Legal Perspectives on Family Violence Against Children

Abstract The situation of crisis produced by the Coronavirus (COVID-19) pandemic poses major challenges to societies all over the world. While efforts to contain the virus are vital to protect global health, these same efforts are exposing children and adolescents to an increased risk of family violence. Various criminological theories explain the causes of this new danger. The social isolation required by the measures taken in the different countries, the impact on jobs, the economic instability, high levels of tension and fear of the virus, and new forms of relationships have all increased levels of stress in the most vulnerable families and, therefore, the risk of violence. In addition, mandatory lockdowns imposed to curb the spread of the disease have trapped children in their homes, isolating them from the people and the resources that could help them. In general, the restrictive measures imposed in many countries have not been accompanied by an analysis of the access to the resources needed to reduce this risk. It is necessary to take urgent measures to intervene in these high-risk contexts so that children and adolescents can develop and prosper in a society which is likely to undergo profound changes, but in which the defense of their rights and protection must remain a major priority.

Objetivos: descrever a organização familiar frente ao caso de violência contra a criança e analisar através da utilização do genograma e ecomapao risco de familiares em situação de violência. Método: estudo descritivo, tipo estudo de caso realizado no setor pediátrico de um Hospital Municipal da Baixada Litorânea do estado do Rio de Janeiro. Aplicado o Modelo de Calgary de avaliação de famílias. Resultados: através do genograma e ecomapa identificou-se a organização familiar, as relações familiares e as várias situações de violência vivenciadas pela criança e seus familiares. Conclusão: este estudo ratifica o papel da enfermagem na identificação de casos de violência, a importância destes profissionais em compreender a magnitude desta situação e seus desdobramentos no ambiente familiar. O enfermeiro deve desenvolver habilidades que protejam a criança e sua família em questões de violência intrafamiliar.

Aborda a temática da violência que ocorre no âmbito familiar, a qual, por ocorrer no domínio privado, acaba não merecendo a devida atenção da sociedade. Constata-se que, embora os arranjos familiares tenham mudado com o transcorrer do tempo, a violência familiar continua marcando presença, caracterizada pela ação ou omissão do adulto sobre a criança e/ou adolescente. Assim, discute-se o panorama geral da violência doméstica contra criança e/ou adolescente, o conceito e características dessa forma de violência e as diferentes abordagens do problema. Sugerem-se algumas alternativas no tratamento e encaminhamento das vítimas da violência doméstica. Palavras-chave: violência doméstica; criança; adolescente; ação preventiva. Abstract This text studies household violence, which by the fact that it occurs inside family environment, it does not receive adequate attention from the society. Although family arrangements have been changed along time, family violence continues, characterized by adults omission and also evidenced by their actions against children or youths. It discusses the general view of the household violence against children; its conception and characteristics; the different approaches of the problem and suggests some alternatives to treat and help victims from this kind of violence. AbstractService and education organizations such as the ASPCA claim a connection between family violence against children and companion animals, but to what extent does the general public share this perception? Sixty-three undergraduates rated their certainty about perceiving family violence using 60 pictures with differing potential targets of family violence. Participants showed stronger certainty when the target was a child than when the target was a companion animal, but ratings for companion animals averaged above the midpoint of the scale used. Interview questions were used to obtain information about childhood recollections of joint discipline situations in which children received punishment for what companion animals did, or vice versa. Thirty-four participants recalled such situations, some of which resulted in the death or discarding of a family's companion animal. The majority of participants affirmed a connection between violence against children and companion animals in the family, with some giving credit for that insight to their taking part in the study.

ABSTRACT Objective: to understand the context of care addressed to the families involved in family violence against children and adolescents (IVCA), as produced in the context of the Primary Health Care (PHC), from the vantage point of the practitioners of a municipality in the State of Sao Paulo. Methods: qualitative research of the social-strategic type, based on the Complexity Paradigm. The participants were 41 health practitioners in five health units of the municipality under study, pertaining to the five districts of the municipality. Data collection was done through 5 focus groups and 10 semi-structured interviews from April 24th 2013 to December 12th 2013. Data analysis was oriented by the comprehension and contextualization mindset and based on the dialogic, recursive and hologramatic principles. Results: two main issues regarding the care provided by the Health of the Family team were identified: the context of this violence (the domestic space) and the power relations that prevail in the territory where this violence surfaces. The community health workers are the targets of specific attention because they experience the live/work dialogic in this same area. Conclusion: paying attention to the territory, and considering the complexity of contexts and dimensions is inherently linked to the design of care to families involved in IVCA in the PHC environment.
