A relação entre Direito e desastres: uma análise a partir da apelação cível nº 0026225-19.2005.8.19.0021 do Tribunal de Justiça do Estado do Rio de JaneiroThe relation between law and disasters: an analysis from the civil appeal no. 0026225-19.2005.8.19.0021 of Rio de Janeiro State Court Carlos Eduardo Silva e Souza[1]Victor Lucas Alvim[2] RESUMO: O presente trabalho objetiva investigar a relação entre o Direito e os desastres, tendo, como parâmetro de análise, os termos do acórdão proferido na Apelação Cível nº 0025225-19.2005.8.19.0021, que foi prolatado pelo Tribunal de Justiça do Estado do Rio de Janeiro. A problemática central está focada na percepção da existência ou não de uma relação entre a aludida ciência e o mencionado fenômeno e qual as ilações que poderiam ser tiradas dessa constatação. Nesse sentido, o trabalho é construído em quatro partes. A primeira dedica a apresentar o caso em análise, de forma a viabilizar a compreensão do acórdão eleito para o início da investigação apresentada. A segunda, por sua vez, volta-se para verificar a proteção jurídica contra os desastres, focando-se a análise, sobretudo, na realidade jurídico-normativa da legislação brasileira. A terceira parte do trabalho dirige a atenção para a compreensão da tutela ambiental preventiva, a partir da gestão de riscos e perigos catastróficos. A quarta e última parte é dedicada para a compreensão da tutela ambiental reparadora e, de forma mais específica, para a responsabilidade civil em matéria catastrófica. A investigação valeu-se da pesquisa bibliográfica e documental, tendo ainda se servido do método de abordagem qualitativo de análise de dados. PALAVRAS-CHAVE: Direito. Desastre. Catástrofe. Ambiente. Responsabilidade Civil. ABSTRACT: This study aims to investigate the relation between law and disasters, having as analysis parameter the terms of the judgment delivered in the Civil Appeal No. 0025225-19.2005.8.19.0021, which was rendered by the Rio de Janeiro State Court. The main question is focused on the perception of whether or not there is a relation between the alluded science and the mentioned phenomenon, and what are the conclusions that could be drawn from this finding. In this sense, the work is constructed in four parts. The first is dedicated to present the case in question, in order to facilitate the understanding of the judgment elected to start the presented research. The second, in turn, turns to verify the legal protection against disasters, focusing the analysis, especially, on the legal-normative reality of the Brazilian Law. The third part of the work directs attention to the understanding of the preventive environmental protection based on risk and catastrophic dangers management. The fourth and final part is devoted to the understanding of restorative environmental protection and, more specifically, to the civil liability for catastrophic matter. "Restingas" (herbaceous/shrubby coastal sand-dune habitats) used to cover most of Rio de Janeiro State coast, and have suffered extensive degradation over the last five centuries. Using satellite images and field work, we identified the remaining restingas in the State, recording the factors that might cause their degradation. We used two mosaics of Landsat 7 scenes (spatial resolution 15 and 30 m) to map and evaluate preliminarly the remaining areas and conservation status. Each remnant area was checked in the field, degraded areas within it were mapped and subtracted from the remnants. We identified 21 restinga remnants totalling 105,285 ha. The largest and smallest restinga remnants were Jurubatiba (25,141 ha) and Itaipu (23 ha), respectively. We identified 14 causes of degradation. The most important were vegetation removal for housing developments, establishment of exotic plant species, change of original substrate, and selective removal of species of economic importance for the horticultural industry. All restingas had disturbed parts under strong pressure due to human activities. Due to intense habitat loss, and occurrence of endemic/threatened vertebrate species in restinga habitats, we strongly indicate the implementation of new conservation units to protect these fragile remnants. This habitat is steadily decreasing and most remnants lack legal protection. Therefore, under the current human pressure most of this unique habitat is likely to be lost from the State within the next few years.

The article presents an analysis of the concept and methods of civil protection of rights to the means of individualization. The study provided grounds to identify common features of liability and protection measures: aimed at their impact on the offender; aim to protect the rights and interests of the victim; can be implemented both voluntarily and compulsorily; directly enshrined in law; have a retrospective character; can be used alone or in combination. Distinctive features are also available. The following criteria are defined: the first criterion is the presence of non-equivalent property deprivations in civil liability; the second criterion: invariability of protection measures and variability of liability measures; the third criterion is the temporal (temporal) criterion; the fourth criterion for distinguishing between liability and protection measures are the forms of their implementation. In this contribution six new species of Poeciloderrhis Stål, 1874 are described: P.aureolatus sp. nov. (Holotype male in MNRJ: Brazil, Rio de Janeiro State), P.mediansclerostylatus sp. nov. (Holotype male in MNRJ: Brazil, Rio de Janeiro State), P.diamantinensis sp. nov. (Holotype male in MNRJ: Brazil, Mato Grosso State), P.itatiaiensis sp. nov. (Holotype male in MNRJ: Brazil, Rio de Janeiro State), P.vanzolinii sp. nov. (Holotype male in MNRJ: Brazil, Rio de Janeiro State), and P.penduloides sp. nov. (Holotype male in MNRJ: Brazil, Rio de Janeiro State). The genus is recorded for the first time from the state of Rondônia, Brazil based on P.diamantinensis sp. nov. A new combination is proposed for Poeciloderrhisbicolorata Rocha e Silva & Lopes, 1977 that is transferred to Epilampra Burmeister, 1838. For specific delimation, the tergal modification in the abdomen, the genital plates and their respective structures were analyzed. A key for males including all species of Poeciloderrhis is also given.

