This article attempts at analysing the current and drafted legal regulations concerning courtexecutive officers and execution as well as the civil procedure as regards the court executive officers’legal status. Allowance is made for their hybrid position in the system: on the one hand, they performpublic authorities’ functions; on the other hand, they conduct activities in a self-employed capacity,based on full business risk related e.g. to the high personnel and material costs.

This text is an attempt at a sociological description of the phenomenon of street trading as a form of (in)visible presence in the public space of the city. Street traders are (in)visible in the sense that, in breaking the legal regulations setting the frame for public visibility, they must be invisible to the apparatus of power in order to avoid fines and ensure their ability to achieve their aims, their livelihoods. On the one hand, street traders balance on the edge of the law, transgressing the public order, and on the other hand, they are active creators of its (in)visible portion, metaphorically speaking—protesters against the established socio-cultural structures but in reality people seeking the means to survive.

Labur-labur esan dezakegu, batetik, 39/2015 Legeak murrizketa arautzaile batzuk sartu dituela behin-behineko neurriak hartzeko eremuan. Orain, prozedura oro har hasi aurretik har daitezke neurri horiek. Era berean, Administrazio Publikoen Administrazio Prozedura Erkidearen Legeak jasotzen duen administrazio-prozedura erkidearen ikuskera berriaren ondorioz, kasu bakoitzean behar diren behin-behineko neurriak hartu ahalko dira prozedura zehatzaileetan, araudi erregulatzailean aurreikuspen espezifikorik egon beharrik gabe. Beste alde batetik, eskakizun gehigarri batzuk ezartzen ditu erregulazio berriak, kontuan hartu behar direnak administrazio-prozedura hori hasi aurretiko edo hasi ondorengo behin-behineko neurriak hartzean. Horrela, administrazioak neurri horiek hartzean duen irizpidezkotasuna murrizten lagunduko da. RESUMEN: El art. 56 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas (LPAC) ha introducido algunas novedades en la regulación de las medidas provisionales. De forma resumida puede decirse que, por una parte, la Ley 39/2015 ha eliminado algunas restricciones normativas relativas a la adopción de las medidas provisionales, de manera que ahora éstas pueden ser acordadas antes del inicio del procedimiento con carácter general. A su vez, a consecuencia de la nueva concepción del procedimiento administrativo común que recoge la LPAC, en los procedimientos sancionadores podrán adoptarse las medidas provisionales precisas en cada caso, sin necesidad de previsión específica en la normativa reguladora. Por otra parte, la nueva regulación establece una serie de exigencias adicionales que deben observarse al acordar las medidas provisionales previas o posteriores a la iniciación del procedimiento administrativo de referencia, contribuyendo así a reducir la discrecionalidad administrativa en su adopción. Desde otra perspectiva, cabe destacar que los cambios introducidos por el legislador parecen responder a distintas fuentes de inspiración pues, mientras que en lo relativo a la enunciación de las medidas provisionales de posible adopción la LPAC ha pretendido tomar como referencia la Ley de Enjuiciamiento Civil, en lo que respecta a los principios que ordenan la adopción de las medidas señaladas el legislador parece haber tenido en cuenta, principalmente, algunas singularidades que, en la normativa precedente, caracterizaban al régimen de adopción de las medidas provisionales en los procedimientos sancionadores. ABSTRACT: Article 56 of Act 39/2015 of October 1st, on the Common Administrative Procedure by the Public Administrations provided some novelties in the regulation of interim measures. In brief we can consider that on the one hand Act 39/2015 has lifted some normative restrictions regarding the adoption of interim measures so that they now can be agreed in general before the beginning of the procedure. At the same time, as a consequence of the new common administrative procedure conception established by the LPAC, in penalty procedures interim measures specific to each case might be adopted without the need to be specifically stated by the governing regulation. On the other hand, the new regulation has established a number of additional requirements to be observed when agreeing previous or subsequent interim measures to the beginning of the administrative procedure of reference, contributing to reduce administrative discretion at the time of their adoption. From another angle, it should be noted that changes introduced by the legislator seem to respond to several sources of inspiration since whilst the establishment of interim measures to be adopted the LPAC intended to take as reference the Civil procedure law, concerning the principles that govern the adoption of the aforementioned measures, the legislator seem to have taken into account mainly some particular features that in the previous legislation characterized the system of adoption of interim measures in penalty procedures.

