<p>Abstract<br />This article aims to find out how legal protection is provided to passengers in commercial air transport <br />activities in Indonesia, especially regarding airline responsibilities to passengers and the compensation <br />provided in case of flight delays due to negligence of the carrier. This research is performed with legal <br />research, using prescriptive characteristic. The research is using statute approach by reviewing the <br />regulations related to the issues. The source of the research is derived from primary legal materials namely <br />legislation, secondary materials from legal literatures, as well as tertiary or non-legal legal material. The <br />collection of legal materials was done by literature studies, and analyzed with deductive reasoning patterns. <br />Based on the result of the research, it can be concluded that the regulation of compensations given by <br />the airlines to passengers has been quite well regulated in the Minister of Transportation Regulation <br />No. 89 of 2015, but in the implementation, the government is still less firm in cracking down on airlines <br />that do not carry out their responsibility of the compensation regulated in Regulation of the Minister of <br />Transportation Number 77 in year 2011.<br />Keywords: compensation; flight delay; commercial air transportation.</p><p>Abstrak<br />Artikel ini bertujuan mengetahui bagaimana perlindungan hukum yang diberikan kepada penumpang <br />dalam kegiatan angkutan udara komersial di Indonesia, khususnya mengenai tanggung jawab maskapai <br />penerbangan terhadap penumpang serta apa kompensasi yang diberikan apabila terjadi penundaan <br />penerbangan karena kelalaian pihak pengangkut. Penelitian ini dilakukan dengan penelitian hukum dan <br />bersifat preskriptif. Pendekatan penelitian berupa pendekatan undang-undang dengan menelaah regulasi <br />yang besangkutan dengan isu yang penulis angkat dalam penulisan ini. Sumber penelitian berasal dari <br />bahan hukum primer yaitu perundang-undangan, bahan sekunder dari kepustakaan hukum, serta bahan <br />hukum tersier atau non-hukum. Pengumpulan bahan hukum dilakukan dengan studi kepustakaan, dan <br />menganalisis dengan pola penalaran deduktif.  Berdasarkan hasil penelitian maka dapat disimpulkan <br />bahwa  pengaturan  mengenai  kompensasi  yang  diberikan  oleh  maskapai  penerbangan  terhadap <br />penumpang  telah cukup  baik  diatur dalam Peraturan Menteri Perhubungan Nomor 89 Tahun 2015, <br />namun dalam pelaksanaannya pemerintah masih kurang tegas dalam menindak maskapai yang tidak <br />melaksanakan tanggung jawabnya untuk memberikan kompensasi sesuai dengan Peraturan Menteri <br />Perhubungan Nomor 77 Tahun 2011.<br />Kata kunci: kompensasi; keterlambatan penerbangan; pengangkutan udara komersial.</p>

This study aims to determine that there are still many events that are still require the liability from the commercial air transportation company, both from the carrier company and those who are related to the carrier, such as flight delays (flight delay) either caused by weather factors or internal factors from the carrier company, the occurrence of negligence from the transport officer which causes the loss of goods owned by passengers, or because of there is an event for which the reason is unknown so that the aircraft experiences interference during the flight, from the results of this research it can be seen that the carrier operating the aircraft is obliged to be responsible for losses against:a. passengers who died, disability or injury;b. lost or damaged of the cabin baggage;c. lost, destroyed, or damaged of the checked baggage;d. lost, destroyed, or damaged of the cargo;e. delay in air transportation; andf. losses suffered by third partiesas well as who are the parties involved, the requirements that must be fulfilled and how the rights and the obligations of the parties are fulfilled, as well as other provisions in its implementation if a passenger's goods are lost or damaged and provide a description of its protection.Keywords : Liability, Theft of Goods, Aircraft Passengers, Kualanamu International Airport.

