scholarly journals IMPLEMENTING EUROPEAN ENVIRONMENTAL POLICY IN THE EUROPEAN UNION AND TURKEY: THE COST AND EXPENDITURES OF THE POLICY COMPLIANCE

This paper examines the European environmental policy and the tools that the European Union (EU) uses for the aim of protecting the environment. Environmental policy is of crucial importance indeed as it has direct impact on human’s health, on the quality of environment, on the well-being of all living creatures and species and on the preservation of our natural resources around the world. The EU is quite active in environmental protection policy making and the scope of her environmental policy expanded with time, including nowadays many aspects such as air, water and soil pollution, waste management, protection of the environment, industrial pollution, chemicals, climate change and noise pollution. The methodology of the study consists of the review and analysis of primary and secondary sources regarding EU legislation on European environmental policy. The requirements of environmental policy are exposed and evaluated at the European level and other international engagements at the global level such as the United Nations Framework Convention on Climate Change (UNFCC), Kyoto Protocol and Paris Agreement are also evaluated in our paper. European statistics and reports are evaluated to provide a good understanding and assessment of the relation between governments and corporations’ expenditures and the protection of environment in EU member states and in Turkey. Our paper also includes the implementation of the European environmental policy in Turkey, therefore Turkish of􀏐icial policy alignment and compliance is explained with data related to EU funded projects implemented by Turkish institutions. Regarding the relation between expenditures and environment, our 􀏐indings indicate a reverse causality effect; the quality of the environment determines the level of public expenditures indeed, and not vice-versa. As analyzed in our paper, governments and corporations’ investments related to environmental protection are quite low and they are in decline, this share needs to be increased both at the EU level and in Turkey. This paper analyses the evolution of the new environmental policy of the European Union in the context of the efforts undertaken to moderate the negative effects of climate change. It describes all the activities in the European Union designed to implement new tools of the EU environmental policy, such as low carbon economy technologies, tools that improve the efficiency of managing the limited natural resources, the environmentally friendly transport package, etc. All of them are aimed at laying the foundations of the circular economy, which may also be referred to as a closed-loop economy, i.e., an economy that does not generate excessive waste and whereby any waste becomes a resource.

AbstractThe European Green Deal announced by the European Commission in December 2019 is a roadmap meant to foster the transition of the European Union towards the climate-neutral economy by reducing carbon emissions towards 55% by 2030 and achieving carbon neutrality by 2050. By putting the EGD in a boarder perspective of evolving, constitutional rationale of environmental protection in the EU legal order, this contribution examines horizontal, legal dimension and financial implications of the green transition. The challenge ahead of the Union is now how to transform the ambitious climate agenda into efficient legal and economic instruments ‘in a fair way, leaving no one behind’. This paper argues that EGD is a great opportunity, but in order to turn it into a success, it must be strongly anchored in the concepts pertaining to the constitutional framework of the EU legal order, in particular, the concepts of solidarity, sustainable development and high level of environmental protection.

Abstract The protection of environmental factors, of the environment as a whole, is a major and ever more pressing issue, which should be of interest to all mankind, to all the states, and to all political and governmental decision factors. In this sense, at the level of the Member States of the European Union, it was necessary to draw and adopt coherent environmental policies and strategies, which would insure an effective protection of the natural and anthropological factors, on the medium and long term. Environmental quality is a matter of general, global interest, which requires achieving appropriate environmental policies, taking into account the essential connection between the world’s economy and the environment. The environmental policy is a method of organising, coordinating, and institutionalising the complex activity of protecting the environmental factors, meant to set the strategies, means, and their implementation techniques at a national, regional, and global level, with the purpose of insuring the preservation and development of the environment. Within the European Union, the opportunity to draw and adopt an environmental policy was determined by the problems that surged following the rapid extension of pollution, a phenomenon that does not stop at the borders of one state or of Europe. Thus, in a first instance, the general policy concerning the environmental protection within the European Union was formulated and defined, through the elaboration and implementation of the Environmental Action Programmes, following which the European Commission established the sectoral strategies in the field, starting from the Strategy for sorting waste and continuing with the EU Strategy for natural protection, the EU Strategy for air pollution, and the EU Strategy for water pollution. In the end, by adopting the Strategy for Sustainable Development, the environmental policy is permanently connected to the environmental issues that may appear, leading to new tendencies in the actions for environmental protection. The efficiency of environmental policies in the European Union is materialized through improvements in the issues related to air quality, surface water quality, through the dissemination and delimitation of fauna protection areas, but there are still many contexts in which such approaches should be intensified, such as: global warming, deterioration of piscicultural fauna, decline in biodiversity.

