Carceral Feminism: Saving Indigenous Women from Indigenous Men

This article offers a cautionary tale for efforts to decriminalize domestic violence through a retrospective analysis of Canadian feminist legal activism to decriminalize sex work. Both domestic violence and sex work are contested terrains of activism, litigation, and scholarship and have come up against the disparate views of criminalization as necessary to protect women from violence, versus criminalization as compounding women’s potential risks for violence. Through the example of Canadian feminist jurisprudence in R v Bedford, wherein the Supreme Court of Canada recognized the endangerment of women as resulting from the criminalization of sex work, I explore the liminal space following this decision, and how regressive legislation was introduced to re-entrench carceralism in the breach of a seeming feminist victory. My focus is on how carceral feminism continues to occupy the liminal space as a force of colonial violence, further endangering Indigenous women. I draw linkages between several violent murders of street-involved Indigenous women and the severing of allyship among feminists, sex workers, and Indigenous women over the potential decriminalization of sex work. Finally, I suggest that opposition to the decriminalization of sex work is successfully argued by an emerging force of carceral feminism: neo-abolitionist feminists who have appropriated a politics of abolition and, yet, may have deepened carceralism in the lives of Indigenous women.

Abstract This paper will reflect on key findings from a Summer 2017 initiative entitled The Role of Culture and Land-Based Healing in Addressing and Ending Violence against Indigenous Women and Two-Spirited People. The Indigenist and decolonizing methodological approach of this work ensured that all research was grounded in experiential and reciprocal ways of learning. Two major findings guide the next phase of this research, complicating the premise that traditional economic activities are healing for Indigenous women and Two-Spirit people. First, the complexities of the mainstream labour force were raised numerous times. Traditional economies are pressured in ongoing ways through exploitative labour practices. Secondly, participants emphasized the importance of attending to the responsibility of nurturing, enriching, and sustaining the wellbeing of soil, water, and original seeds in the process of creating renewal gardens as a healing endeavour. In other words, we have an active role to play in healing the environment and not merely using the environment to heal ourselves. Gardening as research and embodied knowledge was stressed by extreme weather changes including hail in June, 2018, which meant that participants spent as much time talking about the healing of the earth and her systems as the healing of Indigenous women in a context of ongoing colonialism.

According to the results of breast cancer data in the Republic of Uzbekistan in addition to the increase in morbidity and mortality from breast cancer among women the presence of age specific features among indigenous women in the direction of “rejuvenating” of the disease with all molecular-biological (phenotypic) subtypes of breast cancer were marked. Within the framework of age-related features the prevalence of the least favorable phenotypes of breast cancer was found among indigenous women: Her2/neu hyperexpressive and three times negative subtype of breast cancer. The data obtained made it possible to build a so-called population “portrait” of breast cancer on the territory of the Republic, which in turn would contribute to further improvement of cancer care for the female population of the country.

Using the theoretical framework of epistemic injustice articulated by philosopher Miranda Fricker as an analytic tool, we analyze recent victories of Indigenous feminist activism in gathering the stories of Indigenous women, challenging dominant meta-narratives and rewriting the herstory of Canada. We use the epistemic concept of the hermeneutic gap to consider the implications of this resistance in conjunction with the increased visibility of the intersectional positionality of Indigenous women. To illustrate our analysis, we focus on two case studies. Firstly, an individual perspective through the life journey of a feminist Anishinaabe Activist, Bridgett Perrier. Secondly, we conduct a systemic analysis of the recent Report on the National Inquiry into the Missing and Murdered Indigenous Women and Girls (MMIWG). We close with a discussion on how critical it is for social workers—especially non-Indigenous social workers—to relearn and document the meaning of the MMIWG issues. This includes recognizing Indigenous resistance, activism, and the newly formulated hermeneutic understandings that are emerging. Then, the final task is to apply these concepts to their practice and heed the calls to action which the report calls for.
