Sport is a useful area of study to test assumptions of international law. International law has traditionally focused on states and on international organizations that oversee specialized areas of human activity. International sport is overseen by an NGO—the International Olympic Committee (IOC). Yet sport is of great interest to states, serving as a testing ground of national superiority by providing a simple narrative of “winners” and “losers” in competition. Meanwhile, entities that are not yet states have historically been able to participate in international sport more readily than in other areas of international relations. This essay will examine the connection between participation in the Olympic Games and claims to statehood. In doing so, this essay will outline the modern approach to statehood, consider sport's role in that approach, and examine two case studies: the German Democratic Republic, and Kosovo.

В данной статье рассматривается актуальный вопрос расходов на организацию летних Олимпийских игр на предолимпийском этапе. В статье проводится анализ структуры расходов на рассматриваемом этапе на примере XXXII летних Олимпийских игр в Токио. Детально исследуется структура расходов на двух крупных подэтапах: подача заявки на проведение Игр и непосредственно организация Олимпиады, при этом отдельно выделяются расходы трёх основных групп: Международного олимпийского комитета (с фокусом на программе Олимпийской солидарности), условной группы бизнеса и условной группы государства. На первом подэтапе в условную группу государства входят Токийский муниципалитет, правительство Японии и Заявочный комитет Токио 2020, в то время как на автором рассматриваемом подэтапе место Заявочного комитета занимает учреждённый в 2014 г. после официального избрания Токио городом-организатором Организационный комитет Токио 2020. В рамках каждой из трёх основных групп приводятся конкретные проекты, проводится анализ статей расходов на их осуществление. Отдельно стоит выделить тот факт, что автор, являясь действующим сотрудником Организационного комитета Токио 2020, осуществляет детальное изучение проектов и статей расходов, зачастую не попадающих в поле зрения исследователей данной темы. Отдельно анализируются факторы и причины увеличения первоначального бюджета на организацию и проведение XXXII летних Олимпийских игр, в частности такие, как перенос соревнований по марафону и спортивной ходьбе из Токио в г. Саппоро, перенос Игр на 2021 г. в связи с угрозой распространения вируса COVID-19 и т.д. На основе имеющихся данных по состоянию на май 2020 г. выделяется ряд тенденций, связанных со статьями расходов отдельно взятых групп. Основываясь на данных проведённого исследования, автор делает вывод, что наибольшие расходы на предолимпийском этапе несёт условная группа государства, в рамках которой доли Токийского муниципалитета и Оргкомитета Токио 2020 условно равны. This article deals with the topical issue of the costs related to hosting the Olympic Games at the pre-Olympic stage. The article provides an analysis of the cost structure at this stage on the example of the Games of the XXXII Olympiad in Tokyo. The cost structure in two major sub-stages is studied in detail: bidding stage and the organizing stage, with the focus on the costs of three main groups: the International Olympic Committee (highlighting the Olympic Solidarity program), nominal business group and nominal state group. In the first sub-stage the nominal state group includes Tokyo Metropolitan Government, the government of Japan and the Tokyo 2020 Bidding Committee, while in the second sub-stage the Tokyo 2020 Bidding Committee is replaced by the Tokyo 2020 Organising Committee, established in 2014 after Tokyo was officially elected as the host city. Specific examples of the projects within each of the three main groups are indicated and the analysis of the costs related to their implementation is conducted. It is important to highlight the fact, that the author of the article, being the current employee of the Tokyo 2020 Organising Committee, has carried out a detailed study of projects and cost items that frequently are not covered by other researchers of this issue. The factors and reasons for increased budget, compared with the initial one, for staging and holding the Games of the XXXII Olympiad are analyzed separately; particular emphasis has been put on the transfer of the marathon and race walk competition from Tokyo to Sapporo city and on the postponement of the Games till 2021 due to the threat of the COVID-19 virus spread, etc. Based on the available data as of May 2020, a number of trends related to the cost items of the main groups are indicated. Based on the materials of this article the author concludes that the largest expenses at the pre-Olympic stage are borne by the nominal group of state, within which the shares of Tokyo Metropolitan Government and the Tokyo 2020 Organising Committee are conditionally equal. This chapter describes the contours of the international law (IL) and international relations (IR) scholarship on international organizations (IOs), as well as some of its key characteristics and debates. It proceeds in three parts. Part I briefly surveys the major theoretical approaches to the creation and functions of IOs found in the IL and IR literature. Part II analyzes the most important conceptual debates that have occupied IO scholars in recent years, including debates over the autonomy, accountability, and legitimacy of IOs. Part III explores a cluster of policy dilemmas, including the political implications of institutional fragmentation, how to manage IO interactions, and why IOs increasingly seem unable to effectively address matters of pressing international concern.

This chapter analyses the enforcement of international law by States acting individually, that is, decentralized enforcement, including by their courts, as well as through retortion or countermeasures (once called reprisals). This is the typical form of enforcement under traditional international law. At the same time, enforcement might take place through measures taken by States acting collectively, that is, through mechanisms that include resort to collective measures, such as those adopted at the UN level (or within other international organizations), which can lead to collective sanctions. The first form of enforcement looks at the traditional law governing retortion and reprisals or countermeasures (as they are now called), as well as at the post-1945 law, taking into account that the ban on the use of armed force in international relations imposes that all enforcement measures taken by States individually must be peaceful. The second form examines the issue of collective sanctions, such as those taken at UN level.

In this shrinking world, states are increasingly interdependent and interconnected, a development that has affected international law. Early international law dealt with bilateral relations between autonomous states. The principal subjects until well into this century were diplomatic relations, war, treaties and the law of the sea. One of the most significant developments in international law during the twentieth century has been the expanded role played by multilateral treaties addressed to the common concerns of states. Often they clarify and improve rules of international law through the process of rendering them in binding written agreements. AbstractThis article evaluates the interplay between international sport and international politics during the cold war through an examination of the two Germanys and the Olympics from a British perspective. Germany was at the centre of Olympic and cold war politics between 1945 and the early 1970s, and the two German states competed fiercely over questions of national legitimacy. West Germany was initially successful in denying international recognition to the ‘other’ German state. East Germany countered this by developing a strategy that utilised international sport, particularly the Olympic Games, to further its claims for statehood. While recognising the flaws in the West German case against East Germany, British policy was constrained by the need to accommodate Bonn's sensibilities, given that the Federal Republic was a major ally. An examination of this ‘Olympian’ struggle from a British perspective tells us much about the West's cold war strategy and casts new light on this arena of East–West competition.

The article is devoted to the question of where the international law legitimacy comes from. The author analyzes the consensual sovereign volition of international law subjects (states, nations, international organizations) as the main source of its legitimacy. The specificity of legitimacy depending on the type of international law norms is indicated. Types of international law legitimacy in the context of its sources are distinguished. Positions on the question of criteria of the legitimacy are given. The author points out the interrelationship between legitimacy of international and national law. It is concluded that legitimacy is an essential feature of international law, since the source of international law legitimacy is the same as the source of the creation and mandatory of its norms, namely, the consensual sovereign volition of the participants of international relations.
