Exclusion of the Ottoman Empire from the Family of Nations, and Legal Doctrines of Humanitarian Intervention

This chapter examines the legal doctrines of humanitarian intervention that were developed in the second half of the nineteenth century. Drawing on nineteenth-century British and French writings, articles, memoirs, journals, pamphlets, and reviews, it shows that the image of the Ottoman Empire and that of its Christian subjects were far from being monolithic. The chapter first considers the reasons why the Ottoman Empire was generally excluded from the Family of Nations, including despotism, Islam, polygamy, slavery, corruption and the absence of a sound social structure, inability to reciprocate in legal dealings, and unwillingness or incapacity to institute reforms that would guarantee security of life and property to Ottoman Christians. It then discusses the main criterion articulated by various legal scholars for the Ottoman Empire's inclusion in the Family of Nations before concluding with an analysis of late-nineteenth-century doctrines of humanitarian intervention.

This book examines the European roots of humanitarian intervention as a concept and international practice during the nineteenth century, with particular emphasis on the politics and policies of Great Britain and France. It challenges two assumptions: first, that humanitarian intervention is a phenomenon of international relations that appeared after the end of the Cold War and second, that it emerged abruptly during the nineteenth century. Focusing on the Ottoman Empire, the book investigates when, where, who, how, and for what reasons a humanitarian intervention was undertaken from 1815 to 1914. It argues that the primary motivation of humanitarian intervention is to end massacre, atrocity, and extermination or to prevent the repetition of such events, to protect civilian populations mistreated and unprotected by the target-state government, agents, or authorities. This introduction discusses the concept of rights, including natural rights, before the nineteenth century and provides an overview of the questions, assumptions, and issues raised in the book.

The Safavids (1501–1722) controlled a land-based empire that comprised the modern-day nation of Iran, with extensions into Iraq, the Caucasus, and Afghanistan. The family of the Safavids originated as Sufi mystical sheikhs based in the region of Azerbaijan but were later imperialized thanks to the dynastic founder, Shah Ismaʿil (r. 1501–1524). The transition from Sufi tariqa to imperial polity was not smooth, and Ismaʿil faced external threats from the Ottoman Empire to the west, as well as internal pressure from his popular base, the Qizilbash tribal Turks who revered their shah as both a Sufi sheikh as well as a manifestation of the millenarian figure Mahdi who was popularly understood as the Muslim agent of the Apocalypse. The success of the Safavids was partly based on their ability to distance their family from such decentralized, tribal elements and seek out those constituencies that could help with regard to establishing and building legitimacy: orthodox Twelver Shiʿite jurists and scholars as well as urban Persian administrators and bureaucrats. It was Ismaʿil and his successor, Shah Tahmasp (r. 1524–1576), who proclaimed and enforced Twelver Shiʿism as the new state doctrine, thus contributing to a stark Sunni-Shiʿite division between themselves and their neighboring rival empires of the Ottomans and the Uzbeks. The apogee of the Safavid Empire took place during the reign of Shah ʿAbbas (r. 1589–1629) who, among other things, transformed Isfahan into a city of international stature with fantastic architectural patronage while at the same time enticing European merchants and traders to trade in textiles, silk, and other manufactured goods. Following the reign of Shah ʿAbbas, the Safavid Empire became less stable and more susceptible to outside elements, namely those Caucasian nobles and landed gentry who had been previously incorporated into the Safavid state as court officials, provincial governors, and ranking military officers. Concurrently, there was a rise in conservative orthodoxy among the Shiʿite religious scholars, and the previous era of open trade and strong international relations began to wane as Christians, Jews, and other minorities became increasingly targeted and persecuted. By the end of the 17th century, the Safavid court was politically isolated from the other provinces, so much so that the imperial capital was easily besieged and conquered in 1722 by an invading conglomerate of Afghan tribes.

Abstract This article is a study of the family photo album of Elisabeth Leitner (ca. 1842?–1908), a Hungarian immigrant in the Ottoman empire. The album contains a complete set of cartes de visite portraits of the Ottoman sultans by the Abdullah Frères. As the only surviving example of such a collection with a known provenance, it provides a rare opportunity for understanding how such images were used in the context of identity formation and social mobility undertaken by a member of the immigrant population. The album, which has never been studied before, is also a fascinating source for investigating the history of Hungarian immigrants in the Ottoman empire who were displaced after the 1848 Revolution. The article approaches the intriguingly autobiographical album by means of a close reading of Elisabeth Leitner’s diaries and unfinished autobiography. My interpretation serves to dismantle notions of a carefree global cosmopolitanism and exposes a historiographical bias that privileges men and their collections of images and ethnographic artifacts over those of women. Elisabeth Leitner’s writings and photographic collection also represent a vast and entirely untapped resource for investigating cultural contacts between Europe and the Ottoman empire in the second half of the nineteenth century.

AbstractThe 1917 promulgation of a new Ottoman family law is recognized as a landmark moment in the history of Islamic law by scholars of women and gender in the Middle East. Yet the significance of the 1917 law in the struggle over religious jurisdiction, political power, and Ottoman sovereignty has been overlooked in the scholarship on both Ottoman legal reform and World War 1. Drawing on Ottoman Turkish, German, French, and English sources linking internal interpretations of the law and external reactions to its passage, we reinterpret adoption of the family law as a key moment in the geopolitics of World War 1. We demonstrate that passage of the law was a critical turning point in the wartime process of abrogating the capitulations and eliminating the last vestiges of legal extraterritoriality in the Ottoman Empire. The law is situated in its wartime political context and the geopolitical milieu of larger Europe to demonstrate that, although short-lived, the 1917 family law was a centerpiece of the wartime struggle to define extraterritorial rights of the Ottoman Empire, the Great Powers, and their protégés within the empire.

Abstract:Focusing on Cengiz Mehmed Geray, an idiosyncratic member of the ruling house of the Crimean Khanate, this article examines how a Crimean Prince became an active participant in the stormy politics of the Ottoman Empire and later of Europe, as a result of his distinguished Chinghisid pedigree, in the age of revolutions. The first section of this article discusses the place of the Geray and Chinghisid lineage within Ottoman imperial politics. The second section focuses on the period following the Gerays’ departure from Crimea. It illustrates how members of the family, although scattered throughout the Balkans, operated in the provincial and imperial politics of the Ottoman Empire in the late 18th and early 19th centuries. The following section introduces Cengiz Geray and his turbulent life between the Ottoman and Russian Empires, and discusses how he became an actor in a revolutionary age. The last section is a short discussion on Chinghisid charisma in the early modern Europe, Russia and the Ottoman Empire.

AbstractIn this paper, we will discuss the reforms concerning family life that started with Tanzimat finished with the Family Act of 1917 (HAK=Hukuk-i Aile Kararnamesi). Women’s rights and the value given to women in Islam have always been on the world’s agenda. The Family Act that was prepared in the final years of the Ottoman Empire is the most important legal work in the Islamic world with respect to women’s rights.
