Convergence and Divergence in ‘New Governance’ Arrangements: Evidence from European Integrated Natural Resource Strategies

To analyse convergence and divergence in Natural Resource New Governance Arrangements (NRNGAs) two regimes in the environmentally-related areas of forest and fisheries management are examined. The findings reveal limited convergence across sectors and countries in the general aims and ideas behind NGAs and evidence of significant policy divergence in the tools and mechanisms created for their implementation. The reasons for the differences lie primarily in the policy formulation process. While the impetus for the adoption of both NRNGAs is in the international and regional realms, without the force of either international law or competitive advantage, pressure for convergence is weak. Aspects of the policy formulation process, especially the manner in which the changing capacities of domestic public and private actors active in the affected resource policy arena interact to influence policy design, are critical for explaining policy convergence and divergence. Specifically, the interplay between the effect of the internationalization of resource policy issues, tending to increase private capacities at the expense of the public one, and the declining importance of primary industries, which has the reverse effect, is shown to have played an important role in NRNGA policy dynamics.

The application of the resource-oriented approach used in this book confirms the prominent role of the resource Property in the resource portfolios of each of the three policy actors. Property consists of the ownership of property and use rights to material and immaterial (natural, manufactured, social and/or human) resources and the various bundles of goods and/or services they provide to the owner. One of the prominent services of such resources involves their role as policy resource (abstract use of such resources as opposed to concrete uses). The most prominent material resource is the ownership of (strategic) land, which enables both public and private actors to play a predominant role in policy formulation and, especially, implementation processes. The chapter illustrates the mobilization and use modes of the resource Property in the areas of spatial planning, institutional policies (creation of a Swiss canton) , public accounting and state infrastructural policies (land acquisition policies for communal land use policy). It stresses the role of legal appeals by target groups or beneficiary organizations and the privileged position occupied landowners in the planning and implementation of large urban projects.

This Special Issue aims to develop a deeper understanding of the interplay between public and private actors in the regulatory governance of food. It starts from the observation that the traditional concept of law as command-and-control legislation and law enforcement by national governmental bodies, including inspectorates and courts, is not adequate to capture today's world of food governance. Nowadays, a broad range of public and private entities acting at national and international level seek to shape and influence the production, trade and handling of food and the risks involved therein. Drawing on data from Europe and the United States, the contributions to this Special Issue seek to unravel the intimate, yet complex ties between public and private actors within governance arrangements regulating food safety and sustainability. The articles are focused around the various phases of the policy cycle for food governance, thus addressing the interaction in stages of agenda-setting and rule-making, adoption and implementation, monitoring and enforcement, and evaluation and review. In descriptive terms, each contribution lays out the ‘who’ (actors), the ‘what’ (activity), the ‘why’ (rationale) and the ‘how’ (instruments) of food governance. In evaluative terms, the papers discuss and explain the results and challenges of the design of the public private governance arrangements. Jointly, the contributions offer original and invaluable empirical insights explaining the rise, design and challenges of mixed governance arrangements in the food sector.

The most important phenomena attributable to the project of “global administrative law” (GAL) consists of rules, principles, practices, or procedures that have a more informal character and are generated from networks of public and private actors. The main characteristics of those rules is that they tend to be generated below the level of formal international treaties and that norm production occurs—at least in part—outside traditional formal modes of decision-making. However, some GAL norms including standards on products and services in particular, can have far reaching consequences as their factual weight is much more influential than domestic norms. GAL also develops new forms of procedure (e.g., voting) that are different from traditional international forms.

Por ello, en el marco de toda ordenación territorial, la planificación mediante la participación de todos los agentes públicos y privados que operan en el ámbito agrosilvopastoral se erige en instrumento esencial de las orientaciones garantizadoras de una gestión que, aprovechando óptimamente el monte en el presente, transmita ese mismo valor social y económico a las futuras generaciones. ABSTRACT: The management of forests and the forest policy are presently based on enviromental and sustainability criteria which are addressed to the decisions regarding the exploitation of the main natural resource of the territory. Because of it, in the framework of the whole territorial planning, the planning by the participation of all the public and private agents that operate within the agrarian, forest and herding field becomes an essential instrument of the guidelines that guaratee the management which using ideally the forest nowadays give that same social and economic value to the future generations.

The prevailing practice in new areal real estate development is for public and private actors to perform their duties by turns. Yet, the planning process could benefit from simultaneous contributions from society and developers and their designers. That, again, requires that the municipality selects the private partner consortia prior to completion of the local detailed plan through a competition in order to find the most potential actors and the best ideas for implementation of an urban structure of high quality. Candidates will be attracted by offering them the right to implement a residential/business block as a developer. The several blocks involved in an areal development project, and the laboriousness of producing competitive solutions, require a well planned selection process. A novel multi‐target competition process was developed which is presented in this paper with special emphasis on the allocation algorithms that allow selecting the most qualified competitors for parallel follow-up competitions from among a large group of registered candidates. The approach was tested in an actual real estate development project in the municipal district of Vuores which was the original reason for launching the study. Kai teritoriju pletros projektas apima kelis kvartalus, o kuriant konkurencingus sprendimus idedama daug darbo, reikia gerai suplanuoto atrankos proceso. Yra sukurtas novatoriškas daugiatikslis konkurso procesas, pristatomas šiame darbe, daugiau demesio skiriama paskirstymo algoritmams, kuriuos naudojant iš daugybes registruotu kandidatu galima atrinkti tinkamiausius tolesniems tuo pat metu vykdomiems konkursams. Toks būdas patikrintas realiame nekilnojamojo turto pletros projekte, kuris vyko Vuores savivaldybes teritorijoje, ir būtent del šios priežasties pradetas šis tyrimas.
