Recent years have witnessed a number of counterclaims by State parties in investment treaty arbitrations based on environmental concerns and the need to protect local resources and safeguard the associated human rights of local communities. This article charts the development of the case law in this context, starting with the Urbaser v. Argentina award of December 2016, before examining its impact on the cases that followed in its wake, notably including the respective 2017 and 2018 awards in Burlington v. Ecuador and Aven v. Costa Rica. It concludes by considering whether these recent cases mark the beginning of a new era of international law claims which finds a parallel in the broader paradigm shift in public discourse on the critical role of all stakeholders in the conservation of the environment, and which may one day result in investors facing standalone claims as the respondent in future investment treaty claims brought by States.

The article analyzes the role of economists in public discourse with regard to the financial crisis. Specifically, it focuses on the prevailing rhetorical strategies and the economic convictions of leading German-speaking economists as they appear in seven leading newspapers and magazines in the German-speaking area. Special attention is given to the prevailing rationales and explanations for the financial crisis as well as on the metaphors used for describing specific economic events in particular and the market economy in general. The results of this article show that while the financial crisis could have offered a possibility for a paradigm shift in economic thinking, there is not much evidence for such a shift among German-speaking economists. The observed stability of the dominant paradigm is attributed primarily to the very stable role of certain basic economic convictions, which are exposed through the use of specific metaphors as well as a characterization of the financial crisis as a series of extraordinary and exogenously given events. Although narrative journalism has a long history in the Netherlands, it is in recent years being promoted as a ‘new’ genre. This study examines the motives underlying this promotional tactic. To that end, we analyze how narrative journalism is framed in (1) public expressions of the initiatives aimed at professionalization of the genre and (2) interviews with journalists and lecturers in journalism programs. Results indicate that in public discourse on narrative journalism, the genre is framed as moving, essential, and as high quality journalism. These frames indicate that the current promotion of narrative journalism as ‘new’ can be seen as a strategy that journalists apply to withstand the pressures they are facing in the competition with new media. These frames are deepened in the interviews with lecturers and practitioners, who frame narrative journalism as a dangerous game, a paradigm shift, and as the Holy Grail. These frames indicate that narrative journalism is regarded as the highest achievable goal for journalists, but that its practice comes with dangers and risks: it tempts journalists to abandon the traditional principles of objectivity and factuality, which can ultimately cause journalism to lose its credibility and authority. We discuss these findings in terms of boundary work and reflect on implications for narrative journalism’s societal function.

A sustainable family policy acknowledges the contributions of the family to society and takes it as point of departure for the support of the family. It is characterized by a clear goal orientation and the integration of different policy measures into a comprehensive strategy. Based on this concept, the article reflects the historical evolution of family policy focusing on the question whether and to what extent a paradigm shift from compensation to active support has occurred in the interpretation of policies in the fields of infrastructure, time and money. This is essential for the historical genesis of the parental allowance, considering that the emergence of the concept of a sustainable family policy was based on this paradigm shift. By means of reconstructing the conceptual evolution and political implementation of the parental allowance since the 1970s, we argue that this political measure is the first to be integrated in such a concept. The analysis shows that even though the parental allowance is a progressive element of a sustainable family policy, the implementation of a comprehensive strategy still lacks a shift towards the life course perspective and an independent basic income for children. Zusammenfassung Nachhaltige Familienpolitik erkennt die Leistungen der Familie für die Gesellschaft an und nimmt sie als Ausgangspunkt für die Unterstützung der Familie. Sie zeichnet sich durch klare Zielorientierungen und die Integration der verschiedenen familienpolitischen Leistungen aus. Vor diesem Hintergrund analysiert dieser Beitrag, ob und inwiefern aus der Entwicklung der Familienpolitik ein Paradigmenwechsel im Verständnis der familienpolitischen Kernelemente Infrastruktur, Zeit und Geld von einem Nachteils- zu einem Leistungsausgleich hervorgegangen ist. Denn erst auf dieser Grundlage konnte das Konzept nachhaltiger Familienpolitik formuliert werden. Anhand der Rekonstruktion der konzeptionellen Entwicklung und politischen Durchsetzung des einkommensabhängigen Elterngeldes seit den 1970er Jahren wird aufgezeigt, dass hier zum ersten Mal eine familienpolitische Maßnahme geschaffen wurde, die in dieses Konzept eingebettet ist. Die Analyse zeigt jedoch, dass das Elterngeld zwar ein Element einer nachhaltigen Familienpolitik ist, es aber bisher weder gelungen ist, eine am Gedanken des Leistungsausgleichs orientierte finanzielle Transferpolitik zu konzipieren noch eine Lebensverlaufsorientierung umzusetzen.

The demographic change in Germany brings about diverse challenges and burdens. Family policy has the potential to play a special, formative role in influencing and shaping demographic development. This raises the question of how family policy is determined within its current demographic context. To answer it, this article lays out the fundamental goals, schemes and responsibilities of present-day family policy in Germany a striking feature of which is that its task is cross-sectional in nature. The example of old-age provisions shows how far-reaching family policy schemes are, and how they are gaining in importance given the current demographic context.
