Digital Library Protection Using Patent of Retrieval Process

In this chapter, we present a formulation for protecting digital library as intellectual property, especially image digital library. The entire content of digital library assembled by database designers is to be differentiated from its individual contents. The digital library community demands an innovative approach for protecting digital library associated with content-based retrieval that dynamically generates indexes to its contents. The entire content with dynamically assigned indexes goes beyond the scope of the conventional copyright protection of the database with statically assigned indexes. The proposed formulation uses the patent of content-based retrieval process, and protects its object digital library in the specified domain without any excessively exclusive protection in general domains. That formulation determines whether the problem retrieval process identifies a classification of the entire content stored in its object digital library as a single and unique collection, or its equivalents within the scope of its specified domain. The similar collection realized in other digital libraries evidences unauthorized use of the problem retrieval process, or its equivalents, as far as it is patented. The patent of content-based retrieval process works as a catalyst of digital library protection, and restricts any other assembling of equivalent digital libraries in the scope of its specified domain. We provide mathematical foundation and reasoning of the proposed formulation, and confirm its feasibility and accountability in several case studies.

The principal concern of this article is to provide researchers and practitioners in information science and technology with legal references on the concepts, issues, trends, and frameworks of intellectual property protection regarding multimedia digital library in engineering manner. Digital library is the global information infrastructure in the networked society (Borgman, 2003). A digital library, as an information system, consists of digital contents in databases and retrieval mechanisms. The right protection of digital library is a critical issue in the digital library community that demands frameworks for recouping their investment in database design and system implementation. Intellectual property law gives incentive to advance appropriate investment in database design and implementation with two types of intellectual property protection: copyright and patent (Jakes & Yoches, 1989; Junghans & Levy, 2006). Multimedia digital contents take a variety of forms including text, images, photos, and video streams, which often commingle in multimedia digital libraries. Nevertheless, present legal studies are not satisfactory as the source of technical interpretation of the intellectual properties regarding multimedia digital libraries. The intellectual property protection of the multimedia digital libraries demands clear and concise frameworks.

We outline the legal issues on multimedia digital libraries and retrieval mechanisms. The study aims at identifying the concept of digital library, it also tries to shed the light on the most significant intellectual issues by presenting its definition, development, functions (selection and acquisition of information resources from the web, sources indexing, communication and management of intellectual property rights, production of electronic resources and its availability, and digital resources maintaining), characteristics, and the purpose of turning into digital library, passed by the proposed stages of digital library transition, Types of Intellectual Property (Copyright, Patents, Trademarks, Commercial Secrets), it also discusses copyrights and intellectual property, the problems and challenges of digital library, and finally the future of digital library. Many researchers agree that the main objective of the digital library is to accomplish all the functions of the traditional library, but in the form of electronic digital libraries which are only an extension for jobs that are performed and the resources that are accessible in digital library. The study concluded that digital libraries emerged as an obligatory result of revolution of the third millennium which is called the communications revolution, as libraries are able to prove that they are able to stand and cope with all the modern technology, where there is no conflict between the new and modern trends in libraries issue, but it also benefits from both of them concerning their evolution instruments in service for beneficiaries in every time and place.

Intellectual property poses a major challenge to digital libraries. This is because access to information in digital libraries is limited by laws, licenses and technology adopted by intellectual property owners. Similarly, intellectual property renders it difficult for digital libraries to make orphan works discoverable and accessible. Furthermore, intellectual property fragments copyright ownership, making it difficult for digital libraries to obtain the right clearance on content. To cope with these challenges, digital libraries have embraced the open access movement which allows reading, copying, downloading and sharing of digital content as long as the creators of the works are cited and acknowledged. Besides, digital libraries offer access to digital works produced under creative commons licenses. These licenses give the copyright owners the liberty to modify the copyright of their works to give room for sharing, use, and building upon the work.

This chapter introduces Spatial Data Infrastructures (SDI) and establishes their strong conceptual and technical relationships with geographic digital libraries (geolibraries). The authors describe the origin of SDIs and highlight their role as geographic resources providers. Then, they give several examples of the use of techniques and tools taken from the digital libraries world in the development of SDIs. The purpose of this chapter is establishing a solid foundation for those aspects of SDIs that can make profit from the knowledge and tools provided by the digital library community. It will also point the key differences between SDIs and geolibraries in order to provide a broader view of these infrastructures.

Digital Libraries (DLs) are extremely complex information systems that support the creation, management, distribution, and preservation of complex information resources, while allowing effective and efficient interaction among the several societies that benefit from DL content and services. In this paper, we focus on our experience facing challenges of building, maintaining, and developing the Networked University Digital Library (<A HREF="http://www.nudl.org/">www.nudl.org</A>), an extension of the Networked Digital Library of Theses and Dissertations (<A HREF="http://www.ndltd.org/">www.ndltd.org</A>). NUDL is a worldwide initiative that addresses making the intellectual property produced in universities more accessible, stimulating international collaboration across all disciplines. We detail technological aspects of our solutions and research activities carried out to provide powerful and enriched services for the communities served by this initiative.

The modern knowledge economy has transformed library and information organizations to adopt and embrace digital social media platforms. Proliferation and growth of social media and social networking technologies continue to play pivotal roles in establishment and operation of digital library and information systems in organizations. The purpose of the chapter is to examine the extent to which information professionals and practitioners understand the impact of social media and social networking technologies on digital library and information systems. The author also analyzes how information professionals manage and promote the adherence to copyright and intellectual property laws in digital library contexts.
