Resumen: La regulación respecto los derechos de los pasajeros en el transporte aéreo tiene por objeto que aquellos consumidores se vean completamente resarcidos por los perjuicios que pudieran sufrir en el desarrollo de su vuelo, y que el pasajero pueda hacer valer sus derechos frente al transportista u operador aéreo en caso de cancelación, denegación de embarque o retraso significativo del vuelo. Este derecho de compensación plantea cuestiones relevantes de competencia judicial internacional, a la hora de determinar los tribunales ante los que el pasajero debe acudir para ejercitar de forma efectiva su derecho. En un sector como el de transporte aéreo de pasajeros es habitual la inclusión de cláusulas de elección de tribunales dentro de las condiciones y términos del transporte impuestas por el operador y cuya eficacia habrá de evaluarse a la luz del Derecho internacional privado.Palabras clave: transporte aéreo internacional, pasajeros, Convenio de Montreal, competencia judicial internacional, Derecho aplicable.Abstract: The regulation regarding passenger passenger rights in air transport aims to ensure that consumers are fully compensated for the damages they may suffer in the development of their flight, and that the passenger can assert their rights against the carrier or operator air in case of cancellation, denied boarding or significant flight delay. This right of compensation raises relevant issues of international judicial competence when determining the courts before which the passenger must go to effectively exercise their right. In a sector such as passenger air transport, it is usual to include clauses for the selection of courts within the conditions and terms of transport imposed by the operator and whose effectiveness will have to be evaluated in the light of private international private law.Keywords: international air transport, passengers, Montreal Convention, international jurisdiction, applicable law.

<p>Abstract<br />This article aims to find out how legal protection is provided to passengers in commercial air transport <br />activities in Indonesia, especially regarding airline responsibilities to passengers and the compensation <br />provided in case of flight delays due to negligence of the carrier. This research is performed with legal <br />research, using prescriptive characteristic. The research is using statute approach by reviewing the <br />regulations related to the issues. The source of the research is derived from primary legal materials namely <br />legislation, secondary materials from legal literatures, as well as tertiary or non-legal legal material. The <br />collection of legal materials was done by literature studies, and analyzed with deductive reasoning patterns. <br />Based on the result of the research, it can be concluded that the regulation of compensations given by <br />the airlines to passengers has been quite well regulated in the Minister of Transportation Regulation <br />No. 89 of 2015, but in the implementation, the government is still less firm in cracking down on airlines <br />that do not carry out their responsibility of the compensation regulated in Regulation of the Minister of <br />Transportation Number 77 in year 2011.<br />Keywords: compensation; flight delay; commercial air transportation.</p><p>Abstrak<br />Artikel ini bertujuan mengetahui bagaimana perlindungan hukum yang diberikan kepada penumpang <br />dalam kegiatan angkutan udara komersial di Indonesia, khususnya mengenai tanggung jawab maskapai <br />penerbangan terhadap penumpang serta apa kompensasi yang diberikan apabila terjadi penundaan <br />penerbangan karena kelalaian pihak pengangkut. Penelitian ini dilakukan dengan penelitian hukum dan <br />bersifat preskriptif. Pendekatan penelitian berupa pendekatan undang-undang dengan menelaah regulasi <br />yang besangkutan dengan isu yang penulis angkat dalam penulisan ini. Sumber penelitian berasal dari <br />bahan hukum primer yaitu perundang-undangan, bahan sekunder dari kepustakaan hukum, serta bahan <br />hukum tersier atau non-hukum. Pengumpulan bahan hukum dilakukan dengan studi kepustakaan, dan <br />menganalisis dengan pola penalaran deduktif.  Berdasarkan hasil penelitian maka dapat disimpulkan <br />bahwa  pengaturan  mengenai  kompensasi  yang  diberikan  oleh  maskapai  penerbangan  terhadap <br />penumpang  telah cukup  baik  diatur dalam Peraturan Menteri Perhubungan Nomor 89 Tahun 2015, <br />namun dalam pelaksanaannya pemerintah masih kurang tegas dalam menindak maskapai yang tidak <br />melaksanakan tanggung jawabnya untuk memberikan kompensasi sesuai dengan Peraturan Menteri <br />Perhubungan Nomor 77 Tahun 2011.<br />Kata kunci: kompensasi; keterlambatan penerbangan; pengangkutan udara komersial.</p>

This chapter examines the effect of the Hague Convention on the Law Applicable to Trusts and on their Recognition (Hague Trust Convention) on the law applicable to the arbitration of trust disputes. It also considers the extent to which arbitrators can apply the conflict of laws rules of the convention in cases where the parties have not agreed that these rules should govern the issues in dispute. The chapter is organized as follows. Section II addresses the selection of the applicable substantive law by arbitral tribunals in cases where the parties have not agreed on the applicable law. Sections III and IV cover international conventions and, in particular the Hague Trust Convention, as sources for the selection of the applicable law. Section V deals with the validity and effect of arbitration agreements while Section VI considers the effects of a choice of-law-clause and the binding effect of such a clause for the arbitral proceedings. Section VII addresses the effect of specific conflict of laws rules of the Hague Trust Convention on the law applicable to the merits in international trust arbitration disputes.

The establishment of an Industry Training Board for the civil air transport industry in March 1967 provided, for the first time, a single central point of focus for the trained manpower needs of the Industry. The early months of the Board's existence were preoccupied with the establishment of its own internal administration, with the search for accommodation, and with the recruitment and selection of staff. These internal matters were largely disposed of by April 1968, and since then the Board has started to fulfil its proper function.

Resumen: El nuevo Reglamento 1104/2016 se ocupa de la competencia judicial internacional, la Ley aplicable y el reconocimiento de decisiones relativas a los efectos patrimoniales de las uniones de hecho registradas. ¿Pero qué ocurre con los efectos patrimoniales de las uniones de hecho no registradas? Estas comunidades de vida, cada vez más comunes en España, conllevan también consecuencias económicas. Cuando se acaba el amor empiezan los litigios. Los integrantes de la pareja pueden reclamar alimentos debidos, pensión por desequilibrio, adjudicación de la vivienda y del ajuar familiar o posibles derechos sucesorios. En este trabajo se analizará la competencia judicial internacional y la Ley aplicable al patrimonio de las parejas de hecho no registradas en Derecho internacional privado español.Palabras clave: Normas de producción interna, competencia judicial internacional, ley aplicable, parejas de hecho, parejas no casadas, uniones de hecho.Abstract: New Regulation 1104/2016 deals with the assessment of international jurisdiction, applicable law and extraterritorial validity of decisions relating to the patrimonial effects of registered partnerships. The patrimonial effects of unregistered couples remain subject to domestic rules. These unions are more and more common in Spain and they also entail economic consequences. When love ends, litigation starts. The former partners can proceed against each other claiming for maintenance, compensatory allowances, rights of use and occupancy of the house or household effects and potential inheritance rights. This paper addresses the determination of international jurisdiction and applicable law on these matters under Spanish private international law.Keywords: Domestic rules, international jurisdiction, applicable law, civil partnerships, unmarried couples, de facto unions.
