Restorative Justice is an approach to justice that focuses on the needs of the victims and perpetrators of crime, as well as involving the community, not to follow the principle of punishment for the perpetrators accompanied by the consideration of the judges. The principle of Restorative Justice process of the completion of the action a violation of law that occurs is done by bringing victims and offenders together talking. The act of punishment alternative to using the justice restorative should be pursued by the state so that the adhesion of unity of the nation become strong and become potential of socio economic development and politics of the country. The propriety of the imposition of a criminal through the justice restorative so the duty and responsibility of law enforcement to sharpen legal analysis and sensitive conscience of humanity. justice restorative aims to reconcile the conflicting parties. If offenders could be rehabilitated with other measures that better then the punishment should be avoided. In the penalty ta'zir, forgiveness and granting the minimum penalty is the criminal justice system of Islam that can change the penal system of retributive to restorative. This research problem is how the strengthening of restorative justice in the settlement of the criminal case according to Law Number 16 Year 2004 On the Prosecutor's office? How the actualization of the completion of the criminal case through the restorative justice perspective of Islamic Law?. The purpose of this study was to determine the strengthening of restorative justice in the settlement of the criminal case according to Law Number 16 Year 2004 On the Prosecutor's office and find out the actualization of the completion of the criminal case through the restorative justice perspective of Islamic Law. Methods this research was conducted using qualitative research a research process and understanding based on the methodology that investigates a phenomenon of social and human problems. The results of this study concluded, that the strengthening of restorative justice in the settlement of the criminal case according to Law Number 16 Year 2004 On the Prosecutor's office through a mediation that can be used in resolving a criminal case. A new breakthrough in the Indonesian criminal justice system in the completion of a criminal offence outside the court. Handling the criminal case related to the land both by investigators, prosecutors and judges must advance the exact seat keperdataannya legal status. The handling of criminal cases the object of land should be done carefully and cautiously through the understanding of the anatomy of the case and from the evidence of civil owned by the parties. It aims to prevent the engineering / coercion case which is basically a pure civil dispute, eventually used as criminal assault. To deal with this phenomenon, law enforcement agencies have issued policies on formulatif / legislation containing about pending examination of crime related / object land. At the level of the Supreme Court there is a Supreme Court Regulation No. 1 of 1956 and the Supreme Court Decision Number 628K / Pid / 1984. At the level of the Attorney General has issued Circular Letter of the Attorney General for General Crimes No. B-230 / E / EJP / 01/2013. While in the police has been no regulatory policies relating thereto. However, in practice the investigators make policies and regulations issued by the Supreme Court and the Attorney General as guidance in handling the criminal case related to the land. It is for the sake of effectiveness and efficiency in the framework of an integrated criminal justice system. While in the police has been no regulatory policies relating thereto. However, in practice the investigators make policies and regulations issued by the Supreme Court and the Attorney General as guidance in handling the criminal case related to the land. Penyelesaian perkara pidana melalui lembaga peradilan sering tidak menjamin rasa keadilan di antara korban dan pelaku. Oleh karenanya diperlukan penyelesaian melalui restorative justice untuk mewujudkan keseimbangan antara korban dan pelaku. Selain itu agar penanganan perkara pidana dapat berjalan secara fleksibel dan tidak bersifat kaku. Penelitian ini menjawab permasalahan sejauh mana restorative justice dapat diterapkan dalam sistem peradilan pidana di Indonesia untuk mencapai keadilan dan bagaimana mewujudkan keseimbangan antara pelaku dan korban tindak pidana guna menuju cara berhukum yang fleksibel. Penelitian ini termasuk dalam penelitian hukum empiris yang bersifat deskriptif dengan menggunakan pendekatan kasus dan perundang-undangan. Berdasarkan hasil penelitian disimpulkan bahwa restorative justice di Indonesia sejauh ini dapat diterapkan dalam penyelesaian perkara pidana untuk mencapai keadilan. Selain itu restorative justice terbukti mampu mewujudkan keseimbangan antara pelaku dan korban tindak pidana. Oleh karena itu direkomendasikan agar aparat penegak hukum mempunyai standar operasional untuk menggunakan restorative justice pada setiap penanganan perkara pidana.<p>The completion of criminal cases often does not give the sense of justice between the victims and perpetrators. Based on that, citizens need a resolution in justice through restorative justice to create balance between the victims and perpetrators. Moreover, through the restorative justice, the vision is to have resolution of criminal case that can run flexible and is not rigid. This research answers the question of the application’s effect of the restorative justice can be done in the criminal justice system in Indonesia in creating justice and the question of the process to make balance justice between the victims and perpetrators in order to reach flexible ways in law. This research is included in the descriptive empirical law research by using case approach and the legislation. Based on the research’s result, the writer can conclude that the restorative justice in Indonesia nowadays can be applied in the criminal case solution to reach the justice.</p>