The conference dedicated to the memory of the founder of the Ural scholarly tradition of criminal law and criminology professor M. I. Kovalyov (1922–2001) was held in Yekaterinburg on 13–16 February 2019 and united more than 300 scientists and experts from Belarus, Germany, Kazakhstan, Italy, Russia, Serbia, and USA. The topic of the meeting was «Mistake: a Right or a Crime». It was emphasized that the response to mistakes is dual: оn the one hand, a mistake is allowed (errare humanum еst) and, on the other hand, any mistake gives rise to responsibility. The participants discussed a variety of legal approaches to interpretation, classification and penalization of professional mistakes, which make it difficult to find a balance of right and responsibility when dealing with professional errors. It was also mentioned that a mistake can be made not only by the person who committed the crime, but also by the legislator himself. The issue of the responsibility of state bodies and officials for the non-correction of legislative errors was raised. Mistakes which could be made by advocates, notaries and businessmen were considered. In particular, some rapporteurs made an attempt to differentiate business risk and a criminal mistake (or a crime). The debate on judicial errors and malpractice also took place.

Abstract Why did Nazi concentration camps routinely send death notifications and even cremation urns to families of dead prisoners, including Jewish prisoners, until well into the war years? This article challenges the assumption that these practices served solely to provide reassurance that the prisoners had died under ‘normal’ circumstances. In the case of Jewish prisoners, urns sent home for burial to families in the Reich were part and parcel of a system of intimidation waged through local Gestapo offices. These urns also illuminate changing practices around prisoner deaths within camps themselves and the dissonant character of Nazi camp organization. On the one hand, camp administrators adhered to long-standing German state practices, establishing civil registries on camp premises to record prisoner deaths. On the other hand, they flouted bureaucratic norms, fabricating the causes of prisoner death on a grand scale and using bureaucratic procedures to veil the gross mistreatment of inmates. In many camps, prisoner labour was forced to help manufacture and uphold this imperfect subterfuge. These histories point to one of the few places in which the death of Jewish prisoners in the Nazi detention system was systematically recorded and conveyed back to families and Jewish communities in the Reich. Yet, paradoxically, the ‘processing’ of death in the major concentration camps was in many respects untrustworthy, and intimidation now also hovered over what had been a credible, neutral civil procedure.

Abstract. Two experiments examined the influence of stories on recipients’ self-perceptions. Extending prior theory and research, our focus was on assimilation effects (i.e., changes in self-perception in line with a protagonist’s traits) as well as on contrast effects (i.e., changes in self-perception in contrast to a protagonist’s traits). In Experiment 1 ( N = 113), implicit and explicit conscientiousness were assessed after participants read a story about either a diligent or a negligent student. Moderation analyses showed that highly transported participants and participants with lower counterarguing scores assimilate the depicted traits of a story protagonist, as indicated by explicit, self-reported conscientiousness ratings. Participants, who were more critical toward a story (i.e., higher counterarguing) and with a lower degree of transportation, showed contrast effects. In Experiment 2 ( N = 103), we manipulated transportation and counterarguing, but we could not identify an effect on participants’ self-ascribed level of conscientiousness. A mini meta-analysis across both experiments revealed significant positive overall associations between transportation and counterarguing on the one hand and story-consistent self-reported conscientiousness on the other hand.

