Issue Brief: Section 230 of the Communications Decency Act: Research Library Perspectives

This issue brief provides background on Section 230 of the Communications Decency Act and implications for libraries of the potential changes to the law, as well as a summary of the discussion held during the Spring 2021 Association of Research Libraries Meeting. Through the discussion several ideas surfaced on how university and library policies connect to Section 230. A few illustrative examples from UC San Diego are included in the discussion summary.

Electronic resource management (ERM), as a tool for library management, grows in importance every day. The ERM industry has matured greatly over the past decade. Just ten years ago, the first journals began to be published on the Web in significant volume; by 2007, many smaller colleges and some large research libraries have moved to complete or nearly complete electronic-only access (Ives, 2006). The Association of Research Libraries reports that the average ARL research library now spends over 31% of its materials budget on electronic resources, with a large proportion of these libraries spending more than 50% of their materials budget on electronic resources (Kyrillidou & Young, 2006).

The conference on Exposing Hidden Collections, hosted by the Association of Research Libraries (ARL) at the Library of Congress in September 2003, was notable for many reasons. David Stam and Sarah Thomas have set forth a number of ideas and suggestions for shaping the nature and the future of special collections in libraries belonging to the Association of Research Libraries (ARL). From my perspective as director of the special collections operations in a research library, I want to comment on their recommendations and add a few suggestions that I believe are in line with the vision and strategies they have described. Like Stam, I feel that little, if anything, I say will be new. I know that many of you could offer more insightful observations and recommendations . . .

The research reported here is focused on a specific type of change in an organization: an innovation. In an empirical analysis of research libraries, it was found that five factors had a significant impact on the innovation performance of the library. These factors relate to the strategy, organizational structure, and leadership of the research library. The study sample consisted of 50 libraries that were members of the Association of Research Libraries. This paper will discuss the theoretical model, explain the effects of these five variables, highlight certain additional correlations that are meaningful, and discuss implications for research libraries.

Purpose Assessment activities in academic libraries continue to grow as libraries explore assessment endeavors. Ranging from basic stats gathering and reporting to surveys, focus groups, and usability studies and beyond. Many practitioners are finding it necessary to create new processes and programs, with little guidance. The purpose of this paper is to paint a broad picture of assessment activities in Association of Research Libraries (ARL) university libraries with the goal of creating a resource for libraries developing or improving their assessment programs. Design/methodology/approach A survey was developed that asked questions about assessment personnel, activities, mission, and website. A total of 113 surveys were sent to academic library members of ARL. Survey results were analyzed to compile a list of recommended good practices for assessment and working with assessment committees in academic libraries. Findings The investigators had a response rate of 43 percent. The open-ended nature of the survey questions allowed for the respondents to specifically narrow down the problems and opportunities inherent in library assessment committees. Originality/value This study takes the temperature of the current state of assessment programs in ARL libraries, demonstrating the growth of assessment programs. It begins to document the practices of these libraries, particularly in regards to the sometimes informal and hard to track use of committees and other in-house collaborations, as a first step toward developing best practices for the field. The results illuminate productive areas for further study, including investigating how to measure a culture of assessment and maximizing impact of assessment information presented on assessment websites.
