Although people with autism are protected under the Americans with Disabilities Act of 1990, there is little theoretical or practical effort to determine whether traditional pre-employment assessments unfairly impact autistic job seekers. Due to the lack of emphasis on social communication, game-based assessments (GBAs) may offer a way of assessing candidate ability without disadvantaging autistic candidates. A total of 263 autistic job seekers took one of two game-based assessment packages designed to measure cognitive ability. After comparing their results to 323 college-graduate job seekers in the general population, we found that performance on the GBAs was generally similar in both populations, although some small differences were detected. Implications for hiring decisions are discussed.

Only 8.8% of faculty have reported receiving formal training for develop-ing ADA (Americans with Disabilities Act) compliant online courses (Gould & Harris, 2019), yet in any given semester, faculty may be required by federal law to make their course accessible for a student that has enrolled with a disability. Linguis-tics faculty face many of the same challenges (namely time and resources) as other disciplines with implementing ADA federal guidelines. However, there are further obstacles with linguistic specific topics (such as dialect illustrations, phonology, morphology) that require special attention when devising accessible material for those that are either visually or hearing impaired. Through the exploration of an un-dergraduate linguistics course (LING 2050: Language of Now), this paper reflects on best practices, suggested modifications, barriers in developing an ADA compliant online linguistics course, and presents a resource developed by the author aggregat-ing resources that facilitate making a course ADA compliant.

Part I of the paper discusses the Americans with Disabilities Act or ADA, its requirements, and various protections for persons who suffer from a recognized disability which impacts their ability to work under certain circumstances and conditions. The context of this study is American higher education. Part II will discuss the obligation of an employer to offer a “reasonable accommodation” of the nature sought by an employee which would permit the employee to continue teaching while otherwise meeting all of the obligations imposed on faculty members under appropriate university policies. Specifically, the research question considered in Part II relates to whether “commuting” is a covered activity under the ADA which would trigger the responsibility of providing the employee with a reasonable accommodation, allowing an employee to teach in the employee’s preferred combination of online and hybrid modalities.

While there are many contestations surrounding the significance, meanings, and interpretations of dis/ability in the field of critical cultural studies, the author presents a variety of foundational as well as emergent concepts, structures, and histories in order to situate these debates. The 30th anniversary of the Americans with Disabilities Act in 2020, increasingly frequent criticisms of the “sea of whiteness” in disability critique, and an attendant call for equitable attention to intersectional theorization and practice, accompanied by a variety of frameworks, are employed to introduce the relevance of these contestations as well as to equip readers with opportunities to engage and study further.

This article offers a glimpse of the Americans with Disabilities Act (“ADA”) of 1990, as amended by the ADA Amendments Act of 2008 (“ADAAA”), at its 30th anniversary. It considers current issues before the courts, primarily legal cases from 2020 and 2021, and new questions in light of the COVID-19 pandemic, such the latitude of the ADA’s antidiscrimination protections and its definition of disability. It provides a quick primer on the basics of the ADA: employment discrimination under Title I, antidiscrimination mandates for state and local governments under Title II, and commands to places of accommodation offering services to the public under Title III. The ADA at 30 remains a beacon for a future in which all people, regardless of individual difference, will be welcomed as full and equal members of society.
