Pengadilan, oleh masyarakat tidak lagi dilihat sebagai lembaga penyelesaiain sengketa satu-satunya. Saat ini keberadaan lembaga pengadilan sudah terindikasi dengan berbagai kasus korupsi, kolusi, dan nepotisme, yang lebih dikenal dengan istilah KKN. Hal ini mengingat banyak produk keputusan pengadilan yang menyimpang dari asas-asas keadilan, cepat dan berbiaya murah. Dalam konteks inilah diperlukan model alternative penyelesaian sengketa pada masyararakat hukum adat yang lebih efisien, adil serta akomodatif guna menjaga kelesterian dan keberlanjutan kehidupan masyarakat hukum adat, yang lebih manusiawi dan berkeadilan. Tradisi penyelesaian sengketa pada masyarakat hukum adat didasarkan pada nilai filosofi kebersamaan (komunal), pengorbanan, nilai supernatural, dan keadilan. Dalam masyarakat hukum adat kepentingan bersama merupakan filosofi hidup yang meresap pada setiap anggota masyarakat adat. Pelaksanaan hasil mediasi yang sudah disakralkan dihadapan tokoh adat, apalagi sudah dilakukan dengan suatu upacara adat (ritual), maka kesepakatan tersebut harus dilaksanakan dengan segera, bila salah satu pihak mengingkari atau tidak bersedia melaksanakan hasil mediasi, maka pihak tersebut akan mendapatkan sanksi adat dari masyarakat hukum adat. Sanksi adat diberikan atas pertimbangan, bahwa pengingkaran kesepakatan damai merupakan bentuk pengingkaran terhadap nilai dan rasa keadilan masyarakat hukum adat. Penjatuhan sanksi adat dijatuhkan oleh tokoh adat yang bertindak sebagai penjaga nilai keadilan dan warisan leluhur dalam masyarakat hukum adat.The court, by the community is no longer seen as the only dispute resolution agency. At present the existence of a court institution has been indicated by various cases of corruption, collusion and nepotism, which are better known as KKN. This is because there are many products of court decisions that deviate from the principles of justice, fast and low cost. In this context an alternative model of dispute resolution is needed in the customary law community that is more efficient, fair and accommodative in order to maintain the sustainability and sustainability of the life of indigenous peoples, who are more humane and just. The tradition of dispute resolution in indigenous peoples is based on the values of communal philosophy, sacrifice, supernatural values, and justice. In indigenous peoples the common interest is a life philosophy that permeates every member of the indigenous community. The implementation of the mediation results that have been sacred before traditional leaders, moreover has been done with a traditional ceremony (ritual), then the agreement must be carried out immediately, if one party denies or is unwilling to carry out the mediation results, the party will get customary sanctions from the community customary law. Customary sanctions are given for consideration, that the denial of a peace agreement is a form of denial of the values and sense of justice of indigenous peoples. The imposition of customary sanctions is imposed by traditional leaders who act as guardians of the value of justice and ancestral heritage in indigenous and tribal peoples.

Wind Cave National Park (NP) in South Dakota has a long and complex history with local indigenous peoples, including the Lakotas. Wind Cave is the location of the Lakotas’ traditional origin story, and is now protected by a park representing a federal government that many indigenous peoples view negatively. The purpose of this exploratory study was to understand the attitudes of Lakotas toward Wind Cave NP and the interpretive stories it shares with visitors. Seventeen in-person interviews were conducted with Lakota people to understand their thoughts and feelings. Content analysis was used to uncover positive and negative themes about the park and various forms of interpretation. Findings indicate that park interpretation should include more Native perspectives, and recommendations are noted. The park should attempt to work more closely with Lakota and other local tribes, and can follow the examples of other National Park Service sites to accomplish these changes.