ABSTRAKPengadilan Negeri Meulaboh melalui Putusan Nomor 12/Pdt.G/2012/PN.Mbo jo. Putusan Pengadilan Negeri Banda Aceh Nomor 50/Pdt/2014/PN.Bna jo. Putusan Mahkamah Agung Nomor 651 K/Pdt/2015, menghukum PT KA untuk membayar ganti rugi atas kerusakan lingkungan yang ditimbulkan sebagai akibat dari kebakaran hutan. Putusan Peninjauan Kembali Nomor 1 PK/Pdt/2017 yang dimohonkan PT KA juga menolak permohonan peninjauan kembali PT KA. Ketika Kementerian Lingkungan Hidup dan Kehutanan mengajukan perintah eksekusi, justru Pengadilan Negeri Meulaboh menerbitkan Penetapan Nomor 1/Pen/Pdt/Eks/2017/PN.Mbo yang menunda eksekusi dan memberikan perlindungan hukum kepada PT KA, dengan alasan PT KA sedang mengajukan gugatan baru kepada pemerintah. Permasalahan dalam penelitian ini apakah Penetapan Nomor 1 Pen/Pdt/Eks/2017/PN.Mbo dapat menunda putusan pengadilan yang telah berkekuatan hukum tetap. Metode dalam penelitian ini adalah yuridis normatif dengan pengambilan data secara kepustakaan dengan cara berpikir deduktif dalam melakukan verifikasi data. Bagian pembahasan penelitian ini akan diuraikan bahwa penetapan dalam kasus PT KA ini akan menimbulkan ketidakpastian hukum dalam peradilan dan dikhawatirkan akan menjadi preseden baru yang kontraproduktif dalam penegakan hukum dan dapat disimpulkan bahwa penetapan tersebut melanggar prinsip hukum acara.Kata kunci: penetapan, eksekusi, preseden baru. ABSTRACTMeulaboh District Court through its Decision Number 12/Pdt.G/2012/PN.Mbo in conjunction with Decision of the Banda Aceh District Court Number 50/Pdt/2014/PN.Bna in conjunction with Supreme Court Decision Number 651 K/Pdt/2015, sentenced PT KA to pay compensation for environmental damage due to forest fires. PT KA filed an extraordinary request for review which was then rejected through Court Decision Number 1 PK/Pdt/2017. By the time the Ministry of Environment and Forestry filed a writ of execution, the District Court of Meulaboh issued the Injuction Number 1/Pen/Pdt/Eks/2017/PN.Mbo which ordered postponement of the execution and granted a legal protection to PT KA with the legal basis that PT KA was filing a new claim against the government. The main problem is whether the Injunction of Court Number 1/Pen/Pdt/Eks/2017/PN.Mbo can delay a court decision that has a permanent legal force. This research is conducted through normative juridical method based on literature sources by means of deductive reasoning in data verifying. The discussion in this research shows and explains that the injunction in the case of PT KA will cause legal uncertainty in judicial proceeding and is feared to create a new precedent that is counterproductive in law enforcement. The research concludes that the injunction has violated the main principle of procedural law.Keywords: injunction, execution, new precedent.

Over the past decade, the air transport system has undergone profound changes, mainly driven by the evolution of reference legislation and markets globalization process. The primary cause also goes by the name of "deregulation", which has profoundly revolutionized the tariff methodology and air transport management.With deregulation, airlines have seen disappear of barriers and constraints that incentivized growth and development for many years (Arrigo, Giuricin, 2006; Postorino, 2009).The globalization of markets has also proved decisive in the growth of demand for air transport, which has become an irreplaceable means of transfer that allows the connection from one part of the terrestrial globe to another in a few hours. Impressive growth in air traffic and deregulation has at the same time led to millions of frequent passengers and unpleasant complications, such as delays. In the absence of a specific discipline in this area and with the desire to give balance to a situation partially unbalanced to the detriment of consumers/travelers, the European Union decided to take action to remedy it, equipping passengers with effective protection tools against these afore mentioned situations.The European Union has made the rules issued in 1991 on compensation and assistance to air passengers more rigid and afflictive for airlines by providing, at the same time, new provisions aimed at mitigating the inconvenience of passengers abandoned at airports due to canceled flights or of prolonged delays. The EU legislation covering these changes, which was preceded by the Passenger Rights White Paper, is contained in EU Regulation 261/1994, which came into force in February 2005, which sets out how and operational rules on assistance and reimbursement to air traffic users (Fraschina, 2009).The three different hypotheses of "denied boarding", cancelled flights and prolonged delays are the subject of regulation.In this study, however, we will mainly address the rights and reimbursement of passengers in the event of delays of air flights, in fact according to the new legislation, more protection will be provided to passengers who will face the painful and common circumstances of the delays. Community bodies believed that adequate assistance and reimbursement should be provided to passengers who were forced to long waits at airports due to a flight delay.

