Islamicate Cosmopolitanism from North Africa to Southeast Asia

Lawrence introduces the idea that ‘Islamicate cosmopolitans’ engage in moral introspection to fashion a genuine orientation of openness to religious-cum-cultural difference. Drawing from the work of Marshall Hodgson, Lawrence argues that these cosmopolitans carried a specific conscience, a conscience that precedes Islam yet was reshaped by the Quran and ethical reflection within Muslim empires. The chapter then explores two renowned pre-modern thinkers, the scientific polymath Abū Rayḥān al-Bīrūnī and the legal scholars Ibn Khaldūn, as exemplars of a universal ethos with an Islamicate accent. Yet, Lawrence also acknowledges how notions of cosmopolitan justice could nevertheless sustain coercion by directing Muslim commitment to state power through concepts such as the medieval ‘circle of justice’.

Abstract A revision of the rhinocerotid material from the Negev (Israel), dating back to the early Miocene (MN3 in the European Mammal Biochronology), highlights the presence of Brachypotherium and a taxon close to Gaindatherium in the Levantine corridor. A juvenile mandible, investigated using CT scanning, displays morphologically distinct characters consistent with Brachypotherium cf. B. snowi rather than with other Eurasian representatives of this genus. Some postcranial remains from the Negev, such as a humerus, display features that distinguish it among Miocene taxa. We attribute these postcrania to cf. Gaindatherium sp., a taxon never recorded outside the Siwaliks until now. This taxon dispersed into the Levantine region during the late early Miocene, following a pattern similar to other South Asian taxa. Brachypotherium cf. B. snowi probably occurred in the Levantine region and then in North Africa during the early Miocene because its remains are known from slightly younger localities such as Moghara (Egypt) and Jebel Zelten (Libya). The occurrence cf. Gaindatherium sp. represents a previously unrecorded range expansion out of Southeast Asia. These new records demonstrate the paleogeographic importance of the Levantine region showcasing the complex role of the Levantine corridor in intercontinental dispersals between Asia and Europe as well as Eurasia and Africa.

The purpose of this article is to discuss Kant’s concept of juridical state as the foundation of the contemporary rule of law. Therefore, the article tries to answer two questions: (1) what character can be attributed to Kant’s concept of juridical state taking into account the obligations arising from it; (2) can the analysis of the Kantian juridical state have any impact on the contemporary understanding of the rule of law and if so, what can this impact be. In order to accomplish this task, moral presuppositions of Kant’s juridical state are discussed, according to the commonly accepted view that Kant’s political philosophy is closely linked with his moral and ethical reflection. Then, two interpretations of Kant’s juridical state – the liberal one and the authoritarian one – are analysed. The crucial difference between these interpretations lies in establishing the circumstances in which the duty of obedience to state power should be carried out. Then, Kantian juridical state is compared with two ways of understanding the rule of law – the material one and the formal one – in order to evaluate whether the rule of law should be considered as continuity of or rupture with the Kantian concept.

Studies of the archipelago (nusantara) on the notes of foreign travelers written in the 9th and 10th of centuries are still quite rare.  Indeed, there have been several studies on the notes of travelers such as Ma Huan (China), Tome Pires (Portuguese), Ibn Bathuthah (Arabic), and some others. But, these studies revolve around the notes of travelers after the 10th of century.  Meanwhile, notes of travelers who came to the archipelago (nusantara) in the century before 10 AD have not got serious attention yet. This book is a travel note's report which captures various activities in India, China and Southeast Asia. This book also contains a history about how Islam met in the Sarandib area.  There are many interpretations of sarandib accurate location today. The findings of Keram Kevonian in his research on the names of regions in the Indian Ocean region using Armenian language sources stated that Sarandib means Swarnadipa which was no other than Sumatra. The communis opinio of historians is that early modern, or precolonial, states in Southeast Asia tended to lead precarious existences. The states were volatile in the sense that the size of individual states changed quickly, a ruler forced by circumstances moved his state capital, the death of a ruler was followed by a dynastic struggle, or a local subordinate head either ignored or took over the central state power; in short, states went through short cycles of rise and decline. Perhaps nobody has helped establish this opinion more than Clifford Geertz (1980) with his powerful metaphor of the “theatre state.” Many scholars have preceded and followed him in their assessment of the shakiness of the state (see, for example, Andaya 1992, 419; Bentley 1986, 292; Bronson 1977, 51; Hagesteijn 1986, 106; Milner 1982, 7; Nagtegaal 1996, 35, 51; Reid 1993, 202; Ricklefs 1991, 17; Schulte Nordholt 1996, 143–48). The instability itself was an enduring phenomenon. Most polities existed in a state of flux, oscillating between integration and disintegration, a phenomenon which was first analyzed for mainland Southeast Asia by Edmund Leach (1954) in his seminal work on the Kachin chiefdoms. This alternation of state formation and the breaking up of kingdoms has been called the “ebb and flow of power” and the “rhythm” of Malay history (Andaya and Andaya 1982, 35). In this article, I will probe into the causes of the volatility of the Southeast Asian states, using material from Sumatra to make my case.
