Developing a Copyright Curriculum for Nigerian Universities for the Creative Digital Space

Abstract This paper explores the significance of teaching and learning digital copyright laws within a reformed Nigerian copyright regime. It further analyzes how an experiential and clinical teaching pedagogy, developed as part of a copyright law curriculum, will become an agency to protect, safeguard, and impel the development of Nigerian creative industries, particularly the film sector. Nigeria is Africa’s largest economy and an emerging creative industrial power. The training and expertise of its legal professionals in the knowledge and creative economy have significant impact beyond Nigeria, across the length and breadth of the other African countries. The article sets out to provide a recipe for a functional approach to the development of a digital copyright curriculum in the law faculties of Nigerian universities as a pragmatic and industry-focused way of teaching while adding value to the creative industries. The paper further examines how the law faculties of Nigerian universities could redesign their copyright curriculum to teach not just theories but, more importantly, the wider policy framework. The paper also explores how to understand the practical, business and economic systems of the creative industries. The paper uses ‘Nollywood’, the contemporary Nigerian film industry, as a case study to continue the discussion on the sustainable development of the Nigerian creative industries.

A heightened interest in the notions of ‘creative cities, creative industries and creative economy’ has propelled research in these emerging areas of the New Economy. As an emerging area, some conceptual and methodological issues need to be addressed prior to adopting the creative city paradigm as part of the strategic and policy framework towards a creative economy. This paper presents a review of key conceptual and methodological issues that need to be considered when conducting research on creative cities in Malaysia. The conceptual and methodological issues relating to creative cities and creative industries should be addressed and dealt with in order to facilitate an enabling framework for contemporary research in this emerging area.

Thanks to the concerted effort of the international community to promote basic education, driven by the Education for All (EFA) goals and Millennium Development Goals (MDGs), indices of education in Africa have improved dramatically since the 1990s. Although the access to schooling has improved, there are still issues of quality related to teachers, facilities, teaching and learning materials, and relevance of educational contents. Recently, under the Sustainable Development Goals (SDGs), the focuses of educational policies of African countries have been diversified, to concentrate not only on quantitative and qualitative improvement of basic education, but also on secondary, tertiary, and technical and vocational education and training (TVET). One of the problems which critics point out is that, regardless of the massive expansion of basic education, learning outcomes of school leavers in Africa have not improved. It has also been remarked that school enrolment has not directly led to poverty-reduction or decent employment. Another side-effect of the expansion of basic education has been an increased dependency on aid. So, although there is a constant demand for higher and more education among the general public, aid-dependent expansion of the system is unsustainable. Before colonization by European powers, many groups in Africa had a tradition of oral transmission of knowledge, although there were some significant exceptions of societies which had formal educational institutions. With or without formal institutions, African traditional societies had their own mechanisms of transmitting knowledge across generations. However, Europeans overwrote such existing modes of education by introducing Western school systems. With the paternalistic conviction of their civilizing mission, they refined traditional cultures and practices which could be maintained and taught in school, while replacing other “barbarous superstitions” with teaching of European subjects. Resistance to such impositions of European education eventually led to nationalism, which accompanied the desire to find a uniquely African epistemology and teaching method. At the same time, the mechanism of recruiting African white-collar workers through schooling, which started during the colonial period, planted a strong hope for social advancement through gaining school certificates deeply in the mind of African people.

