Analysis of geodetic and legal documentation in the process of expropriation for roads. Krakow case study

Abstract Amendment to the Act on special rules of preparation and implementation of investment in public roads resulted in an accelerated mode of acquisition of land for the development of roads. The decision to authorize the execution of road investment issued on its basis has several effects, i.e. determines the location of a road, approves surveying division, approves construction design and also results in acquisition of a real property by virtue of law by the State Treasury or local government unit, among others. The conducted study revealed that over 3 years, in this mode, the city of Krakow has acquired 31 hectares of land intended for the implementation of road investments. Compensation is determined in separate proceedings based on an appraisal study estimating property value, often at a distant time after the loss of land by the owner. One reason for the lengthy compensation proceedings is challenging the proposed amount of compensation, unregulated legal status of the property as well as imprecise legislation. It is important to properly develop geodetic and legal documentation which accompanies the application for issuance of the decision and is also used in compensation proceedings.

“So you want to be a politician,” my friend said, with a slight lift to the eyebrows. Others wanted to know what the goal was. Running for alderman in ward politics and a partisan campaign must be a training ground for some coveted objective in the state legislature or Congress. You don't just want to be an alderman, some queried. “Starting pretty low down,” was another leading remark. All these and many more comments intrigued me, for they spelled out something or other about the prestige of local government in a day of Big Government at the federal level, or any level other than a municipality of 40,000 population. My answer to all this was that, after twenty years of residence in one community, a professor of municipal government could hardly avoid grubbing around in politics at the level of local self-government. I hoped to become an alderman—period.I soon learned to parry the pleasant “hazing” remarks made to all prospective ward “politicians.” “Kissed any babies today, Alderman?” “Where are the cigars?” “How's ward-heeling today?” “I'll vote for you, if—.” “How is door-bell ringing?” Most of these remarks prompted the unspoken remark: “When you say those words, sir, smile.” You will notice that I said unspoken.

<p><b>This research is an architectural enquiry into how the visibility of local government can mimic the performance of everyday political life. Using the conceptual framework of place and understanding of the collective community. The intention of this design proposal is to encourage the transparency of local authority through an architectural intervention in the city.</b></p> <p>The driver of this research is the reduced physical presence of civic practices, with particular regard to the congregating place of local government. A framework is developed as a precursor to develop an understanding of the traditional civic architype. The aim is to reimagine a contemporary civic architecture which is detached from the corporate functions of local government. Architecture supports the celebration of collective rituals of movement and meeting.</p> <p>An archetype investigation formalises a set design criteria by which the design case study is evaluated against. The background research comprises a critique of the spatial arrangement of the traditional town hall. An additional background task is consisted of a comparative inquiry into today’s local government accommodation.</p> <p>The site is located in Tamaki Makaurau/Auckland City. The site analysis criteria utilised by this thesis is grounded in the research of Jan Gehl and his understanding of architectures impact on peoples’ behaviour in cities.</p> <p>Finally the design case study is driven by dynamic circulation, which establishes a celebration of the formal and informal interactions between the participants of local government. Transparency and hierarchy are used to challenge the spatial and functional qualities of Auckland City Council. The result of the research will contribute to the inclusive understanding of the ordinary rituals of local government through architecture in the city.</p>

This paper discusses the theoretical rheology of local governance from the bureaucratic system to the network city and explores whether and how such a city network can be developed in a dual local government system. This paper suggests that, in dual systems, councilors are nodes which extend their networks, and councilors together can construct a more comprehensive network than a city executive branch alone does, so as to remedy the executive branch’s deficiencies concerning city affairs. This paper chooses Kaohsiung city council as its case study and provides evidence that the network developed by city council and councilors covers many city affairs which are ignored by the city executive branch. This result also implies that the network city may be better feasible in a dual local government system than in a unitary one.

