Kajian ini bertujuan untuk mendeskripsikan penegakan hukum terhadap pembajakan karya cipta melalui pendekatan indikator penegakan hukum dalam perspektif teori fungsionalisme struktural. Metode yang digunakan dalam kajian ini adalah yuridis empiris, yaitu mendeskripsikan fenomena (penegakan hukum terhadap pembajakan karya cipta) dalam perspektif fungsional struktural. Sedangkan analisis data yang digunakan adalah kualitatif. Data yang telah diperoleh dianalisis melalui penalaran berdasarkan logika untuk dapat menarik kesimpulan yang logis. Hasil kajian menunjuk-kan bahwa penegakan hukum terhadap pembajakan karya cipta melalui rezim hukum hak cipta tidak efektif, karena itu perlu pendekatan sistematis berdasarkan teori fungsionalisme struktural, yaitu adaptation (harus menyesuaikan dengan lingkungan  hukum hak cipta itu berlaku), goal attainment (memenuhi tujuannya yaitu kepastian hukum, keadilan, dan kemanfaatan), integration (satu kesatuan yang mencakup hukum-nya [Undang-Undang Hak Cipta], penegak hukum, fasilitas  pendukung, masyarakat dan budaya [hukum]), latency (melengkapi, memelihara, dan memperbaiki, motivasi individu maupun pola-pola kultural yang menopang motivasi untuk mentaati Undang-Undang Hak cipta). Law Enforcement on The Study of Copyright Works In Perspective Theory of Structural Functionalism This study aims to describe law enforcement against copyright piracy through an Indicator of Law Enforcement approach in the Perspective of Structural Functionalism Theory.The approach method used in this study is empirical juridical, which is to describe the phenomenon (law enforcement against copyright piracy) in a functional structural perspective. While the data analysis used is qualitative, ie the data that has been obtained is analyzed through logic based reasoning to be able to draw logical conclusions.The results of the study show that law enforcement against copyright piracy through an ineffective copyright law regime therefore requires a systematic approach based on structural functionalism theory, namely: Adaptation, must adapt to the applicable copyright law environment. Goal attainment, fulfilling its objectives, namely legal certainty, justice and expediency. Integration, is a unit that includes: the law (copyright law), law enforcement, supporting facilities, society and culture (law). Latency, equipping, maintaining, and improving, individual motivation and cultural patterns that support motivation to comply with the copyright law.

The development of human creativity in creating a work that can have economic value requires legal protection. This protection is very important to encourage the creative enthusiasm of people. There are some basic principles of the copyright law protection of the sound recordings results in its protection that need to be considered, such as what is protected by copyright is an idea that has been tangible and original. As a result of law enforcement efforts against piracy song or music copyright is regulated in the Article 72 where the law enforcement efforts by the government by providing criminal sanctions and civil sanctions with claims for compensation, the Supreme Court considers the reasons of the Petitioner for Review that these reasons cannot be justified, because the judex juris did not commit an error or a real mistake in deciding the a quo case . In general, the forms of Song or Music copyright piracy are divided into several categories, namely Pirate, Couterfeit and Bootleging. The motive for the piracy is for commercial interests in the form of financial gain. Copyright is one part of intellectual property that has the widest scope of protected objects. The rapid development of information and communication technology requires rules that support copyright, especially with the rampant piracies. Therefore, copyright must have a legal protection as other rights. This paper is dedicated to outlining the concept of piracy of works in the field of copyright using an integrated review of Islamic law and the Indonesian Law No. 28 of 2014 concerning Copyright. By using a deductive framework and normative approach, this paper formulates one finding that copyright piracy even though there are no clear and standard rules in Islamic law, by using analogy (qiyās) method, the copyright rule is in accordance with the law against the perpetrator of theft (saraqah). However, because a pirator of copyrights is not the same as a theft, its rule enters ta’zīr domain where all provisions for sanctions are determined by the government. In Indonesia, the actualization of sanctions is regulated in Law No. 28 of 2014, which essentially strives to create justice and guarantee of every individual right that leads to widespread benefit. Islamic law (in this case saraqah rules) becomes the theological basis for Law No. 28 of 2014 in a normativity context, where the integration points of Islamic law and Indonesian law can be established.

The problematic gap between legal and social norms exists in copyright law. The consequences of this gap are severe and include: not following copyright rules, and a big conflict between artists and recipients of a culture. In this context, copyright piracy is prevalent in Poland and legal tools aimed to protect interests of artists have failed. Copyright law might have been in sync with analogue era, but not to digital world. Identification of roots of the discrepancy between social expectations and legally binding rules might be the first step toward rectifying of situation. This article demonstrates the conceptual metaphors as a possible reason for malfunctioning the copyright law. Some metaphors treat intangible objects as tangible ones (intellectual or artistic work) and might pose difficulties mentioned above. Additionally, Larsson defined a group of metaphors in legal system. Bound with them are metaphors outside of law. For example, if law treats intellectual property as tangible property, than metaphors outside the copyright legal system, such as piracy apply. Polish copyright law in the context of Lakoff – Johnson theory of metaphors is a framework of the study.

Uncontrolled piracy in the community will clearly have a negative impact on Indonesia. Hal ini dikarenakan HKI berkaitan erat dengan teknologi, ekonomi, maupun seni budaya. Begitu pentingnya HKI dalam kehidupan, selayaknyalah HKI tersebut dilindungi. Salah satu bentuk HKI yang harus dilindungi adalah hak cipta, khususnya karya musik dari tindakan pembajakan. Hal ini menjadi penting, karena karya cipta musik dihasilkan melalui pengorbanan pikiran, tenaga, waktu bahkan biaya. Indonesia memang sudah memiliki Undang-undang untuk melindungi hak cipta. Namun undang-undang tersebut belum mampu membuat para pelaku pembajakan jera. Pembajakan bahkan cenderung semakin marak dan memprihatinkan. Maraknya pembajakan di tengah masyarakat jelas akan berdampak negatif terhadap Indonesia. Citra buruk oleh dunia internasional dan ancaman mendapat sanksi dipastikan diterima oleh negara Indonesia. Disamping itu, maraknya aksi pembajakan juga akan berakibat menurunnya semangat berkreasi dari kalangan seniman. Melihat kondisi maraknya pembajakan karya cipta musik di Indonesia dan sebagai negara penandatanganan perjanjian TRIPs mau tidak mau Indonesia harus menegakkan hukum di bidang HKI, khususnya hak cipta. Lebih khusus lagi hak cipta karya musik. Jika pembajakan hasil karya cipta musik terus berlanjut, pencipta akan terus mengalami kerugian terutama dalam bidang ekonomi. Untuk itu, negara mempunyai tanggungjawab moril terhadap perlindungan karya cipta yang dimiliki anak bangsa dari tindakan pembajakan.</p><p><em><strong>Kata Kunci: </strong>perlindungan, hak cipta, pembajakan.<br /></em></p>

 The number of piracy cases are popping up in the environment community indicates malfunctioning of the Act or law in mengujudkan legal protection of copyright musical works. It makes people increasingly do not trust the government officials there. Whereas cases of music copyright piracy is certainly not to be taken lightly. If left Indonesia will be increasingly threatened by the danger of a prolonged legal harassment, and it would threaten the creativity of the people of this country.
