AbstractIn this paper, I attempt to examine the evolution of judicial review of legislation in Sri Lanka with a view to better understanding how it has impacted the democratic fabric and constitutional matrix of Sri Lanka. The impact that judicial review of legislation has had on rights jurisprudence, enhancement of democracy, prevention of persecution against selected groups are analysed in this paper in relation to the Ceylon Constitutional Order in Council of 1946 (‘Soulbury’ Constitution) and the two autochthonous constitutions of Sri Lanka of 1972 and 1978. The first part of the paper comprises of a descriptive analysis of judicial review of legislation under the three Constitutions. This is expected to perform a gap filling function in respect of the lacuna that exists in Sri Lankan legal literature in relation to the assessment of the trends pertaining to judicial review of legislation in Sri Lanka. In the second part of the paper, I have analysed decided cases of Sri Lanka to explore how the judiciary has responded to legislative and executive power, and has given up or maintained judicial independence. In this respect, I have also attempted to explore whether the judiciary has unduly engaged in restraint thereby impeding its own independence. The third part of the paper evaluates the differences in technique and stance the judiciary has adopted when reviewing draft enactments of the national legislature and when reviewing draft or enacted statutes of Provincial Councils. From a comparative constitutional perspective, this assessment is expected to provide the background that is essential in understanding the island nation’s current constitutional discourse, transitional justice process, and its approach to human rights.

British rule cut down Muslim power in the United Provinces. Between 1868 and 1916, municipalities and councils acts tempered the rule of officials, many of whom were Muslims, with the rule of the people, few of whom were Muslims. Up to 1916, Muslims felt this loss of power most severely in the towns. But, because the municipalities were electorates for the provincial councils, this decline of Muslim power in the towns was reflected in the province as a whole. UP Muslims directed their politics towards compensating for this loss. They aimed for a protected share of power. This essay analyses the local origins of this Muslim demand.

The two Rouen provincial councils that were held in May 1281 and October 1282 are known only from three petitions addressed to Pope Martin IV that survive in a single manuscript. One was printed by Champollion-Figeac in 1839, another by Professor Gaines Post in 1936, but the third remains unpublished because its historical interest has not been apparent. The first two can be readily related to famous events of their day: one urged the canonization of Louis IX, while the other protested the renewal of papal privileges to the mendicant orders. The third, however, has been neglected because its contents do not seem to rise above the commonplace and trivial.

The elections for the provincial councils, held on the 10th of March 1974, has shown results that are quite similar to those shown by the  parliamentary elections. Traditional parties keep or reinforce their positions, whereas the linguistic parties suffer a setback-clear-cut in the case of the Rassemblement Wallon and the Front Démocratique des Bruxellois, but only limited for the Volksunie, which has a long-standing Flemish-nationalist tradition.

ABSTRACT: This paper analyzes the investigatory commission of Cayetano Manrique in the Royal Chancery of Valladolid and Simancas archives in defence of the Basque foral liberties. In view of a new attack by Senator Sánchez Silva that took place in June 1867, Manrique’s investigation was the base for the publication of his foral rectifications to the speech of the andalusian senator and the reprint in 1868 of the History and jurisdiction of the Basque Country. It includes the management report of Cayetano Manrique to the Basque provincial councils in 1866 and the inventory of documentary sources with his critical comment.


Subject Outook for Sri Lanka's opposition ahead of a parliamentary election. Significance President Gotabaya Rajapaksa on March 2 dissolved parliament and called a parliamentary election for April 25. Interim Prime Minister Mahinda Rajapaksa, Gotabaya’s brother, will be aiming to return to power. The main challenge to the pro-Rajapaksa alliance, the Sri Lanka Nidahas Podujana Sandanaya (SLNPS), is set to come from an alliance formed by members of the opposition United National Party (UNP), the Samagi Jana Balawegaya (SJB). Impacts Concerns over COVID-19 are unlikely to disrupt the election. The SJB will likely win more votes in the north and east, where ethnic Tamil voters are concentrated, than in the south and west. Elections for provincial councils will probably be held after the parliamentary poll.

Looking beyond motorways plans, this essay focuses on the role of the Italian "road" lobby in the 1920s in shaping the national transport policy. Contractors like Puricelli were the driving forces of surface transport modernization, with visionary plans but also facing a lack of sympathy by the automobile industry. Those programs were nevertheless carried out with the strong support of the Touring Club and provincial councils. In this context, it seems that the fascist dictatorship, with its hesitance, slowed—rather than hastened—road modernization. Only in 1928, feeding off the ideas of Puricelli and others, did the Mussolini government develop a proper road renewal program. Finally, framing the Italian experience in the European contexts, it emerges that despite the extreme success of American car culture, England is depicted as a more suitable model.

Some of them are incompatible with the current constitutional framework and others are totally or partially updated. The legal certainty demands to incorporate into law currently in force the powers or historical rights which should be exercised, as well as to specify their content, not always defined with sufficient clarity.</b></p>