Abstract. This paper presents some current results of the research, which proposes a virtual recreation of Reynaldo Dierberger original project for the Seropédica campus of UFRRJ, located in Rio de Janeiro State, Brazil. The gardens, as well as the original architectural ensemble, in neocolonial style, have been legally protected in 2001. The group of researchers faced a triple challenge to make the virtual recreation. The first one concerns the identification of what was designed and not built, based on original hand-made drawings filed in the Document Conservation Laboratory of UFRRJ (LabDOC) and other university departments. The second challenge concerns the interpretation of the elements from English Garden design principles that emerged in the 19th century and were developed in Brazil by European landscapers such as Glaziou (1828–1906). The third one concerns making design drawings digital to elaborate 3d models considering a group of digital graphic tools available and also the application of Sevilla Principles (2011). It is important to mention that some of the research activities were impaired by the COVID-19 pandemic.

Three new Brazilian species of the sharpshooter genus Amblyscarta Stål, 1869 are described and illustrated: A. elianeae sp. nov. (states of Paraná and Minas Gerais), A. souzalopesi sp. nov. (State of Rio de Janeiro), and A. pinna sp. nov. (State of Mato Grosso). The first two species are from the Atlantic Forest, whereas the third is from the Amazon Forest. Cicada unifasciata Fabricius, 1803 is redescribed and transferred to Amblyscarta based on specimens from Guyana and northern Brazil (Amazon Forest). This Fabrician species is the type of the monobasic genus Strictogonia Melichar, 1926, which is thus considered a junior synonym of Amblyscarta. A diagnosis of Amblyscarta is added, as well as brief notes on the phenology of A. elianeae. This paper provides the first detailed descriptions and illustrations of the female terminalia of Amblyscarta species.

A obra Marx Marxismo e Dialética nasceu do III Encontro Nacional dos GT’s Marx e Marxismo da Associação Nacional de Pós-Graduação em Filosofia – ANPOF realizado em Campo Grande, na Universidade Federal de Mato Grosso do Sul, de 9 a 11 de setembro de 2019. Dois encontros do mesmo gênero o antecederam em Fortaleza, na Universidade Federal do Ceará, em 2015 e 2017. Consolida-se, assim, paulatinamente, uma tradição de encontros compartilhados que fortalecem ambos os GT’s que os promovem, a saber: o GT Marxismo e o GT Marx e a Tradição Dialética. O GT Marxismo foi criado em 2004, no XVI Encontro Nacional de Filosofia, realizado em Salvador e o GT Marx e a Tradição Dialética foi criado em 2006, no XVII Encontro Nacional de Filosofia, também realizado em Salvador. Ambos os GT’s, hoje congregam pesquisadores de diversas universidades espalhadas pelas regiões Sudeste, Centro-Oeste, Sul e Nordeste, dentre as quais se destacam a Universidade Estadual de Campinas – Unicamp, a Universidade Federal do Rio de Janeiro – UFRJ, a Universidade Federal de Minas Gerais – UFMG, a Universidade Federal de Uberlândia – UFU, a Pontifícia Universidade Católica de Minas Gerais – PUC Minas, a Universidade Federal do Mato Grosso do Sul – UFMS, a Universidade Estadual do Oeste do Paraná – Unioeste, a Universidade Federal do Ceará – UFC, a Universidade Federal do Rio Grande do Norte – UFRN, a Universidade Federal da Paraíba – UFPB, a Universidade Federal da Bahia – UFBA, etc. Dr. Mauro Castelo Branco de Moura: Prof. Titular do Departamento de Filosofia – UFBA.

This paper describes the findings of the “Third International Conference on Waste Management in the Chemical and Petrochemical Industries,” held in Salvador, Brazil, October 20-23, 1993. A summary of the 74 technical papers, divided into six major categories, is presented together with comments on the more stringent legislation concerning source control programmes. Case studies of two large chemical complexes that have been developing successful waste minimization programmes are described in detail: CETREL-Environmental Protection Company in Camaçari, Brazil, and BASF AG in Ludwigshafen, Germany.
