The special issue covers both fronts by presenting a conceptual analysis of arbitrary law-making that sets out to typify its various meanings, along an empirical account of its actual functioning in legal and political practice. As arbitrariness becomes a pressing concern for lawyers, politicians and scholars attempting to grasp the discretionary powers of judicial and administrative authorities vis-a-vis legal subjects, its social impact as well as its political consequences must be taken into consideration in order to fully comprehend how central arbitrariness has become for a philosophical and a sociological account of law-making. Migration policy is precisely where arbitrariness vividly shows its face, and where its various forms unleash their most revealing implications. It is in this field that we must dig further if we want to know how this hitherto peripheral and surrogated dimension of legal decision-making stretches the leeway of legal officials to the very margin of legality, disclosing the social tension and the power struggle between their agency and the structures that condition and enable it.

In the present stage of research, it is easiest to discern the economic effects of war on the Iberian colonies. These were diverse in chronological, regional and sectoral terms, but the overall results were to tie the economies of the Portuguese and Spanish colonies more firmly to those of the metropoles. This did not exclude two processes pulling in other directions. Firstly, the foreign trade of the colonies persisted but was reoriented away from Europe and towards North America. Secondly, shortages and insecurity of transport led to a significant degree of import substitution and regional African trade in the colonies, in the fields of both industry and agriculture. The social impact of war resembled that in much of the rest of Africa, great hardships and labour pressures on the mass of the population, but windfall profits for a few, both black and white. The political consequences of the two conflicts remain most shadowy at present, but they appear to have heightened the covert struggle between pro-fascist and anti-fascist groups in a situation of strong repression, flaring up into open strife only in the Spanish territories in 1936.

Manifestations of crisis in Russia and other courtiers stimulate the effective use of law resources. Complicated processes in legal sphere encourage exploration of their tendencies and new vectors. Acknowledgement of the supremacy of law is not accompanied by a single-line trend of ensuring its actual high role in the society, one can observe phenomena of lawlessness and legal nihilism. That is why it is important to search for new aspects of legal regulation, among other things, by means of using alternative social regulators. In particular, we mean other alternative social norms that do not contradict the law, including non-state sources of law-making and self-regulation. Such phenomena can be observed both in the national law and in the sphere of international legal regulation where new forms of international obligations and self-commitments of states are successfully applied along with the traditional contract forms. Tangling of the abovementioned vectors is weakened by the tendency to power struggle with the law, when violence breaks down the legal framework foundations. That is why values, principles and fair legal rules enrich the social potential of the law.

<p class="Iabstrak"><strong>Abstract</strong>: <em>The purpose of this study is to know how the changes of the social impact the role and the position of the ulama. Urban society is the real phenomena that happen for the coming of the industrialization era, or in another word that the urban society is the manifest of the industrial society. The writer sees the urban society phenomena as similar as the industrial society. This is a library research, which takes the source of study from the books and other literature related to the topic. The source of data is classified into two parts, the primary source, and the secondary one. As analysis technique, the writer uses the content analysis with the classification of sign-vehicles; which relies solely upon the judgments which theoretically, may range from perceptual discrimination to sheer guesses of analyst or group of analyst’s judgment are regarded as the report of the scientific observer. Finally, it is found that in urban society after coming of the industrialization era. The role and the position of ulama have changed. The ulama in urban society is not the social category again, but the parameter of ulama in urban society is the intellectual one. The position of ulama is not like a kyai or a teacher anymore such as what happened in pre-industrial or semi-industrial, but the ulama become the partner of people</em>. <strong></strong></p><p><strong>Abstrak</strong>: Paper ini bermaksud untuk mengetahui perubahan pada masyarakat terkait dengan peran dan posisi ulama pada masyarakat urban. Masyarakat urban merupakan fenomena nyata pada era industrialisasi. Dengakn kata lain, masyarakat urban merupakan manifestasi dari masyarakat industrial. Penulis melihat fenomena yang serupa antara masyarakat urban dengan masyarakat industri. Tulisan ini merupakan riset kepustakaan yang mengambil sumber data dari buku dan literatur lain yang relevan. Sumber data diklasifikasi menjadi dua bagian, sumber data primer dan sumber data sekunder. Untuk analisis digunakan analisis isi yang mengklasifikasi tanda baca, yang didasarkan pada penilaian secara teoritis, berkisar dari diskriminasi persepsi sampai dugaan analisis atau kelompok penilaian analisis yang dipandang sebagai laporan ilmiah. Temuan dari penelitian ini bahwa masyarakat urban muncul sesudah era industrialisasi. Peran dan posisi ulama telah berubah. Ulama pada masyarakat urban bukan lagi semata pada kategori sosial, tetapi parameter ulama pada masyarakat urban ada pada aspek intelektualitasnya. Posisi ulama bukan lagi Kyai atau guru sebagaimana fenomena pada masyarakat pra industri atau semi industri, tetapi ulama menjadi patner masyarakat.</p>

This article examines different forms of Ukrainian migrant women’s social remittances, articulating some results of two ethnographic studies: one focused on the migration of Ukrainian women to Italy, and the other on the social impact of emigration in Ukraine. First, the paper illustrates the patterns of monetary remittance management, which will be defined as a specific form of social remittance, since they are practices shaped by systems of norms challenged by migration. In the second part, the article moves on to discuss other types of social remittances transferred by migrant women to their families left behind: the right of self-care and self-realisation; the recognition of alternative and more women-friendly life-course patterns; consumption styles and ideas on economic education. Therefore, I will explore the contents of social remittances, but also the gender and intergenerational conflicts that characterise these flows of cultural resources.
