This article draws on the public testimonies of North Koreans living in South Korea (t’albungmin) and analyzes the role that these narratives play in South Korean society as mechanisms of inclusion and exclusion. North and South Korea technically remain at war, with South Korea claiming sovereignty over the entire Korean peninsula. While t’albungmin are eligible for South Korean citizenship, they describe feeling excluded from full social membership. Although some t’albungmin seek anonymity, this paper considers those who gain social status by speaking publicly about their lives and denouncing the North Korean regime. In so doing, they distance themselves from North Korea and align themselves with the “good” discourse of human rights. However, their actions reinforce a logic of exclusion, implying that t’albungmin who prefer anonymity are “sympathizers,” and consequently restricting their access to social benefits and resources. This case of conditional inclusion illuminates tensions that arise when a sovereignty claim entails the incorporation of people from an enemy state. It also highlights the carefully delineated boundaries of publicly acceptable behavior within which “suspect” citizens must remain as a condition for positive recognition.

This comparative study of the constitutional jurisprudence of three East Asian jurisdictions investigates how the rulings of the Constitutional Court of Taiwan, the Constitutional Court of Korea and the Hong Kong Court of Final Appeal have converged. The unique political contexts of all three jurisdictions have led to strong courts using the structured proportionality doctrine and innovative constitutional remedies to address human rights issues. Hong Kong, Taiwan, and South Korea have the only courts in Asia that regularly use a structured four-stage Proportionality Analysis to invalidate laws, and routinely apply innovative constitutional remedies such as Suspension Orders and Remedial Interpretation to rectify constitutionally flawed legislation. This volume explores how judges in these areas are affected by politics within their different constitutional systems. The latest developments in Asian constitutional law are covered, with detailed analysis of key cases.

This article argues that the attitude of Indonesian mufassir is not always parallel in respond to the concept of Human Rights. This is shown from our discussion of three contextual issues in human rights: freedom of religion, freedom to find a mate, and death sentence, which are exemplified by comparing to the three Indonesian mufassir: Hamka’s Tafsir al-Azhar, Hasbi ash-Shiddieqy’s Tafsir al-Nur and Tafsir al-Bayan, and Quraish Shihab’s Tafsir Al-Mishbah. The article concludes: First, in respond to the human rights issues, Indonesian commentators tend to be responsive. All three exegetes denied those who claimed that Islam was spread with violence and those who opposed the death penalty. Second, on the relationship between human rights and Islam, the commentators have similarities and differences with human rights. Among these similarities, for example, is the issue of religious freedom. As for the issue of freedom to choose a mate and a death sentence, they are taking a different position from human rights. On the issue of death penalty, the commentators emphasize to not only looking from the side of the killer, but also from the right of the murder.

Abstract Legal regulation of religious conversion has become one of the central human rights issues worldwide. Numerous countries, especially in South Asia, have enacted laws that prohibit proselytizating on the grounds of force, allurement, and misrepresentation. Critics have consistently relied on freedom of religion to oppose these laws, but courts in these jurisdictions have upheld them on the very grounds of religious freedom. The present Article explains the historical and ideological bases of this counterintuitive approach to religious freedom by focusing on the case of India. It argues that this approach is based on a historically evolving conception of religion associated with modern Hinduism, according to which all religions have an equal claim to spiritual truth. This precept of religious equality has come to constitute the political and judicial approach to religious freedom and religious conversion laws. The Article uses this interpretive insight to renew the normative critique of such laws.

Prawa człowieka w Azji na przykładzie Chin, Japonii i państw koreańskich Artykuł stanowi analizę zagadnienia praw człowieka w Azji na przykładzie wybranych państw regionu: Chińskiej Republiki Ludowej, Republiki Korei, Koreańskiej Republiki Ludowo-Demokratycznej i Japonii. W artykule przedstawiono problematykę praw człowieka „z europejskiej perspektywy”, nie pomijając jednocześnie koncepcji wartości azjatyckich, uniwersalnych dla regionu Azji Wschodniej. W tym celu analizie zostały poddane państwa o różnych ustrojach politycznych. Zdaniem części azjatyckich ekspertów i polityków wartości azjatyckie mogą być ekwiwalentem zachodniej koncepcji praw człowieka. W tym kontekście istotne było przyjęcie Deklaracji z Bangkoku z 1993 r., która jako pierwsza uwzględniła wartości azjatyckie w dokumencie o statusie międzynarodowym i podkreśliła ich istnienie oraz różnicę historyczną i kulturową w zakresie praw człowieka. Prawa człowieka jako produkt cywilizacji zachodniej nie obejmują osiągnięć i myśli filozoficznej regionu Azji. Można przyjąć założenie, że prawa człowieka są uniwersalne nie dlatego, że dotyczą wszystkich ludzi i są powszechnie szanowane i uznawane – jak twierdzi większość zachodnich ekspertów – ale dlatego, że zostały włączone do konstytucji wielu państw azjatyckich (formalnie uznane). W tym sensie możemy mówić o pewnym uniwersalizmie praw człowieka.
