RECOVERY OF UNDUE BENEFITS IN THE SOCIAL INSURANCE SCHEME — SELECTED ISSUESThe article refers to the selected issues of the recovery of undue benefits in the social insurance scheme. Initially, the subject matter of the analysis is the recent modification of the art. 84 of the Act of 13 October 1998 on the social insurance system. It is argued in the article that there are not per­suasive arguments why the recent change — introducing the limit for handing down adecision for the Polish Social Insurance Institution art. 84 [7a] of the Act on the social insurance system — does not relate to the contribution payer or the other persons enumerated in the art. 84 6 of the Act on the social insurance system. Furthermore, the paper analyses the notion of the undue benefit in the social insurance scheme and the issues of the instruction. In the article there are emphasized some questions referring to the explanatory proceedings conducted by the Polish Social Insurance Insti­tution ZUS and the issues of the relations between the art. 84 1 and 6 of the Act on the social insurance system. In the conclusion the article analyses the relations between the art. 84 of the Act on the social insurance system and the special regulations, i.e. art. 138 of the Act of 17 December 1998 on pensions from the Social Insurance Fund and art. 66 of the Act of 25 June 1999 on cash social insurance benefits in respect of sickness and maternity.

The main purpose of this paper is to examine the farmers’ opinion on the functioning of their dedicated social insurance system. Particular attention was also paid to the development of different forms of social insurance and to the functioning of the Farmers’ Social Insurance Fund (Polish acronym: KRUS). The analysis was based on a literature review and a survey conducted with 114 farmers registered in KRUS offices located in Działdowo, Iława and Ostróda, with assistance from the Olsztyn Regional Branch. The data collected enables an objective assessment of the entire social insurance system and reflects the farmers’ views on the system and its reforms. The research shows that the accident insurance, health insurance and maternity insurance schemes work very well (41%) or well (34%) according to the farmers concerned. The respondents also expressed their satisfaction with activities undertaken by KRUS, especially in the social field (61%).

The paper presents an initial concept of an integrated public social insurance system in Poland. The first part presents a diagnosis of the financial basis for the functioning of this system in the years 1991–2018. In the second part of the paper the diagnosis gives an indication of the directions for further development of this system, allowing it to become an integrated system, the financing of which does not negatively impact the functioning of the Polish economy and prevents the collapse of the public finances of the state. The aim of the paper is to define the financial foundations of an integrated social insurance system in Poland. The basic assumption of the study was the need to improve the financial efficiency of the public social security system through systemic and parametric reconstruction. The research tool used for the diagnosis was the analysis of documents (legal acts in the field of social insurance and financial statements of the Social Insurance Fund (FUS)). The research tool used for the diagnosis was the financial efficiency indicators relevant to the purposes of the analysis. The main conclusion of the study is that a parametric and systemic reconstruction of the Polish social insurance system is possible, which should lead to a balance of revenues and expenses in the Social Insurance Fund.

The subject of this article was the issues related to the protection of the rights of citizens in the field of compulsory social insurance in the conditions of digitalization. It is shown that in order to ensure effective and safe conditions for the use of digital technologies, it is necessary to include universal basic approaches in the legal regulation. Specific examples of how the tasks of digitalization of social services in the field of social security are currently actively implemented by the social insurance Fund of the Russian Federation are given. Social insurance as a system of guaranteeing material support in case of occurrence of insured cases undergoes the process of reforming, the State uses a variety of methods of influence, including achievements of scientific-technological progress. Social security funds were created to provide citizens with a full range of services that provide a decent life. The article is aimed at analyzing the opportunities of social security funds to provide electronic services. The latest changes in the reform of the social insurance system of Ukraine are illuminated. The functions performed by these establishments are considered in order to understand their essence. The concept of «e-government» is described and it is defined that its application influences the improvement of effectiveness of the government policy. The analysis of services of the Pension fund of Ukraine, the Social insurance fund and the Social insurance fund in case of unemployment was carried out. The largest number of electronic services is now provided by the Pension fund of Ukraine, which successfully implements e-government. The Social security fund does not yet provide the opportunity to receive services remotely. The Social security fund in case of unemployment in the aspect of e-government focuses on the employment services of citizens. Recommendations for further development of the social insurance system using electronic services are provided.

The presented research reveals the main directions of development of the social insurance system in Russia. The relevance of the study is caused by the modern challenges that have arisen in connection with the COVID‑19 pandemic, demonstrating the crucial role of social programs in ensuring the sustainability of countries. The subject of the research is the main factors affecting the development of the social insurance system. International experience shows that the development of private social insurance is a promising direction for the development of social insurance. The research reveals the main structural elements that should be formulated in the strategy for the development of the social insurance system in Russia.

The article deals with the issues of functioning of the social insurance institution, the organizational-legal and financial forms of which are presented by the state extrabudgetary social funds - Pension Fund of Russia, Mandatory Social Insurance Fund and Mandatory Health Insurance Fund. It considers the main characteristics of social insurance: a) scope of covering the employed population by insurance protection; b) contribution rates as related to wages; c) level of protection of population incomes (pensions and benefits as related to wages and subsistence minimum); d) availability of quality medical assistance and rehabilitation services. There are analyzed the present social risks and problems of the RF insurance system. The main problem is that the amount of financial expenditures on all types of social insurance per beneficiary is about half that of most developed and developing countries. The primary cause is lacking motivation of both employees and employers to participate in the mandatory social insurance and to legalize their earnings. In the conclusion there are formulated a number of proposals for improvement of the institution of social insurance in Russia. It is proposed to expand the range of insurance cases concerning unemployment insurance and care for elderly people, to increase the total amount of compulsory contributions to extrabudgetary insurance funds from 30.2% up to 42.5% from three sources - employees, employers and the state.

The article discusses the controversial issues of compensation for physical harm caused to an employee. The article analyzes the possibility of satisfying the claim for compensation of such expenses, presented directly to the harmer, provided that the insurance coverage is obtained at the expense of the Social Insurance Fund. The conclusion is made about the possibility of such a claim. At the same time, the conditions for its satisfaction are determined, including the victim»s need for such expenses, taking into account the right to choose a doctor and a medical organization, in the absence of signs of abuse of the right.
