Conformity assessment. Guidance on a third-party certification system for products

International trade is increasingly regulated through standardization, certification, and accreditation. To ensure that consumers can trust that the products they buy meet regulators’ standards, third-party certifiers and accreditation bodies, which “certify the certifiers,” act as intermediaries enlisted to deliver conformity assessment certificates to producers. This article explores how a few third-party certifiers have exploited their position between multiple regulators and diverse targets to invest in a growing number of sectors, expand globally, and become preferred advisers to regulators. As regulators enlist them to standardize certification practices, big third-party certifiers (BTPCs) advise regulators to set system-based regulations that are better suited to their own organizations and networks of international subsidiaries.

AbstractThe organic food certification system in Italy, based on the EU legislation, relies on private control bodies (CBs) that are supervised by national authorities. The aim of this paper is to investigate whether it is possible to test for differences in controls outcome based on CBs’ behavior. To this extent, we use a multinomial logit model estimated on data corresponding to the results of the inspections in the year 2015 in Italy. The model controls for two fixed effects represented by the type of operator and a contextual variable, i.e., the region where a firm is located. Significant variability in CBs behavior could induce adverse selection in the choice of the CB by organic operators. In this vein, we discuss some implications in terms of policies and consequences for supervision in the conclusions.

Abstract Safety of agricultural machinery is a key aspect in carrying out agrotechnical treatments. Appropriate testing of machines and equipment guarantees better protection of life or health. Applicable conformity assessment procedures do not require (except for particularly dangerous machines) participation of the third party - a professional, specialized, accredited, notified testing laboratory what raises a common fear of the dangers arising from ignorance of manufacturers.

After adoption of the Law of Ukraine On Technical Regulations and Conformity Assessment, and, in connection with the transition from mandatory certification in the state system to the sphere of technical regulation, the bodies that carry out activities on product certification were facing the need to create their own certification systems. On the one hand, this is a necessity step, and on the other, it is the acquisition of some freedoms in the choice of the methodology for carrying out certification work; the possibility of improving activities; promoting the development of promising areas within the scope of accreditation; enhanced functionality. In this case, the above-mentioned positive aspects of creating the own certification system, which, by the way, may differ from other systems, provide conditions for the certification body to be very responsible for the decisions made on the conformity of certified products. The purpose of this article is to provide information on methodological approaches to the creation, development and improvement of the Certification System for railcar building products. In general, the creation of a certification system for railcar-building products took place during the period of formation of the UkrSEPRO certification system. But during this period in Ukraine national standards of the 3400 series were put into effect, in which the basic principles, rules, requirements and structure of the UkrSEPRO certification system were specified. The modern approach to product conformity assessment, introduced in the field of technical regulation, did not destroy certification at all, as incompetent representatives of the mass media imagine it, but endowed it with a different status and place in the conformity assessment system. Furthermore, according to the Law of Ukraine “On Technical Regulations and Conformity Assessment”, the term "certification" is interpreted as "confirmation of conformity by a third party in relation to products, processes, services, systems or personnel." At the same time, in accordance with this law, the term “conformity assessment system” is defined as “rules, procedures and management for carrying out conformity assessment”. The third-party certification industry in China has been gradually stepping on the right track. However, it has not yet gained a foothold in rural building material market. Since the “12th Five-Year Plan” came into being, the new countryside construction is extremely urgent. Therefore, it is very necessary to establish a third-party certification system to regulate and standardize rural building material market. By using the game theory method, this paper analyzed the operating model of third-party certification organization under the economy of monopoly market, and put forward the third-party certification system which was suitable for rural building material market, in the meanwhile, proposed several suggestions in the management models of certification organization for government supervision departments.
