Intellectual Property Rights is granted the exclusive rights to creators, inventors or designers for the creation or invention that has commercial value, either directly or through the automatic registration of the relevant agencies as awards, recognition should be given the protection of the rights of the community development law. Globally, the IPR will be used as collateral to obtain a bank loan internasional. In this law is necessary to realize the concept of legislation in each country who are willing to apply that regulate substance loading, binding, and registration of intellectual property as collateral. Key words: development of intellectual property rights, collateral, bank credit in Indonesia

Abstrak: Di Indonesia saat ini sedang berkembang pemikiran tentang penerapan prinsip syariah dalam bidang-bidang perekonomian, termasuk dalam hal perlindungan Hak Kekayaan Intelektual (HKI). Pemikiran tersebut berbeda dengan “pemikiran barat” yang menjadi dasar dibentuknya undang-undang terkait perlindungan HKI yang sudah ada di Indonesia. Rumusan konsep perlindungan HKI syariah adalah sebuah konsep hasil penggabungan fungsi beberapa pranata hukum yang ada. Hal tersebut memungkinkan rumusan konsep perlindungan HKI syariah ini dapat segera diterapkan di Indonesia dan tetap menjadi bagian dari sistem hukum nasional dan sekaligus menjadi bagian dari tradisi hukum yang ada di dunia. Kata kunci: Perlindungan HKI syariah, konsep, implementasi.  Abstract: In Indonesia, the idea of applying the sharia principles in economy fields is currently developing, including the protection of Intellectual Property Rights (IPR). This idea is substantially different from the "western thought" which became the basis of the law establishment regarding the protection of Intellectual Property Rights in Indonesia. The formulation of the concept of sharia IPR protection is a concept of the result of merging some functions of the existing legal order. It allows the formulation of the concept of IPR protection sharia to be immediately applied in Indonesia and remains a part of the national legal system and also become part  of the legal tradition in the world. Key words : Sharia IPR Protection, concept, implementation.

Intellectual Property Rights is related to the protection of the application of ideas and information that has commercial value, For owners of ideas and information that has commercial value, Intellectual Property Rights is a personal wealth that can be owned and treated as same as other forms of wealth. That same treatment is like reselling or renting it. So that ideas and information that has commercial value is not used by another person who is not responsible, then there must be protection from a legal perspective. This paper briefly discusses about the two cat- egories that are protected under intellectual property rights, namely copyrights and patents. On the other side, this paper aims to provide an understanding of the legal aspects of copyright and patent registration.

Intellectual Property Rights relate to the protection of the application of ideas and information that have commercial value. For owners of ideas and information that have commercial values, Intellectual Property Rights are personal property that can be owned and treated with other forms of wealth. The same treatment is like trading or renting it out. So that ideas and information that have commercial value are not used by others irresponsibly, then there must be legal protection. This paper briefly discusses two categories that are protected in Intellectual Property Rights, which are copyright and patent. The goal of this study is to develop the legal status of brand rights as collateral for bank credit guarantees and to analyze the risks of applying brand rights as collateral for bank credit guarantees in Indonesia. Brand rights are part of intellectual property rights which, of course, are of commercial significance to be used as collateral for bank loans. This study is a normative legal research using a regulatory methodology or a legislative approach to interpreting the idea of brand rights being used as security for bank loan guarantees, as laid down in statutory regulations, which are meant to try to get closer to the problems examined on the basis of laws, norms and rules. In compliance with the purpose of the analysis. The findings of the research suggest that Brand Rights can potentially be used as collateral for bank credit guarantees in compliance with the relevant legal requirements, but there are no specific laws and regulations that explicitly govern brands used as collateral for bank credit and, as a result, many banks in Indonesia have not been able to consider brands as collateral for bank credit guarantees.

Batik artwork is one of the treasures of the nation's cultural heritage. Batik artwork is currently experiencing rapid growth. The amount of interest and market demand for this art resulted batik artwork became one of the commodities in the country and abroad. Thus, if the batik artwork is not protected then the future can be assured of a new conflict arises in the realm of intellectual property law. Act No. 28 of 2014 on Copyright has accommodated artwork batik as one of the creations that are protected by law. So that this work of art than as a cultural heritage also have economic value for its creator. Then how the legal protection of the batik artwork yaang not registered? Does this also can be protected? While in the registration of intellectual property rights is a necessity so that it has the force of law to the work produced
