This chapter examines the state of India’s environmental law. It first provides an overview of the allocation of powers with respect to environmental protection in India, taking into consideration the relevant constitutional provisions, before discussing the structure and substance of environmental law. In particular, it explores sectoral policy frameworks that complement the legislative provisions, along with a number of important laws that deal with environmental issues, including the Water (Prevention and Control of Pollution) Act of 1974, the Wildlife (Protection) Act of 1972, the Forest (Conservation) Act of 1980, the Environment (Protection) Act of 1986, and the Public Liability Insurance Act of 1991. The chapter concludes with an analysis of the implementation framework for Indian environmental law, with emphasis on the role of the Ministry of Environment, Forests, and Climate Change; the Central Pollution Control Board; State Pollution Control Boards (SPCBs); and the judiciary.

Environment protection has become an area of grave significance in the present century, due to new developments, for saving the planet from the evils of pollution, climate change and so on. However, a new kind of pollutant, called ‘e-waste,’ has emerged due to the Internet revolution, otherwise a boon for development, but which is fast becoming one of the biggest threats to environment in the knowledge society of 21st century. It is significant to note that even the United Nations Environment Programme (UNEP) has admitted that the amount of e-waste generated per year grows rapidly. E-waste is dangerous and poses a threat to human health and environment. What is more shocking is its transportation from developed to developing countries, which is being done on a large scale and such e-waste there is being handled and disposed of unscientifically creating environmental damage. It is noteworthy that protection of the environment and e-waste management is fast becoming a major Corporate Social Responsibility (CSR). In promoting CSR as well as other responsibilities such as in the health or education sectors or poverty reduction, roughly 80 non-governmental organ sations (NGOs) (international or national) in collaboration with other actors have made sincere efforts raising awareness through campaigns by lobbying and so on. However, only a few of them are engaged in e-waste management related activates. This article is an attempt to study the role of Environmental NGOs (ENGOs) in promoting CSR, especially with regard to environment protection and e-waste management.

ABSTRACT This paper describes the genesis, composition, and functions of the Intergovernmental Maritime Consultative Organization (IMCO) and the expanding role of this United Nations specialized agency in protection of the marine environment. Focusing on the work of IMCO's Marine Environment Protection Committee (MEPC) established in the wake of the 1973 Marine Pollution Conference, the paper gives evidence of the universal concern for the oceans in the nature and scope of the family of international conventions developed under the auspices of IMCO. Also discussed is the extent to which U.S. regulations on prevention, control of, and response to marine pollution are looked at as models for international standards and, conversely, how IMCO-related activities bear upon U.S. regulations in this field. As the primary U.S. maritime regulatory and enforcement agency, the Coast Guard plays a leading role in IMCO affairs, particularly those concerned with the prevention of marine pollution. Its role in providing assistance to other IMCO member nations also is described, as are methods for mutual sharing of the latest techniques and methodologies for the prevention, control of, and response to pollution incidents.
