Corrupted state assets certainly hurt the country narrowly, but also broadly where it harms the country and its people. However, the formal approach through the current criminal procedure law has not been able to recover the losses suffered by the state. In fact, state losses resulting from corruption are state assets that must be saved. Then there needs to be a new breakthrough to recover state losses through the asset recovery model. When looking at the country from the perspective of the victims, the state must obtain protection, in this case recovery from the losses suffered due to corruption. This paper examines the model of returning assets resulting from corruption in the law enforcement process that focuses on the rule of law in the 2003 UNCAC Convention and the mechanism of returning state assets in terms of Law No. 20 of 2001 concerning amendments to Law No. 31 of 1999 concerning Eradication of Corruption Crimes.

The amendment to the Criminal Procedure Law in China in 2018 mainly involves enhancing the system for leniency based on admission of guilt and acceptance of punishment, increasing the procedure of fast-track sentencing, improving the convergence norm between the Criminal Procedure Law and the Supervision Law, and adding the procedure for trial in absentia. These improvements and additions have positive implications for the implementation of a criminal policy of leniency and strictness, for realization of the diversion of complex situations and simple situations in the proceedings, for deepening the reform of the state’s supervisory system, for realizing the people’s procuratorate’s effective performance of legal supervision, and power and for effectively punishing crimes of corruption. However, there are limitations in the amendment of the Criminal Procedure Law in 2018. In the future, the amendment to the Criminal Procedure Law can adopt both the comprehensive amendment of the National People’s Congress and the partial amendment of its Standing Committee, so as to promote the amendment of the Criminal Procedure Law in a timely and comprehensive manner. In terms of the amendment’s content, the judicial reform results and coordination between laws should be fully considered. New regulations for the new law should be clear and enforceable. In regard to law implementation, there should be sufficient time for implementation preparation after the promulgation of the new law.

The authors analyze publications in criminal policy, study its understanding by scholars of criminal and criminal procedure law and criminology, and present their own vision of different aspects of the development and implementation of criminal policy in the Russian Federation. They examine criminal policy as a complex pheno­menon which has law enforcement and human rights dimensions aimed at counteracting crime, as a system which includes criminal law, criminal procedure, investigation, penitentiary and criminological policies; the authors present arguments in favor of using such an approach. Criminal policy cannot be designed independently from state legal policy; it should be developed with the participation of civil society institutions and should be approved by it. The main goal of this work is to determine the basics (the principles) of Russian criminal policy, to describe their contents, interconnections and interpenetration. The authors examine and analyze different approaches to specifying the principles of criminal policy. They come to the conclusion that the principles of criminal policy differ from the principles of anti-criminal branches of law, but the latter should determine the basic clauses of criminal and criminal procedure law. It is stressed that a system of principles focusing on a common goal — crime counteraction — can only be discussed within the framework of criminal policy. The authors study the international experience of criminal policy in different countries and determine four fundamental principles of criminal policy in the member states of the Council of Europe. The analysis of modern criminal law and criminal procedure legislation with its numerous changes and amendments, the identified lack of coordination and inconsistency of the actions of lawmakers allow the authors to discuss the necessity of developing a unified criminal law, criminal procedure and penitentiary policy, i.e. criminal policy in a broad sense. They conclude that it is necessary to design a document, officially recognized at the state level, that would stipulate and reflect the basics (the principles), goals and tasks, as well as the priority directions for developing the criminal policy.

Эффективность деятельности уголовно-исполнительных инспекций, а также достижение целей наказания во многом зависят от состояния законодательства, регламентирующего уголовно-процессуальные вопросы исполнения приговора. Вместе с тем имеется ряд проблемных аспектов, который требует научного осмысления и разрешения относительно правового и организационного обеспечения деятельности субъектов, вступающих в правоотношения на стадии исполнения приговора. На сегодняшний день в российском уголовно-процессуальном законодательстве некоторые вопросы, касающиеся стадии исполнения приговора, не урегулированы в удовлетворяющей науку и практику степени, к ним, в частности, следует отнести форму и содержание представлений указанных органов и учреждений, сроки назначения судебного заседания по разрешению вопросов, связанных с исполнением приговора. Указанное препятствует не только эффективной деятельности государственных органов и их должностных лиц, участвующих на стадии исполнения приговора, но и осуществлению уголовной политики государства в целом, реализации назначения уголовного судопроизводства и достижению целей головных наказаний. Так, в практической деятельности отмечается недостаточная эффективность функционирования уголовно-исполнительных инспекций в ряде регионов, не везде выполняются плановые и основные показатели их деятельности, в том числе в сфере уголовно-процессуальных правоотношений, возрастает количество предупреждений, выносимых уголовно-исполнительными инспекциями в связи с нарушением порядка и условий отбывания наказания осужденными, при этом снижается число удовлетворенных судом ходатайств о замене наказания более строгим его видом. The effectiveness of the activities of criminal executive inspections, as well as the achievement of the goals of punishment largely depend on the state of legislation regulating criminal procedural issues of execution of the sentence. At the same timethere are a number of problematic aspects that require scientific understanding and resolution regarding the legal and organizational support for the activities of entities entering into legal relations at the stage of execution of the sentence. Today in the Russian criminal procedure legislation some issues related to the stage of execution of the sentence, not resolved in a satisfying science and practice degrees to them, in particular, should include the form and content of submissions to these institutions, the terms of appointment of the hearing on the resolution of issues related to the execution of the sentence. This hinders not only the effective operation of their officials involved in the execution of the sentence, but also the implementation of the criminal policy of the state as a whole, the implementation of the appointment of criminal proceedings and the achievement of the goals of criminal penalties. Thus, in practice, there is a lack of efficiency in the functioning of criminal executive inspections in a number of regions, the planned and basic indicators of their activities are not always fulfilled, including in the sphere of criminal procedural legal relations, the number of warnings issued by criminal executive inspections in connection with the violation of the order and conditions of serving punishment by convicts is increasing, while the number of applications for the replacement of punishment by a more severe type of punishment satisfied by the court is decreasing.
