Abstract“Social justice” is a powerful idea today, but its origins and meaning are unclear. One of the first to use the term was Antonio Rosmini, author of The Constitution under Social Justice (1848) and other works of moral philosophy. I argue that Rosmini arrived at his idea of social justice by developing Thomistic natural law theory into a novel view of the common good that balances two principles: (1) the equal rights and dignity of persons as ends-in-themselves, a version of “personalism” influenced by Kant and Christianity; and (2) unequal rewards for those who contribute most to society, a version of Aristotelian “proportionalism” based on the social nature of man. I conclude by comparing Rosmini's idea of social justice to John Rawls's “theory of justice” and Catholic social teaching.

Masudul  Alam Choudhury agrees that fundamental thinking to construct a new knowledge base is needed when scientific and social conditions tend to be closed and monopolistic. The construction is expected to be able to dismantle the structural veil to find an alternative foundation and format that can be expected to realize social justice. For this reason, law, economics, and social paradigm can be effective instruments. In contrast to Choudhury, Karl Marx emphasized the existence of a new, rational-material awareness that dimensioned an economic struggle based on class consciousness, historical dialectics and materialism as the choice of objectives above. This awareness can be grown contextually, by moving the oppressed to demand equality. So the legal, economic and political foundations can change. While Choudhury focuses more on the transcendental dimension of the divine (tauhid paradigm) which is interpreted comprehensively and totally to dismantle the legal, economic and social order. Thus, the legal, economic and political infrastructure rests on fairness and productivity that remains competitive. The values that are in the divine foundation are arranged in the building of law and ethics (morals) to be integrated into the institution towards the desired reconstruction. However, Choudhury’s ideas remain normative and fail to be translated. It is too utopian.

The natural law is a overempiric law that does not owe his dignity to the legal norm than to the intrinsic qualities of a human being. This paper presents a different hierarchical position of the natural law in the critics of capitalism from K. Marx to our days and its different intonation as a superpositive framework of justice. One should analytically differentiate between (1) theoretical search for social justice in the philosophy of the natural law (K.Marx, M.Weber, G.Radbruch, L.Strauss, E.Bloch, Lj.Tadic) and (2) empirical identification of power relations that allowed or hindered social justice in the reality. The paper provides analysis of historically different relationships between positive and radical natural law in both the compressed 20th century epochal conscience and today?s neoliberal one. In addition, it compares role of the natural law in capitalism and socialism and differentiates between social justice from above and social justice from below. The first one is gratuitous, paternalistic and limited, the second one is radical and has to be conquered. Radical natural law should express itself as a fully developed social justice liberated from capitalism. Critic of social unjustice from the viewpoint of natural law has no practical effects in our days, and in spite of it, it is not anachronistic.

The failure of economic capitalism system stated by Adam Smith (1723-1790) and David Ricardo (1772-1823) actually have been criticized by Karl Marx (1818-1883) in his book "A Contribution to the Critique of Political Economy" (1857) and "A Contribution to the Critique of Political Economy" (1859). Karl Marx and Engels compile a new synthesis of economic socialist system. Stranger enough, socialism particularly as economic ideology is destroyed earlier than Capitalism. Meanwhile, capitalism still survives by transforming performance. For examples, at the time of the glory of Socialism age, capitalism was transformed into socialism state with social justice and welfare state concepts, and when Islam began to rise, it was transformed into new performance as if it has characteristic of Islam, but in fact it is still capitalism. This writing tries to criticize both of them by Islamic economic perspective.

Discorre-se assim sobre ferramentas políticas e de gestão existentes, mas também, e principalmente, de outras possibilidades que remetem a “um impossível possível”, nos termos de Henri Lefebvre. Abstract Most musicians, in their songs, portray their philosophical vision of life as could be seen in the case of Lucky Philip Dube, the black South African reggae musician. His songs show that he adheres to the principle of ethical humanism and portrays him as a crusader of social justice. Thus, this essay shows the link between musical art and law by examining the commitment of Dube’s lyrical composition in fighting for a just legal system in his society. This essay therefore, analyses some of his lyrical productions in order to expound on the philosophical ideas underneath the songs and how they tie with the search of an alternative jurisprudence and humanism in postcolonial discourse and the liberation of the subaltern. From the perspective of natural law theory, this essay postulates that Dube’s songs criticise the injustice of the legal philosophy in his society and quest for an impartial jurisprudence – that of equality and justice in his society.