This article discusses how the law arrangements in the juvenile justice in the process of resolving the case, How restorative justice restrictions in law enforcement in Indonesia and How the application of Restorative justice law in the process of settlement of criminal case in Criminal Law in Indonesia. This type of research is normative juridical that describes reviewing and explaining and analyzing normative provisions associated with restorative justice applicable in Indonesia. From the above discussion that restorative justice in the settlement of criminal acts committed by children is very concerned in rebuilding relations after the occurrence of criminal acts, rather than exacerbate the rift between the perpetrators, victims and the community which is the character of the current modern criminal justice system. The restorative criminal justice process holds the view that realizing justice is not only a matter of government and criminality, but more than that it must provide justice in totality that can not ignore the interests and rights of victims and society. Implementation of the principle of restorative justice and the process of diversion as an effort to solve crimes committed by children in formal juridical has been set clearly and firmly in Law Number 11 Year 2012 about kids of justice.

Restorative Justice (Keadilan Berbasis Musyawarah) adalah satu pendekatan utama, yang saat ini, berdasarkanUndang-undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, wajib dilakukan dalam perkaraanak yang berhadapan dengan hukum. Pendekatan ini lebih menitikberatkan pada kondisi terciptanya keadilandan keseimbangan bagi pelaku tindak pidana serta korbannya sendiri. Mekanisme tata cara dan peradilan pidanayang berfokus pada pemidanaan diubah menjadi proses dialog dan mediasi untuik menciptakan kesepakatan ataspenyelesaian perkara pidana yang lebih adil dan seimbang bagi pihak korban dan pelaku. Pokok permasalahandalam penelitian ini adalah (1) Apa latar belakang filosofis lahirnya Restorative Justice dalam UU SPPA? (2)Mengapa Restorative Justice harus dilakukan sebagai perlindungan terhadap anak yang berhadapan denganhukum; dan (3) Bagaimana cara menerapkan Restorative Justice dalam praktik peradilan pidana sebagaiperlindungan anak yang berhadapan dengan hukum. Metode pendekatan yang dipergunakan dalam penelitianini adalah yuridis normatif dan empiris, yaitu cara atau prosedur yang digunakan untuk memecahkan masalahpenelitian dengan meneliti data sekunder terlebih dahulu untuk kemudian dilanjutkan dengan meneliti dataprimer yang ada di lapangan. Data primer adalah data yang diperoleh langsung dari masyarakat. Hasilpenelitian menunjukkan bahwa Restorative Justice harus dilakukan sebagai wujud perlindungan atas anak yangberhadapan dengan hukum, karena pada dasarnya ia tidak dapat dilepaskan dari konteks yang melingkupinya,sehingga tidak adil apabila ia dikenai sanksi retributif, tanpa memperhatikan keberadaannya dan kondisi yangmelingkupinya. Implementasi Restorative Justice dalam UU Sistem Peradilan Pidana Anak adalah dilakukanmelalui mekanisme Diversi, dengan produk pengadilan berupa penetapan (Pasal 12 dan 52, dan non diversi/mediasi, yang bisa dilakukan di luar atau di dalam persidangan, dengan produk pengadilan berupa putusan,yaitu pidana atau tindakan (Pasal 69). Mekanisme dialog dan mediasi dilangsungkan dengan melibatkan selainkedua belah pihak pelaku dan korban, dapat juga pihak lain. Berdasarkan kesimpulan hasil penelitian dalampraktek peradilan pidana, penerapan Restorative Justice sebagai wujud perlindungan hak anak yang berhadapandengan hukum belum menjadi kecenderungan utama.AbstractRestorative Justice is one of main approach, this time, based on the Law Number 11/2012 concerning JuvenileJustice System need to be done in the case of children against the law. This approach stresses on condition ofhow to create justice and balance to offenders and the victims. Mechanism, procedure and criminal justice arefocused on criminalization changed into dialogue and mediation to find agreement/deal on a fair adjudicationof criminal case to victims and offenders. The main problem in this research is (1) what the background ofphilosophy inception of restorative justice in Indonesia positive law; (2) why restorative justice has to do aschildren protection against the law; and (3) how to apply restorative justice in criminal justice of childrenprotection against the law. This research uses normative and empirical juridical approach that is meansor procedure used to solve the research problem by researching secondary data, previously then proceedprimary data in the field. Primary data obtained by people through observation and interview. The result of thisresearch shows that restorative justice must be done as entity of children protection against the law, because itessentially cannot remove from context that cover it, so it is not fair if he/she has retributive sanction withoutpaying attention existence and condition surrounding him/her. The implementation of restorative justice of theJuvenile Justice System Law carried on diversion mechanism, with court product such as stipulation (articles12 and 52, and non diversion/mediation, can be conducted outside or inside of trial, with verdicts, namelycriminal or criminal action (article 69. Mechanism of dialogue and mediation is held by engaging otherparties. It concludes that the practice of criminal justice, restorative justice as entity of children protectionagainst the law has not become primary tendency, yet.