Flight is an activity that is very vulnerable to weather conditions. The accuracy of weather information strongly supports flight activities. The effects of bad weather on flights include flight delays and flight cancellations. Based on data on flight delays from the Directorate General of Air Transportation of the Ministry of Transportation from January to March 2019 at Husein Sastranegara Airport, it is known that 20-30% of flight delays are caused by weather constraints. To estimate flight delays based on weather forecasts, weather data analysis is carried out to determine the type of weather that is endangering flights and causing flight delays. The analysis was carried out using the K-NN and Random Forest algorithms

Transportation is currently divided into three types, namely land transportation, sea transportation and air transportation. Nowadays, many people prefer to use air transportation since air transportation can travel long distances in a relatively shorter time. However, it is not infrequently for airlines to cause losses to consumers, especially to people with disabilities.  Where as fact people with disabilities should get special treatment. Therefore, these problems can be examined as follows: 1) how is the legal protection for people with disabilities in the positive law in Indonesia? 2) What is the regulation of the rights of consumers with disabilities as airplane passengers? This presentation used normative research methods to find whether there are legal rules according to legal norms or not, whether there are norms in the form of orders or prohibitions in accordance with legal principles or not and whether one’s actions are in accordance with legal norms or not by using a legal and conceptual approach. This research required a source of secondary legal material as the main legal material. People with disabilities have the right to receive special services and facilities while at an airport or aircraft. The government has made legislation as a form of legal protection for people with disabilities. Nevertheless, the government must be more assertive in order to avoid discrimination against people with disabilities. Furthermore, it is not only the government that must provide legal protection for people with disabilities but also the community. The community must change the mindset about people with disabilities who are considered unable to do anything, and they must help people with disabilities to get equal treatment before the law.

Airport is a vital subsystem in the air transport system which has an important and strategic role in smoothening air traffic, so that an airport must be designed to be always ready in all situations and conditions to serve airline flights securely, orderly, smoothly, and quickly. The frequent delay faced by Indonesian domestic scheduled airlines is not fully caused by internal factor of the companies. Instead, it can be caused by the airport factor. The problems faced by airports in Indonesia which have impacts on the performance of flight punctuality among other things are capacity, slot time, quality of flight navigation devices, accessibility, professionalism of  airport and ATC human resources, infrastructure, facilities, equipment, and the human resources handling security and safety of flights in airport. This article recommends that an in-depth study should be carried out to map the interrelations between the airport factor in the flight delay related to facilities integration and the airport authority in the flight activities in Indonesia.

The article discusses the trends in the development of legislation regulating the aviation business in the Russian Federation, in particular, theoretical and practical issues related to the efficiency and safety of air transportation, as well as the search for a balance between them. The article reveals the history of forming the concepts «transport security» and «aviation security» in the Soviet and modern Russian legislation. In order to clarify the Russian state authorities` powers distribution in the field of transport security and their consolidation in the current legislation, the authors investigate the features of the powers of these bodies in the historical retrospect from the beginning of the XIX century. The authors critically analyze the implementation of the certain provisions of the Government of the Russian Federation «On the approval of requirements for ensuring transport security, taking into account the safety levels for air transport vehicles», the implementation of which causes significant problems for air transport operators. It is established that the implementation of these provisions is difficult: it will significantly aggravate the existing economic situation of aircraft operators, and in combination with the general negative trends in the world can lead to a possible mass bankruptcy of domestic small and medium-sized airlines. The authors suggest ways to solve the identified problems. In particular, a possible solution in finding a balance between transport safety and the cost-effectiveness of air transportation may be a «transition period», during which the expansion of the requirements under study will affect only new aircraft.

The aims of this paper is to discuss and analyze the legal protection concerning air transport consumers on domestic flights. The method using normative method with statute approach and conceptual approach. The results of this paper is to discuss the particular regulations on special facilities for disabilities, elderly, children under the age of 12 years and the patient are not found under the domestic flights regulation in Indonesia. The procedure in obtaining compensation to passengers who passed away because of the aircraft accident is extremely complicated. In addition, the compensation to passengers caused by the flight delays have not been optimally implemented.

