The news media are presently filled with headline stories concerning the security of electronic communications and the internet. The Financial Times’ weekend supplement FT Money devoted three pages under the title ‘Hack attack’ and asked whether companies are doing enough to protect data online. 1 Substitute dental practices for companies and we have an unhappy picture of the reasons why so much sensitive personal data is going missing or being accessed without properly informed consent.

In cyberspace, copyright enforcement and privacy rights have become two clashing realities. In fact, with the arrival of digital technology, especially the Internet, right holders, facing massive online infringements to their reproduction or distribution exclusive rights, mainly by file-sharers on Peer-to-Peer (P2P) systems or Cloud storage systems clients, started developing more and more intrusive new enforcement strategies in electronic communications as a means to identify the infringers and the committed infractions. The goal of the chapter is to study how the boundaries between what is public or private become fainter, whether the use of tracking software is consistent with personal data protection legislation, and whether it is possible to reconcile these two human rights, proposing a reflection on a possible extension of the use of levies in order to compensate right holders for private copies originating from unlawful sources.

Resumen: El uso de internet se ha expandido de tal modo que el mundo digital constituye un elemento cotidiano de nuestras vidas. En la actualidad se adquieren constantemente bienes y servicios de carácter digital a través de la red; se almacenan documentos en la nube; se publican fotos, contenidos íntimos, opiniones, en redes sociales y blogs y se llevan a cabo juegos y actividades de ocio por medio de internet. Pero ¿qué sucede con las comunicaciones electrónicas de un sujeto, la información almacenada por él en la red o la música o libros digitales adquiridos por éste cuando muere? Este artículo analiza los problemas que presenta la transmisión “mortis causa” de los bienes digitales y pone de manifiesto la insuficiencia de las reglas generales del Derecho sucesorio para solucionarlos así como la conveniencia de contar con una regulación específica. A continuación se examinan las soluciones legales propuestas o ya adoptadas en distintos ordenamientos, con el fin de extraer conclusiones acerca del mejor modo de regular esta cuestión. Estas conclusiones se contrastan, por último, con las reglas que pretende instaurar el Proyecto de ley de Protección de Datos que se encuentra en tramitación.Palabras clave: Bienes digitales. Voluntad del difunto.Abstract: The use of the internet has been expanded in such a way that the digital world represents a daily element in our life. Nowadays, products and services –analog or digital- are constantly purchased through the internet; digital documents are stored in the cloud; pictures, private information or opinions are uploaded on social networks or blogs and games and leisure activities are carried out through the internet. But ¿what’s the fate of a person’s electronic communications when he dies, of the information stored by him on the network or of the digital music or books acquired through the internet? This paper analyzes the problems involved in the transfer of digital assets upon death and highlights that the probate system is not sufficient to solve them and specific regulation should be enacted. It continues by examining the legal solutions proposed or enacted in different legal systems with the purpose to obtain conclusions about the best way to regulate this issue. The paper considers the peculiarities of the legal protection of personal data of minors in the field of electronic communications in the European Union. The reasons for the expediency of introducing differentiated rules for minors in the context of the realization of the right to protection of personal data are substantiated. In addition, the article analyzes the provisions of Regulation (EC) 2016/679 on the protection of individuals in the processing of personal data and on the free movement of such data which entered into force in May 2018. The author reflects its innovations regarding the conditions for applying to the minors the concept of informed consent for processing and measures to verify the age of data, including the provision of services in electronic communications.

The 21st century is being characterized as the century of evolution for information technology, communication technology and electronic communications. Contemporary society does business using the internet; the forthcoming ‘dispute resolution space’ (Katsh and Rifkin 2001), where people buy and sell regularly and even a large number of corporations have existence via an internet address. This excitement for further improvement of dispute techniques, in relation to the exploitation of those technologies used for the management of online virtual communication led to the appearance of the Online Dispute Resolution (ODR) mechanism. The choice for settlement of disputes through the modern mechanism provides an easement for interested parties to tackle their disputes from any place and at any time through e-mails, video conferencing or chatrooms, instead of being in courtrooms. The fact that the business’s transactions are conducted on the internet causes uncertainty, regarding the security of personal data and business secrets in combination with the lack of a framework that could have supported such scheme. For that reason, the role of Government is taken into consideration in the accreditation of service providers, as well as in the settlement of e-administrative disputes and the securing of e-transactions in general. The necessity for self-regulation, equality of digital divide and government’s recommendation for ODR tools is discussed. The current chapter will identify and explore considerable notions, concepts and debates for moving towards the development of an international dispute resolution framework on-line and trustful mechanism internationally.

