<p class="western" lang="en-US" align="justify"><span style="color: #000000;"><span lang="pt-BR">O Poder Público deve realizar a gestão, conservação e destinação de suas terras públicas, conforme os preceitos legais e Constitucionais. Contudo, o Executivo Federal tem enfrentado resistência para criação de Unidades de Conservação (UCs) na Amazônia, em detrimento da regularização das posses. O presente artigo faz uma análise jurídica da tomada de decisão e discricionariedade da União na destinação destas terras, à luz da Constituição, das Convenções internacionais e das Leis pátrias, tendo como pano de fundo a análise do caso das UCs no Sul do Amazonas. Conclui-se que as terras públicas são priorizadas à proteção ambiental, mas ainda devem ser observadas todas as ferramentas de governança fundiária, incluindo o Zoneamento Ecológico Econômico (ZEE). O arcabouço jurídico brasileiro indica que nas glebas públicas federais, se não criadas as Terras Indígenas (TI) ou UCs, deve o poder público, subsidiariamente, buscar a regularização fundiária, considerando a aptidão e vocação das terras.</span></span></p><p class="western" lang="en-US" align="justify"><span style="color: #000000;"><span lang="pt-BR"><br /></span></span></p><p class="western" lang="en-US" align="justify"> </p><p>Government must carry out the management, conservation and destination of its lands, according to the legal and constitutional precepts. In Amazon the Federal Government has faced resistance and criticism in setting Protected Areas (PA) in detriment of the economic exploitation by the regularization of the possessions. We make a legal analysis of the State's decision on the destination of these public lands, under Constitution, the International Conventions on the Environment and the Brazilians laws in South of Amazonas´s protected areas . Federal Public lands are prioritized for environmental protection, but all tools of land governance, including Economic Ecological Zoning (EEZ), must still be observed. In case of non-creation of Protected areas, Govenment should seek land regularization, considering the aptitude and vocation of the lands, in a subsidiary way.</p><p class="western" lang="en-US" align="justify"><span style="color: #000000;"><span lang="pt-BR"><br /></span></span></p>

<p><strong>INTERVENÇÃO DO PODER PÚBLICO EM OUTRAS TERRAS PÚBLICAS PARA CRIAÇÃO DE UNIDADES DE CONSERVAÇÃO </strong></p><p><strong>Resumo:</strong> A Constituição Federal tutela os recursos naturais sendo obrigação do Estado e da Sociedade e competência comum a todos entes Federativos. A Lei 9.985/00 não enfrentou questões importantes como o da dominialidade das terras públicas. Em 15 anos após a Lei, muitas áreas têm sido criadas em sobreposição ou em territórios sem o domínio do ente titular do ato. Este cenário gera no mínimo insegurança jurídica, desentendimentos fundiários, além de conflitos locais. O objetivo central deste artigo é discutir se os dispositivos da Lei 9.985 de 2000, seu decreto e a Constituição, autorizam a criação de espaços protegidos em área de outro ente da Federação. Além disso, analisar as diferença quanto à modalidade de UC – de uso sustentável ou de proteção integral. As UC de uso Sustentável podem ser criadas em áreas sem o domínio do titular, pois estar-se-ia meramente atuando com Limitação Administrativa, sem a transferência do domínio. Nas UC de proteção integral sua instituição dependem do domínio pelo titular do ato, salvo quando ocorrer a desapropriação nos casos admitidos em Lei.</p><p><strong>Palavras-chaves:</strong> Intervenção do Estado; Lei 9.985/2000; Terras Públicas; Unidade de Conservação; Desapropriação.</p><p><strong>INTERVENTION OF THE PUBLIC AUTHORITIES IN OTHER PUBLIC LANDS FOR CONSERVATION UNITS OF CREATION </strong></p><p><strong>Abstract:</strong> Natural resources protection is a Constitutional duty for both all society and State. Besides all federation members detain such common legal competency. The Brazilian Protected Area´s Act (Law 9.985 of 2000) it was not clear whether it is possible to create Protected Areas over public lands. Over last 15 years many areas have been created in overlapping public territories generating legal uncertainty, disagreements, and local conflicts. The aim of this text was to discuss whether law and the Constitution authorize a member of the Federation to institute Protected Areas in land of another member Federation. Furthermore, to examine the legal effects for different types of Protected Areas. The modality of Sustainable Protected Areas (SPA) can be created in areas without the domain. This is because merely would be acting with administrative limitation. Tourism in national parks is a specific paradox. It can cause great damage to vital values o f national parks, especially if not managed properly, but it can also bring great benefits. In some national parks there are simply so many visitors in certain parts, or at particular times, that nature - and the quality o f the visitor's experience - suffers. Also, tourist facilities often conflict with conservation aims and spoil natural landscapes. On the other hand, if planned and managed for sustainability, tourism can be very positive force, bringing benefits to protected areas and local communities alike. Tourism will be welcome in or near national parks if it respects special character o f the area, such as tourism based on appreciating nature, cultural and educational tourism, and quiet small-scale or small group activities; and if it causes minimal damage, disturbance or pollution. It can justify establishing protected areas in marginal regions, and can lead to revival in local economy and traditional cultures. Techniques for managing tourism in sensitive environment, with national parks included, are now generally better known; though they often cost time and money, the income which tourism generates can help offset the costs. Also, tourism development can be linked to craft industry’ and alternative employment of farms producing elements o f sustainable rural economy.

AbstractMarine protected areas provide cultural services including the aesthetic appreciation of the landscape and the performance of recreational activities. In this study, we use the photographs shared by users in a digital repository to describe the distinctive characteristics of two terrestrial-maritime natural parks in Spain. In total, 1041 photos and 2342 tags generated by 76 users were analyzed. The results show the greatest salience of the landscape values, followed by historical monuments and the sighting of fauna and flora. The methodology based on the extraction of digital data from Flickr facilitates the efficient comparison of a Mediterranean archipelago (Cabrera Island) with an Atlantic archipelago (Cíes Islands). However, some important limitations were also detected in the descriptive capacity of this method, in comparison with the content analysis by external observers. But, overall, the evaluation of the subjective experience of visitors to natural areas can be very useful for tourism management of the marine environment.