<p align="center"><strong><em>Abstract</em></strong></p><p><em>The purpose of this reseach is to describe the reality of peace at investigation levels,  then compared to islah according to Islamic law as the reason of criminal removing, to find / to know the relevance. Based on the relevance, it possible become material for the legislators to formulate islah as a model of law enforcement at the level of investigation. This research is the normative research supported by empirical research. The data used was primary and secondary data. Data was collected by means of study documentation and interviews. Data were analyzed quatitatively dan and presented quatitatively. The research showed that the completion of criminal case based on the agreement between perpetrator and victim, along the case have not reached the judge. If the agreement is violated, they agreed to use the formal law. Criminal case which are resolved with peace/islah personalized and value of the loss is relatively small. Islam placing islah as an alternative the completion of criminal matters, along the case have not reached the judge. In the literature and practice, settling disputes with peace  known as Alternative Dispute Resolution (ADR), which is based on Restorative Justice Theory. Al Qur’an has set peace/islah as a model the completion of criminal matters, long before these theories arises.  Peace/ islah in the completion of a criminal case at the level of investigation relevant to satisfy the principle of fast, simple, and inexpensive.</em></p><p><strong><em>Keyword : </em></strong><em>Islah, Islamic Law, Relevance and Investigation</em></p><p align="center"><strong>Abstrak</strong></p><p>Tujuan penelitian ini adalah mendeskripsikan realitas perdamaian pada tingkat penyidikan, selanjutnya akan dibandingkan dengan islah menurut hukum Islam sebagai alasan penghapus pidana, untuk diketahui/ ditemukan relevansinya. Berdasarkan relevansi tersebut, dimungkinkan menjadi bahan bagi pembentuk undang-undang  untuk menformulasikan islah sebagai model penegakan hukum pidana pada  tingkat penyidikan. Penelitian ini merupakan penelitian normatif  yang didukung dengan penelitian  empiris. Data yang digunakan mencakup data primer dan data sekunder. Teknik pengumpulan data  dilakukan dengan cara studi dokumentasi dan wawancara. Data dianalisis secara kualitatif dan disajikan secara deskriptif. Hasil penelitian menunjukan penyelesaian perkara pidana dengan perdamaian pada tingkat penyidikan mendasarkan kesepakatan pelaku dan korban. Apabila kesepakatan itu dilanggar, mereka sepakat untuk menggunakan hukum formal. Perkara pidana yang diselesaikan dengan perdamaian/ islah, bersifat personal dan nilai kerugiannya relatif kecil. Islam menempatkan perdamaian/islah sebagai alternatif penyelesaian perkara pidana, sepanjang perkara tersebut belum sampai ke tangan hakim. Dalam literatur dan praktik,  penyelesaian perkara dengan perdamaian disebut <em>Alternative Disput Resolution </em>(ADR) yang mendasarkan pada teori <em>Restorative Justice. Al-Qur’an </em>telah menetapkan Perdamaian/ Islam sebagai model penyelesaian perkara pidana, jauh sebelum teori-teori itu muncul<em>. Perdamaian/ Islah  </em>dalam penyelesaian perkara pidana ditingkat penyidikan, relevan untuk pemenuhan asas cepat, sederhana dan biaya ringan.</p><p><strong>Kata Kunci: </strong>Islah, Hukum Islam, Relevansi dan Penyidikan</p>

The resolution of a criminal offence does not have to be carried out through legal channels. Still, it can be done in the spirit of restorative justice, one of which uses the principle of ADR (Alternative Dispute Resolution) or (win-win solution) through the Rembuk Pekon which means through consensus agreement. This study aims to determine what crimes can be resolved with the Pekon consultation, how the process is resolved, and what the legal consequences are. This study uses an empirical normative method by examining the methods, norms, rules and primary data through observation and interviews, the results of the study indicate that the types of criminal acts that can be resolved with Rembuk Pekon include minor criminal offences Article 302, Article 352 paragraph (1), Article 364, Article 373, Article 379, Article 482, Article 315, Article 407 paragraph 1, and the criminal offence of complaint Article 284 of the Criminal Code. So in this study will discuss how the process of resolving minor criminal cases through the Rembuk Pekon and the authors have a suggestion that the police should implement the Rembuk Pekon to prioritize the principles of professional, modern and reliable, this so that the implementation of the Rembuk Pekon can run optimally.

Tax dispute resolution has a number of uniqueness. Its judiciary system takes a procedure starting from filing objections in the executive realm, appeals and filing lawsuits as well as judicial review in the judicial realm. All of these legal remedies do not delay the obligation of the tax payers to pay taxes and the task of Fiscus to collect taxes. Dispute settlement using administrative power has weaknesses as the resolver is one of the parties in the dispute (the Fiscus). Judicial branc of power come to play to settle tax disputes through the Tax Court. No cassation in the settlement of tax disputes as judicial remedies. All settlements of tax disputes are aim at otaining justice. When there is a tax dispute between Fiscus and the Taxpayers the path of mediation is advised. This normative legal research has found that mediation in the settlement of tax disputes by the Tax Court is a form of Dignified Restorative Justice in the form of Dignified Mediation as it is in line with the Pancasila values and virtues. The diversion from conventional processes through mediation is also humanistic in nature, namely the effort to humanize humans, the manifestation of the Pancasila Legal System.
