RESUMOA Resolução nº 125/2010 do Conselho Nacional de Justiça foi um marco importante para a criação de políticas públicas de resolução adequada dos conflitos, o que foi ampliado pela entrada em vigor do Código de Processo Civil de 2015. Nesse contexto, o presente artigo busca compreender a viabilidade das práticas conciliatórias no 2º grau de jurisdição. Para tanto, realiza, a partir da metodologia de estudo de caso, uma análise da experiência do TJRN, especificamente do seu Núcleo de Conciliação. Utiliza dados do próprio órgão sobre as audiências, limitando o escopo aos anos de 2016 e 2017. Procede, ainda, com análise doutrinária e legislativa, sendo o estudo de relevância para exteriorizar a efetividade (ou não) do método consensual de resolução de disputas. Conclui-se que o TJRN tem trazido resultados positivos, chegando, no ano de 2017, ao índice de êxito de 34% no Núcleo de Conciliação e 1,6% no Tribunal como um todo, números acima da média nacional.PALAVRAS-CHAVEConciliação. Políticas Públicas de Resolução de Conflitos. ABSTRACTThe CNJ’s (Brazilian National Council of Justice) Resolution nº 125/2010 was an important landmark for create public policies for the adequate resolution of conflicts, which was amplified after the Brazilian Code of Civil Procedure of 2015. This research aims to understand if it’s possible to use conciliation in Courts of Appeal. In order to do so, it analyses data from conciliation sessions held at the TJRN/NC (Conciliation Chamber of the Courts of Appeal at the state of Rio Grande do Norte/Brazil) between 2016 and 2017. In addition, it analyses the current theoretical and legal framework on conflict resolution. It concludes that TJRN has been achieving positive results, reaching, in 2017, a successful rate of 34% at the TJRN/NC and of 1.6% on all Court levels, numbers above the national average.KEYWORDSConciliation. The article examines the disturbances of warriors from Selenginsk, Udinsk, Ilyinsky and Kabansky fortresses, which occurred in 1696. The author of the study believes that the events were not a direct struggle against state administration. Most of the actions of Transbaikalye residents, directed against the voivode A. Savelov, were not the riot and in most cases did not go beyond the legal framework. On the basis of those events were the erroneous policy of the state aimed at the garrisons formation in Western Transbaikalye, not at anti-feudal process as it was previously thought. The article focuses on the fact that the stage of involvement of Selenginsk and Udinsk military corporations in «troubles» was unequal. While Selenginsk warriors and part of the «old» Udinsk warriors had taken a moderate position in anticipation of conflict resolution with Irkutsk voivode with the help of the state some of Udinsk warriors, mainly the newly-recruited, were inclined to arbitrariness and violation of the law.

At the end the principal aspects and trends for our legal system are set out.

Este trabalho pretende discutir sobre os métodos de resolução de conflitos presentes no atual Código de Processo Civil, com um foco maior nos institutos da mediação e conciliação. O estudo do conceito de mediação e conciliação traz a cidadania e a busca pela pacificação social pelos próprios envolvidos dos conflitos. O Conselho Nacional de Justiça e as legislações pertinentes tem buscado meios para um desafogamento do Poder Judiciário, porém muito mais do que buscar uma celeridade na solução dos processos, busca-se a pacificação social entre as partes de um conflito. A conciliação estava presente nos procedimentos judiciais, já a mediação, passa a ser mais presente, diante de sua institucionalização no Código de Processo Civil promulgado em 2015. Nesse trabalho demonstra a necessidade de mudança de cultura da sociedade e para que essa mudança ocorre o Poder Judiciário deve se reinventar e levar a sociedade as vantagens de resolver o conflito pela autocomposição entre as partes.  Palavras-chave: Código Processo Civil. Autocomposição AbstractThis paper aims to discuss the methods of conflict resolution present in the current Civil Procedure Code, with a greater focus on the institutes of mediation and conciliation. The study of the concept of mediation and conciliation brings citizenship and the search for social pacification by those involved in the conflicts themselves. The National Council of Justice and the pertinent legislations have been looking for means for the Judiciary to be released, but much more than seeking speed in the solution of the processes, the social pacification between the parties of a conflict is sought. Conciliation was present in judicial proceedings, while mediation is now more present, given its institutionalization in the Civil Procedure Code promulgated in 2015. This work demonstrates the need for a change in society's culture and for this change to occur the judiciary must reinvent itself and bring society the advantages of resolving the conflict through self-composition between the parties. Keywords: Civil Procedure Code. This chapter reconstructs the background knowledge that underpins all processes of conflict resolution in rural Bangladesh. It starts with the in-depth analysis of an attempted murder case and shows how state and non-state courts are intricately intertwined in what is conceptualized as the logic of non-enforcement. According to this logic, people frequently file cases with the state court, but not to get binding and enforceable verdicts. Instead, they do so to alter the dynamics of non-state courts. Although non-state justice institutions respond to representations of the state (for example in the form of official documents), they nonetheless do not conform to state law. Instead, their decisions are informed by specific normative convictions about the importance of social harmony and religious prescripts. Importantly, this logic of non-enforcement also applies to the state’s Muslim family laws, which are frequently not enforced if they threaten the patriarchal order of things in rural Bangladesh.

