This chapter explores shifting patterns of intelligence surveillance in the United States. The Fourth Amendment protects Americans from unreasonable search and seizure without a warrant, but foreign spying is subject to few constraints. During the Cold War, surveillance power was abused for political purposes. Operating in a culture of secrecy, American intelligence agencies engaged in extensive illegal domestic spying. The intelligence scandals of the 1970s revealed these abuses, prompting new laws, notably the Foreign Intelligence Surveillance Act. Fearing further recrimination, the national security establishment increasingly demanded legal cover. After 9/11, Congress expanded lawful surveillance powers with the PATRIOT Act. Meanwhile, the Bush administration directed the National Security Agency to conduct warrantless domestic wiretapping. To justify this program, officials sought to redefine unconstrained foreign surveillance to subsume previously protected communications. The Obama administration continued to authorize mass surveillance and data mining programs and legally rationalize bulk collection of Americans’ data.

A key criticism that has emerged in the debate over the search and seizure exclusionary rule is that it exacts heavy societal costs in the form of lost prosecutions and that such costs outweigh any demonstrated social benefits. This article examines the costs of three exclusionary rules using data collected for 7,500 cases in a nine-county study of criminal courts in three states. It emphasizes motions to suppress physical evidence but for comparative purposes also includes motions to suppress confessions and identifications. The results show that the various exclusionary rules exact only marginal social costs. Motions to suppress physical evidence are filed in fewer than 5% of the cases, largely drug and weapons cases, while serious motions to suppress identifications and confessions are filed in 2% and 4% of the cases. The success rate of motions to suppress is equally marginal. Successful motions to suppress physical evidence occur in only 0.69% of the cases, while successful motions to suppress identifications or confessions occur much less often. Moreover, not all who successfully suppressed evidence escaped conviction, especially when only an identification or a confession was suppressed. In all, only 46 cases—less than 0.6% of the cases studied—were lost because of the three exclusionary rules combined, most of them involving offenses that would have incurred less than six months’ imprisonment or first offenders. Finally, the impact of unsuccessful motions on subsequent plea bargaining was found to be marginal; only unsuccessful motions to exclude confessions resulted in any real sentencing concessions.

Dwelling (also a residence, a residence) is a self-contained accommodation unit used by one or more households as a home; such as a house, apartment, mobile home, household, vehicle, other "substantial" structure. The concept of residence has significance in relation to search and seizure, transport of real property, theft, offenses, and land use planning. In a city like Jakarta, with dense infrastructure, wide economic disparities and a tense social composition, increasing green space should be a top priority. However, residents of the capital Jakarta can reiterate that this is not the case. That in fact lacks a conspicuous park, playground and public park in the capital. The urban design concept deals with the integration of land use, movement and traffic management and the form of the built environment.Its aim is to provide urban high-quality places that are efficient, functional and attractive, and can respond to changing societal, environmental and economic needs over time. In designing it also contributes to, and bridges between planning and design. It deals with the surrounding environment by paying attention to the context of the building and space rather than the object itself. Then it requires access to green infrastructure, open space areas and green spaces, which will contribute to a greener, healthier, smarter, safer, livelier, richer and fairer. This guide will assist in assessing and demonstrating progress in improving green infrastructure to create a place that is useful, sustainable and well used. Dalam mendisain juga berkontribusi, dan menjembatani antara perencanaan dan perancangan. Ini berhubungan dengan lingkungan sekitar dengan memperhatikan konteks bangunan dan ruang daripada objeknya sendiri.
