The State Civil Apparatus (ASN) is a vital subject in a country's governance and development system. ASN neutrality in politics is a must. In fact, ASN is often used as a political object from the power of political parties and actors not only at the national but also regional level. This study aims to describe the ASN's political position in the elections in Barito Kuala Regency. As a critical review to explore and build a new paradigm of looking at ASN's political position during the 2019 Legislative Election process in Barito Kuala Regency. A qualitative approach with descriptive methods is used in research. Data collection techniques through three steps, namely: observation, interviews, and documentation. Analysis of Miles and Hubermen's data models and triangulation techniques are used to see the validity of the data. The results of the study are described: (1) The Political Position of ASN in Barito Kuala Regency during the 2019 Legislative Election in some ASNs was still considered to be in favor of one of the legislative candidates. Cases of neutrality violations that occurred in several ASNs, put themselves in a neutral political position. The role of ASN in the formation and distribution of power is only in the voting booth, namely choosing one of the existing legislative candidates. (2) The political position of ASN in Barito Kuala Regency during the 2019 Legislative Election should be able to place itself in a neutral position in accordance with the appeal of the circular letter from MENPAN-RB and the applicable regulations. To build a new paradigm for ASN's political position, the perpetrators of ASN neutrality violations should be fostered because most do not understand their position. For ASN which shows partiality, the organizer (Bawaslu) should take action on this matter. Keywords: political position, civil servants, legislative elections.

In the democratic countries, political party acts as mediator bridging communication between government and its citizens. The decline of political party taking place before and after the 2014 and 2019 presidential elections and legislative elections certainly affects the political parties in carrying out their roles. Conducted in Malang, objective of this study is to describe factors contributing declining image of political parties and its implications. The findings showed that image of political parties are deteriorating due to lack of trust towards the political parties and politicians in the parliament. The Decree on direct vote system for both presidential and regional head election and establishment of an open proportional system in legislative election also contribute to the deterioration. Implications of the phenomenon are negative attitude and declining interest towards political party.

The 2019 Legislative Election featured many celebrities involved in the contestation, where a total of 11 of the 16 political parties had legislative candidates from the celebrity circles. Democratic National Party (NasDem) became the party that nominated most celebrities as legislative candidates. Armed with the popularity that has made celebrities attract political parties to nominate them to increase the vote acquisition and even the number of seats. The process of recruiting legislative candidates from celebrities by the NasDem Party is the focus of this research on how the approach and process are carried out. The study uses qualitative analysis with a descriptive approach to describe the process that occurs through interviews and review of documents and news as a source of data. The results obtained indicate that the NasDem Party’s legislative candidate was recruited using an approach that involved the NasDem Party elite and fellow celebrities as intermediaries. Factors driving celebrities to become the NasDem Party’s legislative candidates are moral support (debriefing, fostering, and active interaction with party elites) and material (Campaign Props, campaign costs, financial reimbursement), Indonesian Restoration slogans, and anti-dowry politics, as well as egalitarian politics attitudes. Celebrity-related research in politics has focused a lot on the role of transformation from entertainment to politics. In contrast, this research has focused on recruiting celebrities as legislative candidates by the NasDem Party.

This research, namely (the interaction of political speech among voters in election campaigns), is a significant investigation which serves the election process in ways it discloses the strategy of political speech and its interaction on voters in election campaigns. It determines the implication of politics in raising the voters’ awareness and directing them to practice their rights in electing their active representatives in power. The study focuses on the role of political speech in representing the political issues, strategic plan, communication and campaign. It wants to discuss that political speech has an outstanding factor in succeeding election process under the shadow of the election laws freely and virtuously. Also, it helps obtaining acceptable results to all in a democratic context within the specific timeframe that the campaign gives the opportunity to the political parties in order to participate in election campaigns.

Chapter 3 investigates the process of party formation in France, Germany, Great Britain, and Italy, and demonstrates the important role of cultural and societal premises for the development of political parties in the nineteenth century. Particular attention is paid in this context to the conditions in which the two mass parties, socialists and Christian democrats, were established. A larger set of Western European countries included in this analysis is thoroughly scrutinized. Despite discontent among traditional liberal-conservative elites, full endorsement of the political party was achieved at the beginning of the twentieth century. Particular attention is paid to the emergence of the interwar totalitarian party, especially under the guise of Italian and German fascism, when ‘the party’ attained its most dominant influence as the sole source and locus of power. The chapter concludes by suggesting hidden and unaccounted heritages of that experience in post-war politics.

This study deals with the political parties’ pluralism in Iraq under the Parties Law No. 36 of 2015. The importance of the study lies in the fact that it looks at a topic that is at the heart of democracy and it is necessary for the success of any democratic processes. The study focuses on parties’ pluralism in Iraq since the establishment of the Iraqi state in 1921 until the end of the Baath Party regime in 2003, it also covers the period after 2003 and pays particular attention to the Parties Law No. 36 of 2015. It focuses on the legal framework of political parties after the adoption of the Political Parties Law and studies the impact of this law on parties’ pluralism in Iraq after its approval in 2015. The study concludes that Law No. 36 of 2015 is incapable of regulating parties’ pluralism for reasons including: the lack of commitment by the political parties to the provisions of the law, the inability of the Parties Affairs Department to take measures against parties that violate the law the absence of a strong political opposition that enhances the role of political parties, the association of most Iraqi parties with foreign agendas belonging to neighboring countries, and the fact that the majority of Iraqi parties express ethnic or sectarian orientations at the expense of national identity.

Dalam perkembangan politik hukum kontemporer, keputusan politik dalam pembentukan regulasi sering dihadapkan pada dua persoalan sekaligus yang saling berhadapan. Konfigurasi politik dalam pembentukan Undang-Undang Nomor 7 Tahun 2017, partai politik di parlemen tidak hanya merepresentasikan kepentingan politiknya, tetapi juga dihadapkan pada keharusan mengakomodir putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013 sebagai koreksi keputusan politik yang otoriter. Penelitian ini adalah penelitian yuridis normatif dengan metode kualitatif, studi ini menitikberatkan pada pemahaman komprehensif yang meliputi interaksi politik dan hukum dalam terciptanya konfigurasi politik hukum pemilu. Hasil studi ini dapat menjelaskan kepatuhan partai politik terhadap hukum dalam menciptakan konfigurasi politik di parlemen, namun di sisi lainnya lemahnya partai politik dalam membangun koalisi dalam mewujudkan sistem pemilu demokratis justru menjadikan keputusan politik yang dipilih menjadi otoriter dalam pelaksana teknisnya. Kehadiran hukum dalam perkembangan konfigurasi politik kontemporer, dapat menjadi paradigma baru dalam terciptanya konfigurasi politik demokratis yang pada akhirnya terbentuknya hukum pemilu yang demokratis.In the development of contemporary political laws, political decisions in regulatory formation are often confronted with two issues at once facing each other. The political configuration in the Law No. 7 year 2017, political parties in parliament not only represent political interests but also face the necessity to accommodate the decision of the Constitutional Court Number 14/ PUU-XI/2013 as a correction of authoritarian political decisions. This research is normative juridical research with qualitative method. The results of this study can explain the compliance of political parties to the law in creating the political configuration in parliament. Yet on the other hand, the weakness of political parties in building coalitions in realizing the democratic election system makes the selected political decision become authoritarian in its technical execution. The presence of law in the development of contemporary political configuration can be a new paradigm in creating democratic political configuration which ultimately the formation of democratic law of elections.
