intellectual property fragments copyright ownership, making it difficult for digital libraries to obtain the right clearance on content. To cope with these challenges, digital libraries have embraced the open access movement which allows reading, copying, downloading and sharing of digital content as long as the creators of the works are cited and acknowledged. Besides, digital libraries offer access to digital works produced under creative commons licenses. These licenses give the copyright owners the liberty to modify the copyright of their works to give room for sharing, use, and building upon the work.

The development of Digital libraries and repositories, a worldwide vision with enormous political and ideological importance for humanity, in an effort to approach cultures and preserve plurality and diversity, is directly affected by the provisions of Intellectual Property Law and is subject to the consideration of innovation through legislation. Legal issues such as these related to software use, database protection, the collection, digitization, archiving, and distribution of protected works are of outmost importance for the operation and viability of Digital libraries and repositories. In this chapter, the authors focus upon some of these legal issues and consider an alternative proposal in respect of Intellectual Property law for open access to creative works furnished to the public through Digital libraries and repositories. The alternative proposal pertains to the use of the Creative Commons licenses as a legal means to enhance Openness for Digital libraries.

The present chapter deals with the challenges faced by moral rights in the digital environment, especially as they pertain to digital libraries. It starts with an introduction to issues concerning the legal framework of moral rights, clarifying their position internationally. Furthermore, specific issues regarding infringements of moral rights are addressed, namely: content digitization, practice of linking, alterations of the work during the digitization process etc. In short, the necessity of the digitization of the library’s content is elucidated and the societal demand of easy and cheap access to knowledge is presented. The author is of the opinion that moral rights, arising out of the conflict of economical interests, are easier to maintain their legal intensity. Furthermore, in the modern information society, moral rights are prone to an inter-disciplinary approach and thus, they gain intensity in the balance of interest between authors and users. More specifically, moral rights have an intricate interrelationship with social, cultural, economic and philosophical aspects as well as with Fundamental and Human Rights.
