scholarly journals “Proof under reasonable doubt”: Ambiguity of the Norm Violation as Boundary Condition of Third-Party Punishment

In six studies, we consistently observed costly third-party punishment (3PP) to decrease under ambiguity of the norm violation. Our research suggests that, under ambiguity, some people experience concerns about punishing unfairly. Those with higher (vs. lower) other-oriented justice sensitivity (Observer JS) reduced 3PP more pronouncedly (in Studies 1-3 and 4b, but not replicated in Studies 4-5). Moreover, those who decided to resolve the ambiguity (hence, removing the risk of punishing unfairly) exceeded the 3PP observed under no ambiguity (Study 4). However, we did not consistently observe these concerns about punishing unfairly to affect 3PP (Study 4-5). We further considered whether people could use ambiguity as justification for remaining passive – thus, avoiding the costs of 3PP. We did not find conclusive evidence supporting this notion. Taken together, ambiguity entails a situational boundary of 3PP that sheds light on the prevalence of this behavior and, potentially, on its preceding decision-making.

When solving a Multi-Criteria Decision-Making problem of any degree of complexity, many researchers rely on the analytic hierarchy process (AHP). To consider mutual connections between criteria and clusters at the same level and not only the hierarchical structure between criteria and subcriteria, researchers often upgrade from AHP to the Analytic Network Process (ANP), which also examines the interdependency of criteria. However, the ANP method requires a large number of pairwise comparisons. In the case of a complex decision-making problem, the authors of this paper suggest upgrading the AHP method with the graph theory and matrix approach (GTMA) for several reasons: (1) The new method is based on digraphs and permanent value computation, which does not require a hypothesis about interdependency; (2) in case of similar alternatives, the distinguishable coefficient of the new method is higher than those computed for AHP and ANP; (3) the new method allows decision makers to rank comparable alternatives and to combine structurally similar methods without increasing the number of comparisons and the understanding of the results. The developed method (AH-GTMA) is validated by a numerical example of a complex decision-making problem based on a symmetrical set of similar alternatives, a third party logistic provider (3PLP) selection problem.

The use of Data Envelopment Analysis (DEA) in many fields is based on total flexibility of the weights. However, the problem of allowing total flexibility of the weights is that the values of the weights obtained by solving the unrestricted DEA program are often in contradiction to prior views or additional available information. Also, many applications of DEA assume complete discretionary of decision making criteria. However, they do not assume the conditions that some factors are nondiscretionary. To select the most efficient third-party reverse logistics (3PL) provider in the conditions that both weight restrictions and nondiscretionary factors are present, a methodology is introduced. A numerical example demonstrates the application of the proposed method.

This chapter studies the role of equity in preserving the autonomy of vulnerable members of the community. It focuses on the equitable domains of trusts, fiduciary relationships, undue influence, and unconscionability, where an imbalance of power exists in which one party has only limited or bounded ability to make decisions. Equity takes great care to protect the independence aspect of autonomous decision, but is less concerned about the availability of choice between meaningful options. A party will be deemed by equity as consenting if their agreement is anchored in freedom and information. Thus, great care is taken by the Courts of Chancery to ensure that no impediment to the exercise of the claimant's will was present in the circumstance. In addition, relevant information must be provided, and at times nothing less than independent advice from a third party would satisfy this requirement. Equity thus conscripts its particularistic nature to offer strong protection for two elements that are crucial for autonomous decision-making: freedom from coercion and information.

A methodological framework with models is provided, which correlates behavioral and perceptual issues related to the use of intermodal transportation with the commonly used physical and economic criteria in modal choice approaches. With factor analysis, key variables and common decision patterns related to the choice of intermodal transportation are identified. Factor analysis is applied to capture the actors’ perception of the importance of variables affecting the decision-making process. With multiple regression analysis, models simulating the decision-making process are developed for actor groups, utilizing actual quantitative data of cost and performance of intermodal transportation services. Three decision patterns and the respective actor groups’ profiles are identified. The first group consists of actors who decide almost exclusively according to the cost criterion; these actors are intensive users of intermodal transportation. The second group has actors who decide according to both quality and cost criteria; using intermodal transportation by this actor group constitutes a minor portion of its total transport volumes. The third group consists of actors who are influenced in their decisions by specific logistics needs, beyond the physical transportation activity itself. The offer of third-party end-haul operations or refrigerated storage areas is an example of such services, necessitating specific logistic support. For each actor group a model is developed, which associates values of the quantitative variables affecting the decision-making process with the share of intermodal transportation in the total volume of transport handled by the group. The application of the model defines the extent to which changes in the values of relevant variables may shift a decision toward the use of intermodal transportation.

Global industry trends show increased outsourcing of non-core business activities (i.e. construction, maintenance, engineering, etc.) to third-party contractors. Data from several industries show that contractors face 1.5–3 times higher incident rates than in-house employees. This extended abstract covers leading-edge approaches for managing contractor risk, presently implemented by organisations in the oil and gas, mining and manufacturing industries. Using a database of more than 35,000 contracting companies and 220 owner/operator companies, this extended abstract accumulates more than six years of extensive health and safety data to show trends associated with health and safety management and performance improvement. Using statistical analysis methods, actionable leading indicators and insightful trends are discussed. Best practices of contractor management and decision-making tools based on a comprehensive management-system approach to contractor-risk management are also examined. Discussed is a practical model to address the following key elements: Gathering, reviewing and verifying contractor information as part of the due-diligence process. Analysing leading and lagging performance indicators. Driving safety through feedback, benchmarking, and continual improvement.

Leaderless group decision-making denotes the idea that political decisions from a non-hierarchical discussion structure can be more legitimate and effective than those from a hierarchical structure. Since the latter half of the 20th century, such decision-making has been practiced widely in community groups, non-governmental organizations (NGOs), “deliberation” forums, as well as in the business and management settings. While one may argue its origins go back to Athenian direct democracy, it was the zeal of the 1960s participatory democracy movement in the United States that produced the more sophisticated principles, philosophies, and mechanics of leaderless group decision-making. The progressive social movement activists at that time considered non-hierarchical groups as ethically appropriate to their causes. Since then, this tradition of leaderless group decision-making processes has been adopted in many grassroots social movements. Debates and controversies abound concerning leaderless group decision-making. It has been a normative imperative for many social activists to adopt decision-making in a leaderless manner. Research to date, however, has produced no conclusive evidence that leaderless group discussion results in better or more effective decisions. Proponents argue that members of a leaderless group would develop greater capacities for self-governance because in such a setting they can take more personal and egalitarian initiatives to organize activities of the group. This, in turn, would lead to better group dynamics and discussion, and, eventually, better decisions. Critics suggest that leaderless groups are slow and inflexible in decision-making and that the supposedly leaderless groups usually end up with leaders because of the social dynamics and human nature present in group interactions. Regardless of its potential benefits and problems, the ideals of deliberative and participatory democracy are strongly propelling this egalitarian, discourse-based form of group decision-making. Researchers will gain a great deal of insight from literature in deliberation concerning the functions, problems, and future directions of leaderless groups. In addition, there is a need to study leaderless groups in a more multi-faceted way, as research to date has been dominated by psychology-based quantitative assessment of groups. Qualitative and ethnographic approaches will be helpful to further assess the dynamics of leaderless group decision-making.
