Seasonal Water Allocation: Dealing with Hydrologic Variability in the Context of a Water Rights System

Water-rights trade has proved to be an effective method for coping with water shortages through the transfer of water resources between users. The water allocation system is classified into two categories based on information transparency and water rights transaction goals: administered system (AS) and market-based system (MS). A multi-agent and multi-objective optimal allocation model, built on a complex adaptive system, was introduced to direct the distribution of water resources under an AS in the Shiyang River Basin; it was compared with a market-based water rights transaction model using the bulletin-board approach. Ideal economic agent equations played a dominant role in both models. The government and different water users were conceptualized as agents with different behaviors and goals in water allocation. The impact of water-saving cost on optimal water allocation was also considered. The results showed that an agent’s water-saving behavior was incentivized by high transaction prices in the water market. Under the MS, the highest bid in the quotation set had a dominant influence on how trade was conducted. A higher transaction price will, thus, result in a better benefit ratio, and a lower one will result in inactivity in terms of water rights trade. This will significantly impact the economic benefit to the basin.

Since 1981, water allocation in Chile has been based on a water use rights (WURs) market, with limited regulatory and supervisory mechanisms. The volume to be granted as permanent and eventual WURs is calculated from streamflow records, if stream gauge data are available, or from hydrologic parameter transfer from gauged to ungauged catchments, usually with less than 50 years of record. To test the performance of this allocation system, while analyzing the long-term natural variability in water resources, we investigated a 400 year-long (1590–2015) tree-ring reconstruction of runoff and historical water rights for Perquilauquén at Quella catchment, a tributary to the Maule River in Central Chile (35°S–36°30S). Furthermore, we assess how the current legislation would perform under a projected climate scenario, based on historical climate simulations of runoff calibrated against observed data, and future projections. Our analyses indicate that the allocation methodology currently applied by the Water Authority in Chile is very sensitive to the time window of data used, which leads to an underestimation of variability and long-term trends. According to the WURs database provided by the Chilean Water Directorate, WURs at Perquilauquén at Quella are already over-allocated. Considering regional climate projections, this condition will be exacerbated in the future. Furthermore, serious problems regarding the access and quality of information on already-granted WURs and actual water usage have been diagnosed, which further encumber environmental strategies to deal with and adapt to climate change. We emphasize the urgent need for a review and revision of current water allocation methodologies and water law in Chile, which are not concordant with the dynamics and non-stationarity of hydrological processes. Water scarcity and water governance are two of the key issues to be faced by Chile in the Anthropocene.

Water is becoming an increasingly scarce resource worldwide, suggesting that water rationing methods should be revised to improve water allocation efficiency, especially during cyclical scarcity events (droughts). The proportional rule is the most widely used rationing method to allocate water in cases of water scarcity. However, this method fails to achieve Pareto-efficient allocation arrangements. Economic theory and international experience demonstrate that implementing security-differentiated water rights could improve allocative efficiency during cyclical scarcity periods. Moreover, it has been proven that this kind of priority rights regime is an efficient instrument to share risks related to water supply reliability, and can thus be considered as an adaptation measure to climate change. This evidence has enabled the development of an operational proposal for the implementation of security-differentiated water rights in the irrigation sector in Spain, as an alternative to the current rights based on the proportional rule. This proposal draws on the Australian case study, which is the most successful experience worldwide. Nevertheless, the insights obtained from the analysis performed and the proposal for reforming the water rights regime are applicable to any country with a mature water economy.

This paper outlines how an area-based water allocation system for irrigating crops could be converted to a system of shares, structured so as to allow the development of a low cost trading market for water and salinity shares. It stresses the need for separation of entitlements of water from land and the separation of water rights into their various components. By moving to this type of allocation system, combined with some safeguard provisions, trade in groundwater could be facilitated in the South East Water Catchment located in the State of South Australia. Separation of salinity and other environmental impacts from water volume trading will allow market assessment of highest and best use to include consideration of environmental impacts. Although the focus of the paper is on groundwater allocation and management, the principles and concepts outlined are applicable to surface water systems.

This project developed conceptual and empirical frameworks to analyze the water management politics as water scarcity increases. The analyses showed that increased scarcity will tend to encourage a transition from systems in which water is allocated administratively to water trading. However, transaction costs and political economy considerations placed barriers on the introduction of markets. The recent droughts - both in Israel and California were shown to cause an increase in water use efficiency by adoption of modern technologies and improvement of water conveyance systems. The drought led to institutional innovations and an increased reliance on trading as mechanisms for water allocation. Case studies from both countries demonstrate that reducing barriers to water trading and increasing farmers' flexibility in exchange of water will lead to efficient outcomes and much better uses of existing water resources.

Increased water variability is one of the most pressing challenges presented by global climate change. A warmer atmosphere will hold more water and will result in more frequent and more intense El Niño events. Domestic and international water rights regimes must adapt to the more extreme drought and flood cycles resulting from these phenomena. Laws that allocate rights to water, both at the domestic level between water users and at the international level between nations sharing transboundary water sources, are frequently rigid governance systems ill-suited to adapt to a changing climate. Often, water laws allocate a fixed quantity of water for a certain type of use. At the domestic level, such rights may be considered legally protected private property rights or guaranteed human rights. At the international level, such water allocation regimes may also be dictated by human rights, as well as concerns for national sovereignty. These legal considerations may ossify water governance and inhibit water managers’ abilities to alter water allocations in response to changing water supplies. To respond to water variability arising from climate change, such laws must be reformed or reinterpreted to enhance their adaptive capacity. Such adaptation should consider both intra-generational equity and inter-generational equity. One potential approach to reinterpreting such water rights regimes is a stronger emphasis on the public trust doctrine. In many nations, water is a public trust resource, owned by the state and held in trust for the benefit of all citizens. Rights to water under this doctrine are merely usufructuary—a right to make a limited use of a specified quantity of water subject to governmental approval. The recognition and enforcement of the fiduciary obligation of water governance institutions to equitably manage the resource, and characterization of water rights as usufructuary, could introduce needed adaptive capacity into domestic water allocation laws. The public trust doctrine has been influential even at the international level, and that influence could be enhanced by recognizing a comparable fiduciary obligation for inter-jurisdictional institutions governing international transboundary waters. Legal reforms to facilitate water markets may also introduce greater adaptive capacity into otherwise rigid water allocation regimes. Water markets are frequently inefficient for several reasons, including lack of clarity in water rights, externalities inherent in a resource that ignores political boundaries, high transaction costs arising from differing economic and cultural valuations of water, and limited competition when water utilities are frequently natural monopolies. Legal reforms that clarify property rights in water, specify the minimum quantity, quality, and affordability of water to meet basic human needs and environmental flows, and mandate participatory and transparent water pricing and contracting could allow greater flexibility in water allocations through more efficient and equitable water markets.