Continuity and Discontinuity in the Cultural Landscape of the Capital City: Paris and SkopjeThe object of my reflections in this article is the question of creating a vision of historical continuity, and thus making significant the narratives about the past, in the space of the city. I treat the city as a cultural landscape par excellence; it is precisely the city that creates the best opportunities of influencing interpretation by means of creating a specific set of symbolic references and of images awakening the play of interpretation. The city is inhabited by many individuals and varied groups, which forces it into negotiations of signification. The research present herein concerns the capital cities. The capital of a nation state is a specific city, normally defined by its very legal status as capital, recognized and regulated by special edict, it is also a symbolic space of particular weight, a place to demonstrate the power of the state and of the nation, to display and consolidate identity, to present one’s image to outsiders and mould a desired self-image for the benefit of the citizens – members of one’s group. Drawing on the example of Paris and Skopje, two cities whose historical contexts are considerably different, I would like to show the specific ways of drawing conclusions adapted to the urban landscape, because despite the obvious differences, both cities allow for the discernment of a historical period in which the city itself served as an important element of the public realm and as symbolic public property. The increased significance of cities in Europe is connected without a doubt to the process of democratization, thus the capitals of France and Macedonia are good examples of the transformation that converted a privatized (feudal) space or a space interpreted along sacred lines (as land belonging to God) into a public space and public property of citizens, and/or the dominant nation.It appears that the most important agent in the capital landscape is the state. It is the bureaucracy of the state, appearing in the role of executor of the national will, deciding on the shape of the image of the city, reinforcing those values that seem to be desirable from the perspective of the represented group. The lack of that factor leads, as in the case of Skopje, to the preservation of the local past and/or to a haphazardly implemented publicly sponsored construction. In both cases discussed above, the map and the landmarks mirror the most important categories of national narrative. The shape of this narrative depends largely upon the central authorities of the nation.Ciągłość i nieciągłość w przestrzeni miasta stołecznego: Paryż i SkopjePrzedmiotem niniejszego artykułu jest zagadnienie tworzenia wizji ciągłości dziejowej, a więc usensowionej narracji o przeszłości, w przestrzeni miasta. Miasto bowiem jawi się jako przestrzeń kulturowa par excellence i ono właśnie stwarza najlepsze możliwości wpływu na interpretację poprzez tworzenie specyficznego układu odniesień symbolicznych i obrazów, pobudzających grę interpretacji. Miasto zamieszkiwane jest przez wiele jednostek i różnorakich grup, co zmusza je do negocjacji znaczeń. Przedmiotem przedstawionych tu badań są stolice. Stolica państwa to bowiem miasto szczególne, co zazwyczaj podkreśla sam status prawny ośrodka stołecznego regulowany przez specjalną ustawę, staje się niezwykle ważną przestrzenią symboliczną, miejscem pokazu państwowej i narodowej siły, eksponowania i utwierdzania tożsamości, prezentowania wizerunku obcym oraz kształtowania pożądanego wizerunku na użytek obywateli – członków swojej grupy. Na przykładzie Paryża i Skopja, miast o odmiennej kontekstowo historii, chciałbym pokazać specyficzne dla przestrzeni miejskiej sposoby indukowania interpretacji, albowiem mimo oczywistych różnic oba miasta pozwalają dostrzec historyczny okres, w którym samo miasto stało się istotnym składnikiem sfery publicznej i publicznej własności symbolicznej. Wzrost znaczenia miast w Europie wiąże się bez wątpienia z procesem demokratyzacji, zaś stolice Francji i Macedonii są dobrym przykładem tej przemiany, która przestrzeń sprywatyzowaną (feudalną) bądź interpretowaną w wymiarze sakralnym (jako ziemia należąca do Boga) przekształciła w przestrzeń publiczną, będącą dobrem wspólnym obywateli i/lub dominującego narodu.Najważniejszym agensem w przestrzeni stołecznej okazuje się państwo. To biurokracja państwowa, występująca w charakterze nosiciela woli narodu, decyduje o kształtowaniu wizerunku miasta, wzmacniając te wartości, które wydają się pożądane z perspektywy reprezentowanej grupy. Brak tego czynnika skutkuje, jak w przypadku Skopje, zachowaniem lokalności i/lub przypadkowością realizowanych inwestycji publicznych. W obu omawianych przypadkach mapa i punkty orientacyjne zdradzają najważniejsze kategorie narracji narodowej, a przecież za jej kształt w znacznym stopniu odpowiada właśnie władza centralna.

