Cooperation and competition in highly skilled migration policy in the European Union

Evidence shows that international flows of highly skilled workers are increasing, both between advanced states and between advanced and developing regions. The movement of skilled people around the globe is driven by a variety of political forces, including governments’ continued efforts to address domestic labor shortages and restock through preferential immigration policies and international recruitment drives. For social scientists, the unprecedented movement of highly skilled labor across the globe calls into question earlier approaches to the study of migration. Where international highly skilled workers were treated in the classical sociological literature on migration as a small population that reflected both the potential for human capital transfers between states and, more controversially, a corresponding “brain drain” from source countries, the realities of transnational migration now complicate this picture. The expansion of the European Union and other forms of regional cooperation have given rise to important trade liberalizing agreements, producing a truly global migration market and the policy context for much contemporary research. More studies are needed to tackle issues relevant to the study of skilled migration, such as estimates of skilled migrants, longitudinal studies of circular migration, and analyses of the differentiation of migrants by occupational group and country of origin, along with the relative access that such groups enjoy in the receiving state.

The migration of highly skilled workers is becoming an increasingly important factor that is influencing the development of specific countries as well as different regions of the world. In fact, in the European Union, the tendency of low-skilled workers shortage is changing to the trend of promoting the highly skilled workers migration, which can create added value and contribute to pension funds for the aging population in those states. At the same time, due to the loss of highly qualified personnel, the recipient countries are losing the pace of their economic development. The relevance of this study is also enhanced by changing conditions for international labor migration to the European Union in connection with the COVID-19 pandemic, including for highly qualified Ukrainian professionals. The article examines the reasons of highly skilled workers migration processes, analyzes the consequences for different stakeholders and provides methods to reduce the scale of such migration. To analyze the reasons of highly qualified specialists labor migration, the model of "Push and Pull" factors was used on the example of Ukraine and the European Union. The positive and negative consequences of the highly qualified specialists’ migration growth for various stakeholders of this process have been identified. It is also proved that despite the fact that salaries are growing in real terms in Ukraine, the difference in salaries in the main areas of emigration to the EU is so large that it is likely to continue to motivate people to work and earn abroad. Moreover, the existence of a large and growing Ukrainian diaspora tends to encourage the migration of other family members and friends, providing informational and logistical support in destination countries. This attraction may increase in the coming years, and the diaspora will continue to expand. In the article, it is also described the impact of the COVID-19 pandemic on the highly qualified professionals’ migration, and it gives a number of proposals or recommendations that could be implemented at the level of state migration policy to address highly qualified professionals labor migration or at least improve the current situation. The proposed recommendations of the migration policy to confront the negative effects of the COVID-19 pandemic include the establishment of a mechanism for coordination and consultation between all government institutions, authorities and agencies involved in labor migration, as well as the establishment of tripartite procedures for advising employers and workers of migration organizations and considering their opinions on the given topic.

The European Union (EU)–Turkey deal consolidated a shift in the EU’s migration policy. The deal is the culmination of the dominance of the security frame and depicts the continuous externalization of the EU’s responsibility of asylum protection and burden sharing. The strengthening of the security frame has weakened the humanitarian norms that previously dictated EU’s behaviour. This has led to the EU losing some of its comparative advantages in negotiations. Simultaneously, the instrumentalization of the value of asylum, paired with an increased number of asylum seekers, has given negotiation leverage to the neighbouring countries turned service providers. These changes in perception and norms have created a power shift, at the disadvantage of the EU, creating a more leveled playing field for negotiations between the parties. This article tracks the historical shifts in the global refugee regime to explain how today’s situation was created. Hereby, the existence of two competing cognitive frames—humanitarian and security—is assumed, tracked and analysed. While looking at the EU–Turkey deal, the article shows that the EU has started treating refugees as a security problem rather than a humanitarian issue, breaking the normative fabric of the refugee regime in the process. The article also displays how Turkey was able to capitalise on this new reality and engage with negotiations of other neighbouring countries of EU that point towards a change of dynamics in the global refugee regime.

The external migration of a significant part of Romania's high-skilled population is a social phenomenon which became increasingly frequent starting from the 1990s, right after the fall of the communist regime. The basis for this phenomenon consists of several causes: globalization, the strengthening of international economic relations, and later on, Romania's adhesion to the European Union. Research has shown that of all high-skilled population, the professionals who emigrate more frequently consist of engineers, teachers, medical staff, scientific researchers, economists and architects. Besides, the chosen destinations have been variable throughout time. The first phase in time took place in the 1990s, when a large part of the high-skilled population chose to emigrate for professional purposes in countries such as The United States of America, Canada, Germany or Israel. The second important phase occurred after year 2000, when the focus was placed on EU countries, especially after Romania's integration. Apart from temporary unqualified migration, the number of high-skilled migrants and those who leave the country to continue their studies also soared. The chosen countries generally include Great Britain, Germany, Belgium, France and Austria. Given these differences in the tendencies of high-skilled migration, this paper will offer an insight on how the phenomenon evolved, and the factors that caused these variations in space and time. Most likely, some of the countries that were preferred have been facilitating the integration of high-skilled immigrants in society, as opposed to unqualified ones, through a selective set of laws and social policies which are meant to favour this social category. Therefore, we will discover and analyze various examples and benefits of legislation and social policies which offered social protection to high-skilledimmigrants in various countries. The European Union has met Donald Trump's presidency in a crisis, caused by Britain's exit, quarrels over migration policy and prospects for European integration. Trump has abandoned a project to create a transatlantic free trade area. He demanded a one-sided trade advantage for the United States. The rejection of the liberal project of multilateral foreign policy contributed to the deepening of contradictions between the EU and the US in the field of trade, environment, the regime of international disarmament treaties, the algorithm for resolving regional conflicts. The Trump era in US foreign policy was a time of abandoning liberal globalism. But it is impossible to realize this task in one cadence. The question is whether it is possible for Democrats to fully restore liberal globalism in equal cooperation with the European Union.Trump has abandoned the project of a transatlantic free trade area between the United States and the European Union. This shocked the European elites. Differences in approaches to world trade contributed to the coolness. The European Union is promoting a liberal approach. Trump insisted on the priority of the patronage of American interests. As a result, the tradition of relationships has suffered. Until 2017, the United States bought European goods and paid the most to the NATO budget. Trump demanded trade parity and more European funding for NATO. European elites perceived Trump's approach to migration issues as unacceptable. Trump's policy on international conflicts has become another reason for mutual misunderstanding. Trump recognized Jerusalem as the capital of Israel and helped establish diplomatic relations between Israel and the United Arab Emirates. This has become a challenge for the European Union's Middle East policy.

In the discussion on the EU migration policy, it is impossible to evade the issue of the relation between this policy and the EU foreign policy, including EU common foreign and security policy. The subject of this study are selected links between migration issues and the CFSP of the European Union. The presented considerations aim to determine at what levels and in what ways the EU’s migration policy is taken into account in the space of the CFSP as a diplomatic and political (and subject to specific rules and procedures) substrate of the EU’s external action.