The article is devoted to solving the problems of ensuring sustainable development based on cultural and creative industries. The methodological basis of the research is a set of methods of scientific knowledge, general scientific and special research methods. The theoretical basis of the author’s statements regarding the concepts of “cultural” and “creative” industries is the fundamental research of Ukrainian and foreign scientists in the field of economic theory, regional economics and sustainable development of territories, sociology, strategic management of socio-economic development of regions. The author’s key conclusions regarding the category of “sustainable development” are based on studies of Ukrainian and European legal norms.Because of a historical digression, the article substantiates the expediency of separating the concepts of “cultural” and “creative” industries, since some represent a set of cultural practices that are carried out according to standards, and the second – involve the implementation of individual creative abilities. It is proposed to consider “cultural industries” in two fundamentally different aspects, which can be covered through cultural and economic approaches. It is proven that these industries are aimed not only at the production of products, they are also a tool for stimulating individuals to choose social forms of life, social behavior, and mutual understanding, rational consumption, etc. It is established that in modern science, the issue of distinguishing the types of cultural and creative industries is debatable, based on which the author’s structure of cultural and creative industries is developed, the core of which is the creative economy, and the external space is represented by the economic, environmental and social components of sustainable development. The author’s approach allows us to expand the scientific vision of the essence and content of cultural and creative industries, as well as to determine their role in ensuring sustainable development. The proposed interpretation of the structure will later be used in the development of a marketing strategy for cultural and creative industries, which contributes to the solution of the applied task of achieving the Sustainable Development Goals. Abstract Background The Sustainable Development Goals (SDGs) and universal design (UD) principles call for inclusive planning. Within the transportation field, this includes the development or improvement of facilities that accommodate people with disabilities. Between 10% and 20% of the African population is affected by disabilities. A lack of understanding of the needs of people with disabilities leads to isolation. Within the transportation field, isolation manifests itself as a reduction in trip-making. Methods This paper investigates the availability of transport policies and guidelines in 29 different African countries, focusing on the inclusion of persons with disabilities. A desktop study was conducted creating heat maps for 29 African countries, followed by the analysis of secondary data in the case study area, South Africa, demonstrating that the lack of adequate policies, guidelines, and appropriate implementation leads to a lack of accessibility, opportunities, and social isolation, measured through trip frequencies. Results The data analysed revealed that many African countries omit, or only superficially include, people with disabilities in their transport policy framework. Ghana has the most inclusive People with Disabilities Act, while South Africa is most inclusive regarding their planning and design of transport facilities and services. In South Africa, 4.5% of the population did not travel at all in the 7 days before the interview, as disability or age prevented them from doing so, or due to a lack of appropriate travel services. When comparing the trip rates per week, people with disabilities travel significantly less, between 27.2% and 65.8%, than their abled counterparts. Conclusions The study reveals that people with disability live less integrated, more isolated lives due to the lack of acknowledgement in the transport policy framework and accommodation in infrastructure and services. The results underpin the need for disability-inclusive planning in the African context and provide recommendations for actions that mitigate the isolation challenges faced by people with disabilities. Municipalities play a crucial role in improving the quality of life for people with disabilities.

The author demonstrates that modern concepts of cultural heritage preservation focus on increasing the efficiency of its use and that building creative potential and systematic support of the creative industries are becoming a key task of the strategic development of regions and municipalities in the post-industrial era.

Economic growth of countries is one of the fundamental questions in economics. Most African countries are opening their economies for welcoming of foreign investors. As such Ethiopia, like many African countries took measures to attract and improve foreign direct investment. The purpose of this study is to examine the contribution of foreign direct investment (FDI) for economic growth of Ethiopia over the period of 1981-2013. The study shows an overview of Ethiopian economy and investment environment by the help of descriptive and econometric methods of analysis to establish empirical investigation for the contribution of FDI on Ethiopian economy. OLS method of time series analysis is employed to analyse the data. The stationary of the variables have been checked by using Augmented Dickey Fuller (ADF) Unit Root test and hence they are stationery at first difference. The co- integration test also shows that there is a long run relationship between the dependent and independent variables. Accordingly, the finding of the study shows that FDI, GDP per capita, exchange rate, total investment as percentage of GDP, inflow of FDI stock, trade as percentage of GDP, annual growth rate of GDP and liberalization of the economy have positive impact on Ethiopian GDP. Whereas Gross fixed domestic investment, inflows of FDI and Gross capital formation influence economic growth of Ethiopia negatively. This finding suggests that there should be better policy framework to attract and improve the volume of FDI through creating conducive environment for investment.

That National Human Rights Institutions (NHRIs) play an important role in the protection and promotion of human rights is a well-known fact. This has been widely acknowledged by the United Nations (UN). Also well-known is the fact that several African countries have enacted new constitutions during the last two to three decades. One of the most salient features of those new constitutions is that they establish NHRIs, among other things. Given their unique role and mandate, these NHRIs can and do play an important role in the realisation of the sustainable development goals contained in the UN 2030 Agenda for Sustainable Development. Adopting a case study approach, this article explores the role NHRIs have played in the promotion and protection of human rights in selected African countries and implications for sustainable development in those countries. The main argument is that there are several lessons African countries can learn from each other on how their NHRIs can more meaningfully play that role. Accordingly, best practice and comparative lessons are identified and it is recommended that NHRIs can contribute to sustainable development more meaningfully if they can make themselves more relevant, credible, legitimate, efficient and effective.

This chapter examines the proper role of intellectual property rights (IPRs) in achieving access to modern energy services in Africa as part of a broader objective of a pro-development intellectual property agenda for African countries. It discusses the role of intellectual property rights, particularly patents, in consonance with pertinent development questions in Africa connected with the implementation of intellectual property standards, which do not wholly assume that innovation in Africa is dependent on strong intellectual property systems. The chapter examines how existing intellectual property legal landscapes in Africa enhance or impede access to modern energy, and how the law can be directed towards improved energy access in African countries. While suggesting that IPRs could serve an important role in achieving modern energy access, the chapter calls for circumspection in applying IP laws in order not to inhibit access to useful technologies for achieving access to modern energy services.
