Hermeneutic or interpretive inquiry is a living tradition of interpretation with a rich legacy of theory, philosophy, and practice. This paper is not intended to be a treatise on the right way to view and practice this tradition, but an exploration of the legacies that inform the philosophy of practice as the author has taken it up. In this explication, the author examines the ancestral, philosophical, and methodological histories that inform a current practice of hermeneutic inquiry.

The academic/scientific publication in Open Access is already a current practice with several advantages, and the trend is that it will continue to be adopted worldwide by academics and researchers to disseminate the results of their work among the scientific community and the public at large. At a time when Open Access is not only unavoidable but tends to become generalised as a form of scientific publication, this paper seeks to put forth, discuss and analyse some emerging issues, which are directly related to the financing of the publication of scientific research in Open Access, and which are directly linked to the consequences for academic freedom and the impact of the dissemination of the scientific publication, as current questions that shape the scientific publication that we will have and wish. The results of this analysis allow concluding that, for this new way of publishing science to grow in a sustained way, it is necessary to ensure, among other aspects, the existence of independent scientific advisory boards; freedom of publication within certain boundaries; a sustainability strategy to plan for the operation of the platform; transparency in public scrutiny; and respect for the law.

This article reports on the results of action research conducted in a university ESP classroom in Oman. The impetus for this research was the practitioner’s dissatisfaction with the current practice of introducing the grammatical concept of the English passive and its subsequent results. Framed within the sociocultural theory of cognitive development, this paper investigates the effectiveness of concept-based instruction (CBI). As a pedagogical approach, CBI targets a learner’s internalization of the concept of a language constituent that assists the learner with the meaning making abilities of sentences where the English passive is used. Twenty-two university students enrolled in an ESP course participated in the study. The data was collected through the teacher’s observations, students’ artifacts, and students’ feedback on the effectiveness of CBI. Data analysis reveals the effectiveness of CBI in heightening learner awareness of the concept of a language constituent, developing learner knowledge of the English passive, and improving their meaning-making abilities at the phrasal and sentential levels.

Este artículo busca demostrar que existen otras formas de acceso a la justicia para consagrar el derecho a la salud, y que el fenómeno de la desjudicialización es una excelente alternativa para que las personas ejerzan sus derechos con total seguridad jurídica. Es el ejercicio del derecho a favor de la vida. Prueba de ello son los resultados positivos logrados al mediar conflictos en lugar de presentar una demanda, así como al instrumentalizar varios actos legales en notarios extrajudiciales y cámaras privadas de conciliación y mediación. La metodología utilizada fue la investigación bibliográfica de autores de renombre que comenzaron a desarrollar formas de resolución de disputas, sin la necesidad de activar el poder judicial, se realizó una investigación exploratoria en doctrina y legislación, utilizando el método deductivo. La investigación es extremadamente importante porque analiza un tema actual, que tiene repercusiones en las esferas legal y social.   Esse artigo busca demonstrar que existem outras formas de acesso à justiça para consagrar o direito à saúde, e que o fenômeno da desjudicialização é uma excelente alternativa para que o indivíduo exerça seus direitos com plena segurança jurídica. É o exercício do direito em favor da vida. Prova disso são os resultados positivos alcançados com a mediação de conflitos, em vez do ajuizamento de uma demanda judicial, e como com a instrumentalização de diversos atos jurídicos nos cartórios extrajudiciais e nas Câmaras Privadas de Conciliação e Medição. A metodologia utilizada foi a pesquisa bibliográfica de renomados autores que passaram a desenvolver formas de solução de litígios, sem a necessidade de se acionar o Poder Judiciário, realizou-se pesquisa de cunho exploratório em doutrina e legislação, valendo-se do método dedutivo. A pesquisa é de suma importância porque analisa um tema atual, que repercute nos âmbitos jurídicos e sociais.   This article seeks to demonstrate that there are other forms of access to justice to consecrate the right to health, and that the phenomenon of dejudicialization is an excellent alternative for individuals to exercise their rights with full legal certainty. It is the exercise of law in favor of life. Proof of this is the positive results achieved by mediating conflicts rather than filing a lawsuit, as well as by instrumentalizing various legal acts in extrajudicial notaries and private conciliation and metering chambers. The methodology used was the bibliographic research of renowned authors who began to develop forms of dispute resolution, without the need to trigger the judiciary, was conducted exploratory research in doctrine and legislation, using the deductive method. The research is extremely important because it analyzes a current theme, which has repercussions in the legal and social spheres.

Global theorem of existence and uniqueness of solution of the first boundary value problem for nonlinear integrodifferential equation of parabolic type is proved. If the right-hand side of the equation is integrally bounded, then we have estimate of the norm of the difference of two solutions, which implies continuous dependence of solution on the initial function and uniqueness of so- lution of the first boundary value problem. The problem under consideration generalizes the real model for measuring the level of incompressible fluid in the fuel tanks missiles. Therefore, such problem have a current application.

While UN treaty bodies have sought to address forms of oppression resulting from the intersection of gender, race and/or disability through their practice, they rarely recognise the experience of groups at the intersection of other social categories. This article uses the lens of intersectionality to analyse the practice of UN treaty bodies in relation to the intersection of minority and refugee status. We argue that while minority-refugees have fled persecution connected to their minority status, UN treaty bodies have failed to appreciate the impact of their location at the intersection of persons belonging to minorities and refugees in host States on their right to preserve their cultural identity. By failing to address the distinct experience of minority-refugees, UN treaty bodies risk participating in their oppression. Further, we reveal that current practice not only has potentially negative consequences for minority-refugees – as both individuals and groups – and for the host society but may even undermine the ability of IHRL to achieve its overarching objectives.

Getting at the tacit understandings of an artful practice is critical in coming to understand the processes of creativity. To achieve this, the researcher, specifically the ethnographer, must place herself in the position of the maker, that is she must herself, make and create. This article provides an account of arriving at the methodological imperative of in situ ethnographic research through actual ethnographic research on the relation of maker and material. From an in situ position, it theorizes the modalities of expression in practice, from problem-solving, to personal style, to the intentional drawing in of embodied histories in practice. This incorporation of varying embodied histories into a current practice is then explored as the possibility for affecting what is recognized in the field as ”new” or ”innovative”. We will see, however, that is affect is grounded more in the corporeal revealing of unexpected aspects of the material worked up.
