Thymos (or thumos), cognate with Indo-European words meaning “smoke,” is one of a number of terms in Greek which associate psychological activity with air and breath. In the Homeric poems, thymos is one of a family of terms associated with internal psychological process of thought, emotion, volition, and motivation. Though the range of the term’s applications in Homer is wide, that in itself gives us a sense of the unity of cognitive, affective, and desiderative processes in Homeric psychology. No post-Homeric author can rival that range, but something of the richness of the Homeric conception of thymos as an interrelated set of motivations re-emerges in Plato’s conception of the tripartite soul in the Republic and the Phaedrus. Plato’s thymos represents a pared-down model of human agency typified by one central desire or aim in life but also exhibiting whatever further capacities of persons are necessary to enable it to pursue that aim in interaction with the other elements of the personality. As in Homer, the metaphorical agency of Plato’s thymos does not detract from the notion of the individual as the real centre of agency. Plato’s conception of thymos, in turn, is a fundamental point of reference for Aristotle’s treatment of thymos as a type of desire (orexis). Though Aristotle tends more generally to use the term as a synonym for orgē (anger), there are also traces of older associations between thymos and qualities such as assertiveness and goodwill towards others. Elsewhere, thymos tends to mean “heart” or “mind” (as aspects of mental functioning), “spirit,” “inclination,” or “anger.” A selection of these uses is surveyed, but the article overall concentrates on Homer, Plato, and Aristotle, where the role of thymos is of a different order of importance.

In the decade following the passage of the Federal Securities Laws of 1933 and 1934, the reform of accounting and auditing practices directed authority for selection of accounting principles and auditing procedures away from the discretion of the individual accountant and auditor. Instead, a self-regulatory peer driven process to establish general acceptance for a more limited set of principles and procedures was being initiated. Two events which occurred in 1938 indelibly affected this process, the SEC's decision to issue Accounting Series Release No. 4, which empowered non-governmental entities as potential sources of authoritative support, and the McKesson & Robbins fraud which called into question the value of the independent audit and the role of external auditing at the very time a momentum had been established for self-regulation by the nascent and recently reunified accounting profession. The contributions of Samuel J. Broad in both the initiatives for self-regulation of accounting principles and of auditing procedures is examined in this paper. Further, several examples of Broad's rhetorical technique of employing analogous reasoning to facilitate dissemination of complex economic and accounting issues are examined.

This paper is an exploration of the chronological development of a series of elaborate and architecturally distinctive chambered tombs on the Islands of Orkney. It begins with a short critique of the present views of the Orcadian Neolithic and highlights a failure to understand chronological developments as the most significant problem. Thus after a brief classification of the monuments there is a detailed discussion of the chronological evidence which consciously avoids typological assumptions. This is followed by an examination of the various uses the tombs were put to and involves an assessment of the location and architectural visibility of the monuments and the remains found in the chamber. When combined with the chronological evidence a series of changes in monument size, type, location and use can be hypothesized for the neolithic period. This culminates in a shift away from burial monuments to physically defined spaces, presumably used for ceremonial purposes. These changes can be interpreted as deliberate manipulation by groups within that society to change the ideological concepts which defined the role of the individual in relation to the other members of the society.

Self-touching gestures can be externally induced by the verbal presentation of anxiety-inducing stimuli and the active discussion of a passage. The frequency of these self-touching gestures appears to be affected by the individual interacting with the topic, the type of discourse (listening or discussing), the type of stimulus (canaries or leeches), and the interaction between the types of discourse and stimulus. This study assessed these variables as well as the sex of the participant and the order of presentation of stimulus type, neither of which were statistically significant. Participants were read two passages, one about a topic (leeches) expected to produce anxiety and the other about a topic (canaries) not expected to do so, and asked to answer questions about the passages. The number of self-touches was counted by an observer in another room. Each participant had both types of discourse (listening and discussing) and both types of stimulus (canaries and leeches). There was no significant difference between the number of self-touches by participants with either the male or female reader. Discussion as a method of discourse was associated with a significantly greater number of self-touches than listening. The interaction between discourse type and stimulus type was also significant. The combination of the anxiety producing stimulus and the active discourse (discussion) produced the highest average number of self-touches.

Lucrezia Marinella (b. 1571–d. 1653) was a widely known author in Venice and throughout Italy in the late 16th and early 17th centuries. Her poetry and prose works were printed (and even reprinted), attracting notice and renown. Despite her subsequent fame as a proto-feminist, most of her writing is devoted to religious topics, in which her personal, pro-woman stance is present but expressed in ways that are in keeping with the constraints of genre and the culture of her time. She was daughter, sister, and wife to physicians. Marinella’s knowledge emerges as varied and extensive in her writings. Her published texts fall between 1595 and 1605 and then 1617 and 1648; this hiatus is usually explained by the date of her marriage (1607). As remarkable as the length of her career is the span of topics her works engage: lives and stories of the Virgin and of several saints, the struggle of man to defeat sin under the guise of classical mythology, the role of women in society and culture, and the Fourth Crusade are but a few. From her will we know she had a son and a daughter, as well as a granddaughter from the latter. Her diverse topics, choice of form, wide-ranging selection of dedicatees, individual voice, and long career make her an important point of reference for exploring post–Council of Trent literary production by women in Italian.