SummaryThe prognosis of patients with acute myeloid leukaemia (AML) has improved considerably by introduction of aggressive consolidation chemotherapy and haematopoietic stem cell transplantation (SCT). Nevertheless, only 20-30% of patients with AML achieve long-term diseasefree survival after SCT. The most common cause of treatment failure is relapse. Additionally, mortality rates are significantly increased by therapy-related causes such as toxicity of chemotherapy and complications of SCT. Including radioimmunotherapies in the treatment of AML and myelodyplastic syndrome (MDS) allows for the achievement of a pronounced antileukaemic effect for the reduction of relapse rates on the one hand. On the other hand, no increase of acute toxicity and later complications should be induced. These effects are important for the primary reduction of tumour cells as well as for the myeloablative conditioning before SCT.This paper provides a systematic and critical review of the currently used radionuclides and immunoconjugates for the treatment of AML and MDS and summarizes the literature on primary tumour cell reductive radioimmunotherapies on the one hand and conditioning radioimmunotherapies before SCT on the other hand.

It is stressed that Schumpeter's revolutionary challenge can lead to radical changes in modern economics.

Abstract Pesantren are often associated with backwardness and traditionalism in everything: facilities, technology, learning methods, and even the curriculum. For now, it seems like the traditional term for pesantren is no longer relevant enough. The pace of movement in the era of renewal marked by the rapid development of technology has demanded pesantren to make adjustments. However, on the one hand, when viewed from the direction of change, the reform efforts pursued by pesantren are not to erase the old tradition, but merely to add something new so that the old tradition and conditions can be maintained while accepting the presence of a new one. On the other hand, the reform efforts undertaken by pesantren have implications for the fact that the typical values of the pesantren are fading away. Abstrak  Pesantren seringkali diasosiasikan dengan keterbelakangan dan tradisional dalam segala hal: fasilitas, teknologi, metode pembelajaran, dan bahkan kurikulumnya. Untuk saat ini, sepertinya istilah tradisional untuk pesantren, sudah tidak lagi cukup relevan. Laju gerak pembaharuan zaman yang ditandai dengan pesatnya perkembangan teknologi telah menuntut pesantren untuk melakukan penyesuaian diri. Kendatipun demikian, di satu sisi, jika dilihat dari arah perubahan, upaya pembaharuan yang ditempuh pesantren tidaklah untuk menghapus tradisi yang lama, tetapi sekadar menambah dengan sesuatu yang baru sehingga tradisi maupun kondisi yang lama bisa dipertahankan sambil menerima kehadiran yang baru. Di sisi yang lain, upaya pembaharuan yang dilakukan pesantren ternyata berimplikasi pada kenyataan akan semakin pudarnya nilai-nilai khas yang dimiliki oleh pesantren.

BASYARNAS’s verdict in resolving dispute can be negotiated or cancelled by submitting nullification to the Religious Court if the parties or one of them felt dissatisfied with the BASYARNAS verdicts. This case is important to be reviewed academically because of its paradox and ambiguity. On the one hand the decision is final and binding, but on the other hand it could be cancelled through the Religious Court. If the BASYARNAS verdicts really want to be final and binding, the nullification of the verdicts should be abolished. It can be replaced by an amendment of the verdict submitted to BASYARNAS and handed back to the arbitrator (arbitrator panel) who handles the dispute. Apart being fast and confidential, the arbitrator (judge) is more aware of the case, the reasons, evidences and witnesses of the dispute.

"Etymological, Lexical and Semantic Correspondences in the Process of Feminization of Professional Names, Trades and Activities in French and Romanian Societies. The feminization of thought represented by language and of its varieties in the Roman World has allowed to highlight some convergences that come from a common linguistic heritage, often from Greek and Latin and some hesitation about adapting society to its realities. The feminization of some words which comes from an ancient process illustrates on the one hand the potential of the language and on the other hand some constraints sometimes linked to the society itself, which creates transitional periods, between matching grammatical correction and the evolution of linguistic uses over time. The possibilities of lexical enrichment (internal creation or loan) show the means available in French and Romanian and some convergences in the area of derivation, of lexical units and their etymologies. The grammatical perspective and word constructing methods make it possible to give keys for the feminization of names of trades or professions. Likewise, recording entries in the lexicon, their evolution, their assimilation or sometimes their forgetfulness, for the benefit of new constructions highlight the existence of objective and subjective criteria which teach us a lot about society as a whole.
