This chapter focuses on the effective implementation of new electronic tools for Public e-Procurement in public sector organizations. While an analysis of the characteristics of transformation processes necessary for the development of e-Government and the choice between Public e-Procurement tools is theoretically already well developed, there are still a number of ambiguities in the approaches of rationalization implementation of these. A deeper understanding of the decision-making phenomenon in general is provided. Flexibly adjusting the e-Government strategy on dynamics of the development of Public e-Procurement tool ex ante or leading in an effort to change the organizational structures, information flows, and constraints in which public sector organizations operate in the area of Public e-Procurement. Public e-Procurement tools are selected for the analysis, because interesting progress is expected here. Results from the nature of the dynamic transformation processes and decision-making show the need to support changes in the environment arising from the development of e-Government.

<p align="justify">En el presente articulo partiendo de la preocupación comunitaria por desterrar las adjudicaciones ilegales, se estudia la naturaleza del Tribunal Administrativo Central de Recursos Contractuales (TACRECO) como órgano común al servicio de la Administración General del Estado y de otros órganos tal como expresa hoy el articulo 41.1 del Texto Refundido de la ley de Contratos del Sector Público aprobado por el Real Decreto legislativo 3/2011, de 14 de noviembre (en adelante, TRLCSP), sin perjuicio de que su carácter de órgano especializado que actúa con plena independencia funcional en el ejercicio de sus competencias, le permita conocer también de los recursos especiales que se susciten contra los actos de los órganos competentes del Consejo General del Poder Judicial, del Tribunal Constitucional y del Tribunal de Cuentas. En concreto el autor estudia el recurso especial en materia de contratación como objeto de resolución por el tribunal administrativo central de recursos contractuales y en especial los aspectos que tienen con su legitimación y competencia. prestando especial atención a los supuestos de nulidad contractual. Concluye con la propuesta de que el TACRECO en su labor de decir el derecho en esta materia se configure a modo del TEAC en el ámbito de a AGE irradiando y proyectando sus resoluciones a los demás órganos que se creen.</p> <p align="justify"><b>Based on the EC’s determination to stamp out illegal awards, this article analyses the nature of the Public Procurement Review Central Administrative Court (whose Spanish acronym is TACRECO), a common body at the service of the Central State Administration and other bodies, as is currently established in article 41.1 of the Consolidated Text of the Law on Public-sector Contracts, approved under Royal Legislative Decree 3/2011, of 14 November (hereinafter referred to as CTLPSC). Its nature of a specialised body which acts with full functional independence in the exercise of its powers also enables it to assess the special reviews arising against the decisions of the competent bodies of the General Council of the Judiciary, the Constitutional Court and Court of Auditors. Specifically, the author analyses the special review concerning public procurement as subject of resolution by the Public Procurement Review Central Administrative Court, and in particular the aspects which have to do with its legitimation and competence, paying special attention to nullity of contract cases. The article concludes with the suggestion that the TACRECO, in its duty to resolve these reviews, establishes itself like the Central Economic Administrative Court (CEAC) in the sphere of the Central State Administration, irradiating and projecting its decisions onto the other bodies to be established.</p>

Health systems in most (if not all) countries perpetually struggle with financial problems and search for resources to cover health care needs. Increased efficiency of health procurement has the potential to save a lot of money and to reallocate them to treatments. The aim of our study is to analyze technical efficiency (efficiency/economy dimension) and allocation efficiency (effectiveness) of public procurement in health care facilities in the Czech Republic and Slovakia, countries whose health systems are governed by the principle of universal access to high quality health services. Concerning the technical efficiency, the results show a low rate of competitiveness whereby the potential of competition is not exploited. In terms of allocation efficiency, our research also sufficiently illustrates the criticality of the situation; however, compared to the element of technical efficiency the situation in the evaluated countries is different. In Slovakia, purchases are usually decided by doctors and procurement is prepared without the necessary ex-ante analysis. In the Czech Republic, the ex-ante evaluation of purchasing of medical equipment is regulated, however, the decision-making process is non-transparent and does not guarantee allocative efficiency. The study has critical policy implications – both countries should urgently adopt measures to improve their respective procurement processes.

Abstract Public procurement outcomes depend on the ability of the procuring agency to select well-performing suppliers. Should public administrations be granted more or less discretion in their decision-making? Using Italian data on municipal public works tendered in the period 2009–13, we study how a reform extending the scope of bureaucrat discretion affects supplier selection. We find that the share of contracts awarded to politically connected firms increases while the (ex ante) labor productivity of the winning firm decreases, thus suggesting a potential misallocation of public funds. The results are heterogeneous across procuring agencies: the effects on supplier selection are primarily concentrated among less qualified and less transparent administrations. Abstract Cushman characterizes rationalization as the inverse of rational reasoning, but this distinction is psychologically questionable. Coherence-based reasoning highlights a subtler form of bidirectionality: By distorting task attributes to make one course of action appear superior to its rivals, a patina of rationality is bestowed on the choice. This mechanism drives choice and action, rather than just following in their wake.