AbstractIn considering the articles in this Special Issue, I am struck by the importance of a set of factors that, in my view, both run through the articles like a leitmotif, as well as shape the major ‘take away’ lesson(s) from the articles. In this short commentary, I elaborate on these factors and the lesson(s) to take from them through five ‘Cs’: context; complexity; contestation; the framework of constitutions; and the role of comparative law. The first three ‘Cs’ are lessons from the case studies of the articles themselves, while the second two ‘Cs’ are offered as lessons to help take the dialogue forward. Fundamentally, these five ‘Cs’ highlight the importance of the articles in this Special Issue and the conference from which they emerged on the one hand, while on the other hand, also making us aware of what are the limits of what we should conclude from the individual articles. In other words, taken together, the five ‘Cs’ are, one might say, lessons about lessons.

AbstractThe literature has tended to deal with diviners only where they have been seen to play a notable role in the transformation of social relationships. This leads us to overlook their relative social invisibility in many African societies. Yet we may gain insight into the rise of prophets and charismatic healers by looking at the other side of this story in the multitude of very humble practitioners plying their trade. This is the context in which this article explores the role of diviners among the Gisu of Uganda.The privacy of consultation, the search for distant diviners, the way they are approached only at times of crisis and as agents of private counteraction or vengeance, go some way towards explaining why it is difficult for diviners to gain recognition. Added to which are the difficulties of another order which relate to what might here be regarded as divinatory success. For divination may be seen to fail at a number of different levels: in the lack of credibility of a given practitioner, i n a lack of unanimity among those consulted and in the multiplicity of causal agents evoked.An argument put forward here is that scepticism is endemic to the system and, possibly, distinctive to it. We should ask not, as Evans-Pritchard did, how belief i s sustained despite the presence of scepticism but what it is about these beliefs which encourages scepticism. It is not useful to explore this issue in terms of the rationality question or the ‘truth’ of belief systems. If we are to draw a comparison with modern attitudes, of greater significance are the organisation and differentiation of knowledge and its relationship to power. It is suggested that diagnostic systems used by societies such as the Gisu encourage an agnostic attitude in a way i n which those of the modern West do not.In the final part of the article the social role of divination is reconsidered and some of the positive functions proposed for it are questioned. Gisu divination can be seen to have evolved into a very narrow niche whose parameters are bound, on the one hand, by the limits of belief and, on the other, by a system of interpersonal vengeance. We may say that the socially marginal attributes of diviners, exclusively concerned with the negative aspects of social relationships, represent a real social marginality. At best they are agents by which the individual may be reconciled with harshnesses imposed by his own destiny, of ancestral affliction; at worst they are agents of individual vengeance and retribution. This may be taken as more or less disqualifying them from articulating a positive, future-oriented vision on behalf of the community. Clearly it is not impossible but it is a huge jump from these humble practitioners, interpreting the present in terms of the past and trading evil with evil at an individual level, to prophets capable of formulating a positive social vision, a means forward, on behalf of a wider moral or social community.

On 4 July, 1989 in Maina Mbacha v. Attorney General the High Court of Kenya appeared to remove itself from its role of enforcing the Bill of Rights of Kenya. The court ruled “inoperative” section 84 of the Constitution of Kenya which grants original jurisdiction to the High Court to enforce Fundamental Rights and Freedoms of the Individual, section 70–83 (inclusive) (Chapter V). The provision was deemed “inoperative” in Kamau Kuria v. Attorney General, and this was upheld shortly thereafter in Maina Mbacha when the High Court found that no rules of procedure had been enacted to enforce the Bill of Rights and dismissed for lack of jurisdiction. Indeed, in the latter case the court dismissed the application for lack of jurisdiction even though the case was before the court by virtue of the constitutional grant of “original unlimited jurisdiction”. As a matter of established law, the court can be approached by any available procedure when ruling to enforce established constitutional rights. Ordinary rights can be defeated for failure to follow procedure, but historically, procedural requirements often defer to constitutionally granted rights. Once the Bill of Rights was enacted in the Constitution, its enforcement became supreme to all other law, including procedural rules, for the supremacy clause of the Kenya Constitution states: “… if any other law became inconsistent with this Constitution, this Constitution shall prevail and the other law shall to the extent of the inconsistency be void”

Through studying how to affect acoustic directivity with MATLAB software, it show that selection of a relatively larger surface of the transducer and a relatively closer transducer interval will be more preferable for directivity. While an array which possess more array element number and whose frequency of the drive signal can be as large as possible in a range, directivity will be more preferable. On the other hand, when the structure of the sound radiating surface of the transducer or array layout is symmetrical, the corresponding directivity pattern will be symmetrical. At a frequency of 10kHz, the individual rare earth magnetostrictive transducers its first point of the simulation carried out before the test. Sounding board with aluminum by the method used to improve the sound source diameter. With the sound plate diameter incrementing, the smaller the angle of the directivity. The beam width of the 3×3 array is about at 23kHz, and the directivity acute angle is about 10°, with a sounding board by the method used to improve their the diameter of the sound source, so as to realize the sound has directivity is feasible.

We have come to the human dimension in this discussion. It would, therefore, be useful for us to consider two different ways of approaching this. One is talking about people at arm's length, in the way we have been doing most of the day; to a certain extent we have had to do so, as social scientists or even as humanists. I am going to try the other approach, namely, to talk about a few individuals to see if there is anything there that might help us in understanding the nationality question. My subject is literature and language. First, I will cover literature as an instrument, as something of interest to social scientists; and then I will discuss certain important individuals. As far as the nationality question is concerned, the individual does matter, although, it seems, the Party places that aspect at the bottom of its list of nationality concerns deemed important.