Climate change litigation is becoming increasingly important. This thesis deals with the question whether state liability claims against Germany or the EU can be justified, if commitments to reduce greenhouse gas emissions are not met. For this purpose, the claim under public liability according to § 839 German Civil Code in connection with Art. 34 German Basic Law, the liability of the EU-Member States and the liability of the European Union according to Art. 340 II TFEU are discussed. At the end of the thesis, considerations on the practical perspectives of state liability are made in order to improve their prospects of success.

The European Union has grown up in terms of influence and size in international politics. The size of its economy and the ever-increasing membership, have seen its ambitions grow meaning that the EU now has an international presence it did not have at its formation. It is easy to say that with the EU being an ambitious actor in international politics, the rise into prominence of climate change naturally came in handy for the EU as it provided an opportunity for the EU to assert itself and prove both its capacity and presence. The 1992 Rio Earth Summit and the withdrawal of the USA from the obligations of the Kyoto came as a blessing in disguise for the Union as it seized the moment to assert itself. Thus, in trying to understand what role the EU has or is playing in international climate change politics, there is need to assess its leadership claims and what it has done to prove these claims. To get there, the paper will navigate through a part of the discipline of International Relations (IR) to understand how it provides for a basis to explain or understand the EU’s limitations and strengths on actorness.

The use of renewable energies has a long past, even though its share of the total energy use is rather low in European terms. However, the tendencies are definitely favourable which is further strengthened by the dedication of the European Union to sustainable development and combat against climate change. The European Union is on the right track in achieving its goal which is to be able to cover 20% its energy need from renewable energy resources by 2020. The increased use of wind, solar, water, tidal, geothermal and biomass energy will reduce the energy import dependence of the European Union and it will stimulate innovation.

The European Union (EU) has sought to lead the world in the adoption of ambitious climate change mitigation targets and policies. In an attempt to characterize and broadly explain the resulting pattern of EU climate governance, scholars have employed the term “multi-level reinforcement.” This term does help to account for the paradoxical situation whereby the EU seeks to lead by example but is itself a relatively leaderless system of governance. Drawing on a much fuller empirical account of the evolution of EU climate governance, this article finds that the term captures some but not all aspects of the EU's approach. It identifies four other paradoxical features of the EU's approach and assesses the extent to which they exhibit “multi-level reinforcement.” It concludes by looking forward and examining the extent to which all five features are expected to enable and/or constrain the EU's ability to maintain a leading position in climate governance.

The European Commission's “Fit for 55” package of July 2021 provides for a significant increase in renewable energy and energy efficiency targets in the European Union (EU). However, the EU’s competences in the energy sector are severely limited and subject to sovereignty. Already in 2018, the EU adopted a Governance Regulation that provides for a hardening of the otherwise only soft governance in the areas of renewable energies and energy efficiency due to the lack of European competences. It is intended to ensure that the Commission's recommendations for improving national energy and climate plans are implemented by the member states. An analysis of the quality of implementation of these recommendations now shows that this has a positive effect in areas with harder soft governance but still needs improvement. Increasing the targets of regulatory action cannot be successful without revising the Governance Regulation and hardening soft governance along with it. Otherwise, the EU is not fit for its 55 percent target in 2030.

This chapter addresses the European Union (EU) as a preeminent example of a regional organization and its role in international environmental law. It first examines the progressive affirmation of EU competence in the environmental field and its development of a distinctive environmental policy. The chapter then turns to the external dimension of EU environmental competence, discussing the EU's participation in and enforcement of international environmental law, as well as the general question of whether the EU can be said to have an external environmental policy. The EU internal environmental policy expands on the international stage. Even if it lacks the internal structures and resources fully and effectively to assume a role as a global environmental leader, the EU participates in environmental negotiations, concludes and implements international treaties, and exercises its ‘soft power’ to promote the development and implementation of international environmental law. The chapter concludes with some brief reflections on other regional organizations and their distinctions from the largely sui generis EU example.

This chapter focuses on the European Union’s environmental policy, the development of which was characterized by institutional deepening and the substantial expansion of environmental issues covered by EU decisions and regulations. Environmental policy presents a host of challenges for policy-makers, including the choice of appropriate instruments, improvement of implementation performance, and better policy coordination at all levels of policy-making. The chapter points to the continuing adaptations that have been made in these areas. It first considers the historical evolution of environmental policy in the EU before discussing the main actors in EU environmental policy-making, namely: the European Commission, the Council of the European Union, the European Parliament, the Court of Justice of the European Union, and environmental interest groups. The chapter also looks at the EU as an international actor.