Abstract This article considers the decision of the Court of Appeal in England in MN v OP [2019] EWCA Civ 679 on the circumstances in which an anonymity order will be made in connection with an application under the Variation of Trusts Act 1958. It looks at the legal framework for the decision, in particular the basis for the contention that an analogy should be drawn with proceedings under Rule 21.10 of the Civil Procedure Rules, with the result that anonymity orders should be the norm. It then sets out the conclusion and reasoning of the Court of Appeal and provides some commentary on the possible ramifications of the decision for practitioners in England and other jurisdictions.

In a case, the court of appeal have interpreted the provisions of the law regarding the enforceable judgments delivered at first instance, with the right of appeal, or those in respect of which the parties agreed to directly exercise the appeal, when those interested or harmed by the enforcement can require the cancellation of the enforcement documents drawn up by violation of the legal provisions. The jurisprudence is not unanimous to consider the enforceability of the final civil decision is, however, a temporary one, until it is confirmed by the court of appeal, and it is removed when the court of appeal gives a contrary approach. One of the roles of the limitation is to provide the security of legal relationships, because after the expiry of the limitation period the debtor is satisfied that it can no longer be enforced, and the creditor knows that he no longer benefits from the coercive force of the state in order to recover his debt. On the other hand, to oblige the creditor to enforce a temporarily enforceable decision, about which he has no certainty that it will be upheld on appeal, means violating the very principle of the security of legal relationships, which the legislator intended to protect.

ASPECTOS POLÊMICOS DA MEDIAÇÃO JUDICIAL BRASILEIRA: UMA ANÁLISE À LUZ DO NOVO CÓDIGO DE PROCESSO CIVIL E DA LEI DA MEDIAÇÃO CONTROVERSIAL ASPECTS OF JUDICIAL MEDIATION IN BRASIL: AN ANALYSIS IN THE LIGHT OF THE NEW BRAZILIAN CODE OF CIVIL PROCEDURE AND OF THE MEDIATION LAW             Karime Silva Siviero* RESUMO: Os debates mais recentes sobre a ineficiência do Judiciário lançaram luz sobre a importância dos meios alternativos de tratamento dos conflitos na administração da Justiça. Com o objetivo de recobrar o passo rumo aos ideais modernos de pacificação social, o legislador brasileiro finalmente normatizou a mediação no novo Código de Processo Civil e na recém-sancionada Lei de Mediação (Lei n.º 13.140/2015). Nessa linha, o presente artigo objetiva abordar as inovações trazidas pelos marcos legais da mediação à luz das exigências intrínsecas do instituto analisado. Tenciona-se demonstrar que a mediação judicial poderá se converter em importante ferramenta de educação dos jurisdicionados para a autonomia cidadã, além de servir de baliza de contenção para o arbítrio dos magistrados na condução dos processos. Não se pretende, obviamente, esgotar a análise de todas as questões relacionadas à institucionalização da mediação, mas apenas lançar luz sobre pontos importantes relacionados ao tema. PALAVRAS-CHAVE: Mediação de conflitos. Acesso à justiça. ABSTRACT: The latest debates on the inefficiency of the judiciary shed light on the importance of the alternative methods of conflict resolution in the administration of justice. In order to recover step towards the modern ideals of social pacification, the Brazilian legislature finally regulated the judicial mediation in the new Brazilian Code of Civil Procedure, as well as in the recently sanctioned Mediation Law (Law no. 13140 / 2015). Therefore, this paper aims to analyze the innovations brought by the legal framework in the light of requirements intrinsic to the analyzed institute. It is intended to demonstrate that judicial mediation may become an important educational tool of the subjected to jurisdiction for citizen autonomy, besides serving as a barrier to the arbitrariness of judges in the conduct of proceedings. It is not intended, obviously, to exhaust the analysis of all issues related to the institutionalization of mediation, but only to shed light on important points related to the theme. KEYWORDS: Judicial mediation.