Various problems that occur in a community, is a social phenomenon that has existed since the start of human life. Problem solving methods that can be taken is basically divided into two, namely the completion of the litigation and non-litigation pathway. In fact, if there is a problem, especially with regard to criminal law (criminal case), the model of problem solving is always done using the path of litigation. The settlement of this litigation by using paths in practice does not always go according to what is expected due to the settlement of litigation by using the path in the traditional criminal justice system today would lead to new problems such as: pattern of retaliatory punishment still, causing a buildup of the case, do not pay attention to the rights of the victim, not in accordance with the principle of simple justice; process is long, complicated and expensive, and the settlement is legistis stiff, does not restore the effects of crime, prisons conditions are not adequate, does not reflect justice for the community and so although, the law was made essentially to provide fairness and benefits to humans. Looking at these phenomena, in the latest development emerged a new concept or approach the concept of restorative justice. The concept of restorative justice approaches assessed or can cope with various problems in the traditional criminal justice system as mentioned above.This study will discuss the application of restorative justice in terms of the integrated criminal justice system in Indonesia. This research is a descriptive normative legal analysis. The approach used is a statutory approach, conceptual approach, and the principles of law.Keywords: Restorative Justice, Integrated Criminal Justice System.

In the 21st century, the concept of restorative justice has become widespread in criminal proceedings. The introduction of special compromise procedures into the criminal process allows for the restoration of the rights of the victim and reduces the level of repression in the criminal justice system. The traditional system of punishment is considered ineffective, not conducive to the purpose of compensating for harm caused by the crime. Restorative justice enables the accused to compensate for the harm caused by the crime and is oriented not towards their social isolation, but towards further positive socialization. The introduction of the ideas of restorative justice into the Russian criminal process requires the introduction of special conciliation procedures. The purpose of the article is to reveal promising directions for introducing special conciliation procedures into the Russian criminal process. The use of the formal legal method provided an analysis of the norms of criminal procedure legislation and the practice of its application. Comparative legal analysis revealed common features in the development of models of restorative justice in modern states. Conclusions. The introduction of conciliation procedures into the Russian criminal process is in line with the concept of its humanization and reduction of the level of criminal repression. The consolidation of the mediator»s procedural status and the mediation procedure in the criminal procedure legislation will make it possible to put into practice the elements of restorative justice.

This paper looks at the criminal case of Deborah Peagler and the California habeas law and explores the effectiveness of legislative changes to domestic battery laws as a mechanism for change in the criminal justice system in regards to its treatment of domestic violence survivors accused of committing a crime against their abuser. It focuses on the androcentric and racialized nature of the criminal justice system and argues that while legislative changes brought about by social movements facilitate opportunities for women like Peagler to pursue just outcomes, they do not counter the gender biases prevalent in the justice system and, alone, are insufficient in improving the treatment of domestic violence survivors in the criminal justice system.

Increased recognition of the need for victims of crime to be integrated into the criminal justice system and to receive adequate reparation has led, in a number of jurisdictions, to legislative measures to encourage the greater use of compensation orders. The Sentencing Act 1997 (Tas) (which came into force on 1 August 1998) went further and made compensation orders compulsory for property damage or loss resulting from certain crimes. This article shows that this measure has failed victims and argues that they have been used in the service of other ends. Mandatory compensation orders are a token gesture repackaged as restorative justice to gain public support for the administration of the criminal justice system.Ways in which compensation orders could be made more effective and the possibilities of accommodating restorative compensation into a conventional criminal justice system are explored.