Studies conducted into minorities like the Jews serves the purpose of sensitizing one about the existence of communities other than one’s own one, thereby promoting harmony and better understanding of other cultures. The Paper is titled ‘A Chronicle of Calcutta Jewry’. It lays stress on the beginning of the Jewish community in Calcutta with reference to the prominent Jewish families from the city. Most of the Jews in Calcutta were from the middle-east and came to be called as Baghdadi Jews. Initially they were influenced by Arabic culture, language and customs, but later they became Anglicized with English replacing Judeo-Arabic (Arabic written in Hebrew script) as their language. A few social evils residing among the Jews briefly discussed. Although, the Jews of our city never experienced direct consequences of the Holocaust, they contributed wholeheartedly to the Jewish Relief Fund that was set up by the Jewish Relief Association (JRA) to help the victims of the Shoah. The experience of a Jewish girl amidst the violence during the partition of India has been briefly touched upon. The reason for the exodus of Jews from Calcutta after Independence of India and the establishment of the State of Israel has also been discussed. The contribution of the Jews to the lifestyle of the city is described with case study on ‘Nahoums’, the famous Jewish bakery of the city. A brief discussion on an eminent Jew from Calcutta who distinguished himself in service to the nation – J.F.R. Jacob, popularly known as Jack by his fellow soldiers has been given. The amicable relations between the Jews and Muslims in Calcutta have also been briefly portrayed. This article questions the extent to which municipal bylaws aimed at cultural heritage resource management (CHRM) reflect the objectives of the Constitution of the Republic of South Africa, 1996 (the Constitution), national legislation and the discourse on cultural governance more broadly. In terms of Schedule 4A of the Constitution, the function of "cultural matters" is not an original power of local government.  It is a function assigned to the national and provincial spheres. Municipalities are assumed, however, to have a responsibility to execute aspects of this function that may be incidental to other typical local government functions. This view finds support in the interpretation of various rights in the Constitution (e.g. sections 15, 30, 31 and 24) as well as the heritage, environmental and local government framework legislation and policy documents of South Africa. The premise of this article is that cultural heritage resource management by way of instruments such as bylaws promotes the overarching objectives of local government, such as sustainable development, while also promoting the rights to culture, language and religion, amongst others. To expand on its theoretical basis, this article provides a critical assessment of the bylaws of the City of Cape Town Metropolitan Municipality

This chapter focuses on the Vestal Virgins. The six Vestal Virgins belonged to the pontifical college (collegium pontificum), the largest and one of Rome's most prestigious religious orders. Chosen for their role between the ages of six and ten, they were committed to serve the cult of Vesta for a minimum of thirty years. They were synonymous with the continued welfare of the city and inseparable from the Roman's view of themselves. In addition to guaranteeing Rome's future, the Vestal priesthood was cherished as one of the most ancient religious institutions in the city. The chapter then considers the social profile of prospective priestesses and explains how they were chosen for their extraordinary role in Roman society. It also outlines their legal status, which set them apart from ordinary Romans, and the privileges they were granted in exchange for their service to the state.

PurposeIn Brazil, the city of Pelotas experienced an economic apex between the end of the nineteenth century and the beginning of the twentieth century, reflecting in the construction of several buildings. The aim of this article is to evaluate the state of degradation of the facades of the Old School of Agronomy Eliseu Maciel, using qualitative and quantitative indicators.Design/methodology/approachThe study was divided into visual and photographic survey, damage map and subsequent application of the Degradation Measurement Method (MMD) and the Element Performance Index (Ip). Taking into consideration the evaluation of the building: through historical research and survey of damages. Finally, the building was framed at a level of degradation.FindingsBy calculating the average damage between the methods – damage map, MMD and Ip – a more faithful representation of the damage was obtained, since the values become balanced. The results show the potential of the use of the methods in the analysis of pathological manifestations in facades.Originality/valueThe originality of this article refers to the use of methods for evaluation of historical buildings. The authors believe that the methods described applied jointly provide the results about the state of degradation through nondestructive and low-cost analyses. The methods of surveying damage to Brazilian heritage are a little researched area. This work will hopefully be engaged by academics and professionals to help establish and promote broad government interest and investments.

This article is based on research in Gereja Kristen Indonesia (GKI, Indoensian Christian Chruch) Yasmin Bogor as a case study. It has been years for the community to struggle for gaining permission to legally build the church. Court has decided to allow the community to use the building for religius activities. However, practically, the court's decision cannot be implemented because there was pressure for some parties, including from the local government, to refuse the operation of the church. The study is aimed to identify the dynamics and difficulties of being minority in a nation-state, called Indonesia. This lengthens the list of acts of intolerance and violence on minority within a democratic government, in which majority is still preferred. There is a celar need for changing the mindset of the state and society to resolve conflict based on religious belief, to enable equality in economy, politics and religious life.