The Development Potential of Air Transportation Routes at Mutiara SIS Al Jufri Airport Palu: The government policy in regulating the air transportation routes on a macro basis aims to open up regional isolation and develop the potential of those regions. Mutiara SIS Al Jufri Airport is one of the entrances to the movement of people and goods through air transport to Central Sulawesi Province. Along with the increasingly socio-economic development of Palu City and Central Sulawesi Province in general, the demand for movement of people and goods also increased, and with the economic improvement of society of Central Sulawesi Province, air transportation becomes the main choice. This study is intended to measure the potential for the development of aviation routes at Mutiara SIS Al Jufri Airport, based on the opinion of current users of air transport and air carrier services, and adapted to the Master Plan of the Airport and the Spatial Planning Document of Central Sulawesi Province, using multiple linier regression analysis method. The results of the survey to the airlines provide the information about the plan to open the Palu-Morowali flight route due to its potential demand for transportation of goods between those cities using ATR-72 type aircraft, where there are many production of mining and palm oil products in Morowali. However, from the analysis, if ATR-72 aircraftshould be operated then the runway capacity at Morowali Airport have to be developed since the current condition with runway length of 1,050 m is not sufficient to be landed by ATR-72 in which require a runway with minimum length of 1,600 m. Kebijakan pemerintah tentang pengaturan rute penerbangan secara makro bertujuan untuk membuka isolasi daerah dan mengembangkan potensi yang dimiliki masing-masing daerah tersebut.Bandar Udara Mutiara SIS Al-Jufri adalah salah satu pintu masuk pergerakan orang dan barang melalui angkutan udara ke Provinsi Sulawesi Tengah.Seiring dengan semakin berkembangnya sosio-ekonomi Kota Palu dan Provinsi Sulawesi Tengah pada umumnya, maka demand pergerakan orang dan barang pun turutmeningkat, dan dengan kemajuan perekonomian masyarakat di Provinsi Sulawesi Tengah maka transportasi udara menjadi pilihan utama. Pengkajian ini ingin melihat bagaimana potensi pengembangan rute penerbangan di Bandar Udara Mutiara SIS AlJufri, berdasarkan opini pengguna jasa angkutan udara dan maskapai penerbangan yang saat ini beroperasi, serta disesuaikan dengan rencana induk bandar udara dan dokumen Tata Ruang Wilayah Propinsi Sulawesi Tengah, dengan menggunakan metode analisis regresi linier berganda. Hasil survei kepada maskapai penerbangan diperoleh informasi adanya rencana pembukaan rute penerbangan Palu-Morowali yang sangat berpotensi adanya permintaan kebutuhan angkutan dari Morowali menuju kota Palu untuk angkutan barang dengan menggunakan pesawat udara jenis ATR-72, dikarenakan daerah Morowali banyak terdapat produksi hasil tambang dan kelapa sawit. Namun dari hasil analisis jika ingin menggunakan pesawat ATR-72, maka kapasitas landas Pacu (runway) di Bandar Udara Morowali harus dikembangkan karena kondisi saat ini dengan panjang 1.050 m masih belum memungkinkan untuk didarati oleh pesawat ATR72 yang membutuhkan minimal panjang runway 1.600 m.

The impact of Covid-19's impact on the air transportation sector, especially in Indonesia. This article will discuss the impact and responsibility of airlines on the policies adopted by the Indonesian government regarding the COVID-19 pandemic. This article uses a normative juridical legal approach, research based on literature or secondary material. Meanwhile, the data obtained through legal analysis and social phenomena that occur in society. The rules that must be obeyed by airlines require them to do flight restrictions and cancellations. As a consequence of the cancellation, the airline must return the funds to passengers who have purchased travel tickets and the airline cannot hide behind force majeure. As the party issuing policies, the Government must be able to see a balance in social life and provide appropriate legal protection. In addition, the Government may not issue policies that can lead to different interpretations of those who read the policies. These strict regulations are needed so that passenger rights can be realized which is the responsibility of the airline.
