Risk assessment and risk reduction have become increasingly central to criminal justice policy and practice in the last 25 years. Yet there remains a lack of consensus both on the theoretical and methodological foundations of risk and on its social and practical implications. Some proponents see risk assessment and reduction as solutions to the inefficiencies and injustices of contemporary mass incarceration. Some critics see actuarial risk as being partially responsible for mass incarceration, and warn that recent iterations will only reinscribe existing inequalities under a new guise of objectivity. Both perspectives contain elements of truth, but each falls short because neither adequately specifies the different dimensions of risk that condition its effects. Using two prominent frameworks as foils, this article excavates the contested terrain of risk assessment and exposes a set of distinctions that can inform the use—and prevent the abuse—of risk knowledge in criminal justice policy.

PurposeThis paper has a twofold purpose: (1) to demonstrate, largely with historical evidence, that, contrary to what some have argued, thinking about educational research articulated at the start of the twenty-first century was not really “new wine in new bottles” but, rather, a continuation of the so-called paradigm wars about, ultimately, unresolvable methodological and epistemological issues that occurred during the twentieth century; (2) to suggest a way members of the educational administration field might transcend, or at least circumvent, time-consuming and distracting battles about unresolvable methodological and epistemological issues in the future while keeping their focus on issues of practice.Design/methodology/approachThis is a quasi-historical essay that uses influential literature during the historical periods focused on as evidence to support the essay's arguments.FindingsThe paper demonstrates that twentieth century philosophical disagreements about research methods and the role that educational research can play in policy and practice decision making were not resolved but, rather, were largely reenacted during the first decade of the twenty-first century, again without a resolution. The paper proposes a way that administrators, policymakers and researchers can manage this situation and still use research to make policy and practice decisions.Practical implicationsThe paper suggests a new role for both school administrators and policymakers to play. If administrators/policymakers play this role successfully, all types of research can inform decision making about policy and practice, and researchers can concentrate on doing their research rather than engaging in unresolvable philosophical disputes.Originality/valueAlthough a great deal has been written about the twentieth century's theory movement and paradigm wars and the twenty-first century's so-called science wars, the link between these phenomena has not been discussed in the literature. In addition, there have been few attempts to articulate an operational strategy for managing unresolvable philosophical disputes about research methods and the role that research can play in decision making. This paper tackles both matters.

The first part of the twenty-first century has been marked by particularly fraught social and racial tensions in the United States, brought to awareness internationally by the Black Lives Matter protest movement that started in 2014 and the vitriol espoused by the 2016 Republican presidential candidate. Randy Martin's work offers paradigms for interrogating the relationships between dance and its sociopolitical contexts that are highly relevant at this historical juncture. Drawing on some of Martin's key concepts, this article explores choreographic agency and creative strategies in dances that respond to issues of social injustice, mass incarceration, and racial disparities in the criminal justice system. Works by Joanna Haigood (Zaccho Dance Theatre), Amie S. Dowling, filmmaker Justin Forbord, and Kyle Abraham (Abraham.In.Motion) focus on narratives of oppression and disenfranchisement yet also inspire resistance and hope.

Abstract There is growing international interest in translating Stark’s concept of coercive control into criminal justice policy and practice. In December 2015 an offence of coercive control was introduced in England and Wales. This paper offers an empirical investigation of the problems and possibilities associated with the translation of this offence into practice in one police force area in England. The findings offer some scope for optimism in response to patterns of abuse, but they also support the view that the current gender-neutral version of the legislation requires revision; there is a need for greater resourcing and training to improve understandings of the nature and impact of coercive control at all points of contact within the criminal justice process and finally, it remains the case that effective responses to domestic abuse need to be genuinely holistic.