One of the non-invasive methods for treating discoloration of hard tooth tissues is teeth whitening. The aim of this work is to assess the dynamics of changes in the acid resistance of enamel and hard tissues of teeth and the rate of its remineralization after the procedure of office teeth whitening. The study involved 123 patients aged 18 to 35 years with discoloration of various origins, with the color of hard tooth tissues on the Vita Classic A2 scale and darker. Before performing the office, teeth whitening procedure, all patients gave their written voluntary informed consent to participate in this study, as well as consent to the processing of personal data. Depending on the chosen method of office teeth whitening, patients were divided into 3 groups. The resistance of hard tooth tissues was judged based on the determination of TOER and CASRE tests. These indicators were determined at various times (5 days before the office teeth whitening procedure, 5 days after it, after 14, 30 days and 6 months). Regardless of the chosen whitening system, the office teeth whitening procedure is accompanied by a decrease in the enamel's resistance to acids and a decrease in the rate of its remineralization. The remineralizing function of oral fluid promotes the positive dynamics of the studied parameters after 14 days and after 30 days values increased due to the appointment of remineralizing therapy to all patients in 2 weeks after the teeth whitening procedure. After 6 months, all patients had high enamel resistance and the rate of its remineralization.

Digitization and the release of public records on the Internet have expanded the reach and uses of criminal record data in the United States. This study analyzes the types and volume of personally identifiable data released on the Internet via two hundred public governmental websites for law enforcement, criminal courts, corrections, and criminal record repositories in each state. We find that public disclosures often include information valuable to the personal data economy, including the full name, birthdate, home address, and physical characteristics of arrestees, detainees, and defendants. Using administrative data, we also estimate the volume of data disclosed online. Our findings highlight the mass dissemination of pre-conviction data: every year, over ten million arrests, 4.5 million mug shots, and 14.7 million criminal court proceedings are digitally released at no cost. Post-conviction, approximately 6.5 million current and former prisoners and 12.5 million people with a felony conviction have a record on the Internet. While justified through public records laws, such broad disclosures reveal an imbalance between the “transparency” of data releases that facilitate monitoring of state action and those that facilitate monitoring individual people. The results show how the criminal legal system increasingly distributes Internet privacy violations and community surveillance as part of contemporary punishment.

Must the Internet promote political fragmentation? Although this is a possible outcome of personalized online news, we argue that other futures are possible and that thoughtful design could promote more socially desirable behavior. Research has shown that individuals crave opinion reinforcement more than they avoid exposure to diverse viewpoints and that, in many situations, hearing the other side is desirable. We suggest that, equipped with this knowledge, software designers ought to create tools that encourage and facilitate consumption of diverse news streams, making users, and society, better off. We propose several techniques to help achieve this goal. One approach focuses on making useful or intriguing opinion-challenges more accessible. The other centers on nudging people toward diversity by creating environments that accentuate its benefits. Advancing research in this area is critical in the face of increasingly partisan news media, and we believe these strategies can help.

Проведен анализ состояния периферического кровообращения у 28 мужчин, больных остеохондрозом поясничного отдела позвоночника, сопровождающегося люмбалгией с клинической симптоматикой нарушения периферического кровообращения нижних конечностей. Все больные, принимавшие участие в нашем исследовании, подписали информированное согласие на участие в программе и соглашение о неразглашении личных данных и протокола исследований. Критериями для анализа являлись изменения клинической симптоматики остеохондроза поясничного отдела позвоночника, обусловленной им люмбалгии и показателей оксиметрического исследования, которые были зафиксированы при первичном обращении и через 7 суток на фоне проводимого лечения и регрессии болевого синдрома. Таким образом, полученные результаты свидетельствовали о рефлекторном нарушении периферического кровообращения за счет развития патологического спинально-вазального тормозного рефлекса, обусловленного люмбалгией, которые восстанавливаются на фоне регрессии патологической импульсации в поясничном отделе позвоночника. Целесообразно продолжить исследования в этом направлении. The state of peripheral circulation in 28 men were analyzed, patients with osteochondrosis of the lumbar spine, accompanied by lumbodynia with clinical symptoms of impaired peripheral circulation of the lower extremities was carried out. All patients who took part in our study signed an informed consent to participate in the program and a non-disclosure agreement of personal data and research protocol. The criteria for the analysis were clinical symptoms of osteochondrosis of the lumbar spine caused by lumbodynia and indicators of oximetry studies, which were recorded during the initial visit and after 7 days amid treatment and regression of pain syndrome. Thus, the results indicated a reflex disorder of the peripheral circulation due to the development of a pathological spinal-vasal inhibitory reflex caused by lumbodynia, which is restored amid regression of pathological impulses in the lumbar spine. It is advisable to continue research in this direction.
